Now I won\u2019t be fined.\u2019<\/p>\n<\/div>\n<p>Firms that rely on trial advocacy need their lawyers to, you know, go to trial. It\u2019s like calisthenics and attorneys who aren\u2019t routinely going through the crucible of trial can see their skills atrophy. Consider Rudy Giuliani, who used to appear in court all the time as a federal prosecutor and now he thinks <a href=\"https:\/\/abovethelaw.com\/2025\/01\/rudy-guilianis-legal-strategy-is-performance-art\/\" target=\"_blank\" rel=\"noopener nofollow\">this is an acceptable courtroom strategy<\/a>.<\/p>\n<p>But can a firm introduce financial incentives to push its lawyers into court. Potentially to the detriment of their clients? This conversation kicked off after an interesting LinkedIn post from <a href=\"https:\/\/mockingbird.marketing\/\" target=\"_blank\" rel=\"noopener nofollow\">Mockingbird Marketing<\/a> president and <a href=\"https:\/\/legaltalknetwork.com\/podcasts\/lunch-hour-legal-marketing\/\" target=\"_blank\" rel=\"noopener nofollow\">Lunch Hour Legal Marketing<\/a> podcast co-host Conrad Saam:<\/p>\n<p><a href=\"https:\/\/www.linkedin.com\/posts\/conradsaam_talking-with-a-law-firm-coo-of-a-large-pi-activity-7284332067666935811-jYG6?utm_source=share&amp;utm_medium=member_desktop\" rel=\"nofollow noopener\" target=\"_blank\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-1079773\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/2025\/01\/Screenshot-2025-01-14-at-9.05.17%E2%80%AFAM.png?resize=545%2C142&#038;ssl=1\" alt=\"Screenshot 2025-01-14 at 9.05.17\u202fAM\" width=\"545\" height=\"142\" title=\"\"><\/a><\/p>\n<p>Imagine the client suffering from a debilitating injury rejecting a big-ticket settlement offer and then heading into court as their lawyer turns to them and explains\u2026<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-1079772\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/2025\/01\/tenor-108713229.gif?resize=400%2C391&#038;ssl=1\" alt=\"tenor-108713229\" width=\"400\" height=\"391\" title=\"\"><\/p>\n<p>If the firm considers a lawyer picking up a pro bono criminal trial on behalf of a client that the prosecutors refuse to deal with because they know they\u2019ve got him up against a three-strikes law or something, that\u2019s fine. But if the firm is telling its attorneys to potentially compromise the best interests of their clients to pad their own wallets?<\/p>\n<p>That feels like an ethical problem:<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-1079803\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/2025\/01\/Screenshot-2025-01-14-at-9.21.24%E2%80%AFAM.png?resize=519%2C171&#038;ssl=1\" alt=\"Screenshot 2025-01-14 at 9.21.24\u202fAM\" width=\"519\" height=\"171\" title=\"\"><\/p>\n<p>Or put more entertainingly:<\/p>\n<p>And the lawyer\u2019s problem might not be limited to the disciplinary authorities. Clients and malpractice carriers could find themselves involved:<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-1079804\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/2025\/01\/Screenshot-2025-01-14-at-9.21.38%E2%80%AFAM.png?resize=534%2C105&#038;ssl=1\" alt=\"Screenshot 2025-01-14 at 9.21.38\u202fAM\" width=\"534\" height=\"105\" title=\"\"><\/p>\n<p>More often than not, the client\u2019s insurance carrier is probably trying to screw them and going to trial is in the best interest of the client anyway. But some lawyer getting toward the end of the year without a trial is incentivized by this policy to take risks that could disadvantage the client.<\/p>\n<p>But consider this scenario\u2026<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-1079774\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/2025\/01\/Screenshot-2025-01-14-at-9.17.36%E2%80%AFAM.png?resize=514%2C148&#038;ssl=1\" alt=\"Screenshot 2025-01-14 at 9.17.36\u202fAM\" width=\"514\" height=\"148\" title=\"\"><\/p>\n<p>One probably wouldn\u2019t balk at the idea of awarding bigger bonuses for trial work \u2014 or at the very least awarding bigger bonuses for bigger recoveries, which would be a likely proxy \u2014 but isn\u2019t that functionally the same? The lawyer not going to trial is still making less than peers who are.<\/p>\n<p>Is there something uniquely problematic about structuring the policy as a disincentive rather than an incentive?
