Photo: Ekem via Wikimedia Commons<\/figcaption><\/figure>\n<h2><i>Purdue<\/i> Pops Up in Talc Bankruptcy Objections<\/h2>\n<p>The<b>U.S. Trustee<\/b>, several insurance firms and a coalition of talc claimants objected to<b>Johnson &amp; Johnson<\/b>\u2019s proposed $10 billion bankruptcy plan ahead of a key Feb. 18 hearing.<\/div>\n<div data-v-e97bc92c=\"\">\n<p><a href=\"https:\/\/www.law.com\/texaslawyer\/2025\/01\/28\/us-trustee-insurers-object-to-jjs-10b-talc-bankruptcy-plan\/\" target=\"_blank\" rel=\"nofollow noopener\">Here\u2019s my coverage<\/a> of the objections, which cite the <b>U.S. Supreme Court<\/b>\u2019s 2024 ruling that dismantled <b>Purdue Pharma<\/b>\u2019s $6 billion bankruptcy plan by invalidating nonconsensual releases granted to the Sacklers, who founded the opioid drug manufacturer. The releases and injunctions are the same for Johnson &amp; Johnson, whose subsidiary <b>Red River Talc<\/b> filed the Chapter 11 case last year, according to the talc objections.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p><b>Johnson &amp; Johnson Worldwide Vice President of Litigation Erik Haas<\/b> disagreed, stating that the <i>Purdue<\/i> decision actually validates the talc bankruptcy plan.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p>But there are other arguments, many of which are contained in the motions to dismiss the talc bankruptcy, such as allegations of Johnson &amp; Johnson\u2019s bad faith and Red River\u2019s lack of financial distress. Objections also repeated criticisms of the solicitation process that Johnson &amp; Johnson claimed gave its plan the support of 83% of talc claimants. The U.S. Trustee\u2019s Office, in its objection, added new concerns about solicitation occurring last month, citing a Dec. 19 email to plaintiffs\u2019 firms from Johnson &amp; Johnson attorney <a href=\"https:\/\/btlaw.com\/en\/people\/james-murdica\" target=\"_blank\" rel=\"nofollow noopener\">Jim Murdica<\/a> (<b>Barnes &amp; Thornburg<\/b>) that touted \u201csubstantial improvements\u201d to the plan.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p>In a Jan. 28 filing, 26 plaintiffs\u2019 firms joined the <b>Coalition of Counsel for Justice for Talc Claimants<\/b> in objecting to the plan. They include <b>Bernstein Liebhard<\/b>, <b>Goza &amp; Honnold<\/b>, <b>Hilliard Law<\/b>, <b>Saltz Mongeluzzi<\/b> and <b>Wagstaff &amp; Cartmell<\/b>.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p class=\"alignnone\">\n<figure id=\"figure_00000194-af34-d7d6-ab97-af7fe51a0000\"><img data-recalc-dims=\"1\" decoding=\"async\" id=\"00000194-af34-d7d6-ab97-af7fe51a0000\" class=\"alignnone\" src=\"https:\/\/i0.wp.com\/k2-prod-alm.s3.us-east-1.amazonaws.com\/brightspot\/bd\/0e\/4db7bfb44f919ad8353446e67942\/california-wldfire-767x633-2.jpg?w=1080&#038;ssl=1\" alt=\"image\" title=\"\"><figcaption>Firefighters work to contain wildfires near Eaton Canyon in California on Thursday, January 9, 2025. Photo: Amanda Bronstad\/ALM.<\/figcaption><\/figure>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<h2>\u2018Arcing and Sparking\u2019: Wildfires Take Different Paths<\/h2>\n<p>As the number of lawsuits filed against <b>Southern California Edison<\/b> over the Eaton fire jumps to 30, some plaintiffs\u2019 lawyers are suing over the Palisades fire.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p>Both wildfires ripped through Southern California starting on Jan. 7, causing the destruction of more than 16,000 structures and 29 deaths. At least <a href=\"https:\/\/www.law.com\/therecorder\/2025\/01\/24\/no-two-wildfires-alike-lawyers-take-different-legal-strategies-in-california\/\" target=\"_blank\" rel=\"nofollow noopener\">three lawsuits<\/a> have been filed against the <b>City of Los Angeles<\/b> and the <b>Los Angeles Department of Water &amp; Power<\/b> for failing to have a 117 million-gallon reservoir available when firefighters faced the Palisades wildfire. But unlike Southern California Edison, neither defendant, as government agencies, can be held liable under California law for failing to provide fire protection. So, the suits only allege inverse condemnation\u2014not negligence or punitive damages.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p>Meanwhile, in the Eaton fire litigation, plaintiffs\u2019 firm <b>Edelson<\/b> was back in court on Monday after discovery unearthed <a href=\"https:\/\/vimeo.com\/1050536872?&amp;login=true#_=\" target=\"_blank\" rel=\"nofollow noopener\">this video<\/a> from a gas station\u2019s security camera of the Eaton fire \u201carcing and sparking\u201d before exploding on Jan. 7. A Los Angeles judge extended his temporary restraining order for Southern California Edison to preserve evidence through Feb. 18.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p>In court documents, Southern California Edison attorneys at <b>Hueston Hennigan<\/b> criticized Edelson for its overbroad discovery requests. <a href=\"https:\/\/edelson.com\/staff\/ali-moghaddas\/\" target=\"_blank\" rel=\"nofollow noopener\">Ali Moghaddas<\/a> (<b>Edelson<\/b>) wrote in a Monday update:<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p><i>&#8220;Defendants have repeatedly endeavored to mislead the public about the cause of the fire, first by having Edison International CEO falsely claim that they had not detected any electrical anomalies on its equipment leading up to Eaton fire, and then by suggesting that a homeless encampment might be to blame. But our justice system is a public one.&#8221;<\/i> <\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p class=\"alignnone\">\n<figure id=\"figure_00000194-af36-debd-afbe-efbf54890000\"><img data-recalc-dims=\"1\" height=\"633\" width=\"767\" decoding=\"async\" id=\"00000194-af36-debd-afbe-efbf54890000\" class=\"alignnone\" src=\"https:\/\/i0.wp.com\/k2-prod-alm.s3.us-east-1.amazonaws.com\/brightspot\/cd\/5e\/80def67940378bb203389f38ef09\/christopher-ayers-767x633.jpg?resize=767%2C633&#038;ssl=1\" alt=\"image\" title=\"\"><figcaption>Christopher Ayers, Seeger Weiss. Courtesy photo.<\/figcaption><\/figure>\n<h2>Who Gets the Work?<\/h2>\n<p>A federal judge named four lawyers as interim class counsel in three consolidated lawsuits over a \u201cforever chemical\u201d in <b>Band-Aids<\/b>. On Jan. 22, <b>U.S. District Judge Michael Shipp<\/b>, in the <b>District of New Jersey<\/b>, appointed <a href=\"https:\/\/www.seegerweiss.com\/team\/christopher-ayers\/\" target=\"_blank\" rel=\"nofollow noopener\">Christopher Ayers<\/a> (<b>Seeger Weiss<\/b>), James Cecchi (<b>Carella Byrne<\/b>), Joshua Arisohn (<b>Bursor &amp; Fisher<\/b>) and <a href=\"https:\/\/millerlawpc.com\/attorneys\/e-powell-miller\/\" target=\"_blank\" rel=\"nofollow noopener\">E. Powell Miller<\/a> (<b>Miller Law<\/b>). He also appointed a plaintiffs\u2019 executive committee: <a href=\"https:\/\/lfsblaw.com\/attorneys\/charles-e-schaffer\/\" target=\"_blank\" rel=\"nofollow noopener\">Charles Schaffer<\/a> (<b>Levin Sedran<\/b>), <a href=\"https:\/\/www.sultzerlipari.com\/our-attorneys\/jason-p-sultzer\/\" target=\"_blank\" rel=\"nofollow noopener\">Jason Sultzer<\/a> (<b>Sultzer &amp; Lipari<\/b>), <a href=\"https:\/\/kolawyers.com\/professionals\/kristen-cardoso\/\" target=\"_blank\" rel=\"nofollow noopener\">Kristen Cardoso<\/a> (<b>Kopelowitz Ostrow<\/b>) and <a href=\"https:\/\/www.weitzlux.com\/our-attorneys\/james-bilsborrow\/\" target=\"_blank\" rel=\"nofollow noopener\">James Bilsborrow<\/a> (<b>Weitz &amp; Luxenberg<\/b>). The lawsuits allege that <b>Johnson &amp; Johnson<\/b> and its spin-off company, <b>Kenvue<\/b>, sold Band-Aid bandages containing unsafe levels of PFAS.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p>Here\u2019s what else is happening:<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p><b>Purdue 2.0<\/b>: Attorneys general from 15 states announced <a href=\"https:\/\/www.law.com\/2025\/01\/23\/states-reach-new-74b-opioid-deal-with-purdue-after-scotus-ruling\/\" target=\"_blank\" rel=\"nofollow noopener\">a new $7.4 billion opioid settlement<\/a> with <b>Purdue Pharma<\/b> and its founders, the Sacklers, after the <b>U.S. Supreme Court<\/b> upended a prior deal. The new deal includes $6.5 billion from the Sacklers and no nonconsensual releases, which the Supreme Court invalidated in a 5-4 ruling last year in <i>Harrington v. Purdue Pharma<\/i>. It also provides $3.1 billion in additional payments than the original 2021 deal.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p><b>Uber Upended<\/b>: The <b>Nevada Supreme Court<\/b> <a href=\"https:\/\/www.law.com\/2025\/01\/27\/nevada-supreme-court-rejects-uber-backed-ballot-initiative-for-20-fee-cap\/\" target=\"_blank\" rel=\"nofollow noopener\">struck down<\/a> an <b>Uber<\/b>-backed ballot initiative designed to cap contingency fees in the state\u2019s civil cases at 20%. Monday\u2019s unanimous opinion found that the description of the initiative\u2019s effect was \u201clegally insufficient\u201d and \u201cmisleading and confusing.\u201d Uber, which faces 250 sexual assault cases in multidistrict litigation in <b>California\u2019s Northern District<\/b>, bankrolled $5 million to support the measure, proposed by <b>Nevadans for Fair Recovery<\/b>. Two other groups, <b>Uber Sexual Assault Survivors for Legal Accountability<\/b> and the <b>Nevada Justice Association<\/b>, represented by <a href=\"https:\/\/www.guptawessler.com\/people\/deepak-gupta\/\" target=\"_blank\" rel=\"nofollow noopener\">Deepak Gupta<\/a> (<b>Gupta Wessler<\/b>), sued last year to challenge the measure, which was slated to go on the 2026 ballot.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p><b>Damages Dispute<\/b>: Plaintiffs\u2019 lawyers have <a href=\"https:\/\/www.law.com\/thelegalintelligencer\/2025\/01\/22\/plaintiff-argues-jurys-22m-punitive-damages-finding-undermines-jjs-talc-trial-win\/\" target=\"_blank\" rel=\"nofollow noopener\">asked for a new talc trial <\/a>after a jury in Pittsburgh returned a defense verdict earlier this month for <b>Johnson &amp; Johnson<\/b> but awarded their client $22 million in punitive damages. Jurors in <b>Allegheny County Court of Common Pleas<\/b> on Jan. 6 found Johnson &amp; Johnson had <a href=\"https:\/\/www.law.com\/thelegalintelligencer\/2025\/01\/07\/pittsburgh-jury-tries-to-award-22m-against-jj-in-talc-case-despite-handing-up-defense-verdict\/\" target=\"_blank\" rel=\"nofollow noopener\">acted negligently<\/a>, but its conduct was not the cause of Michaeleen Lee\u2019s death from mesothelioma. <a href=\"https:\/\/dobslegal.com\/person\/jessica-dean\/\" target=\"_blank\" rel=\"nofollow noopener\">Jessica Dean<\/a> (<b>Dean Omar<\/b>), who represented Lee, said the judge did not seek out more clarity from the jury following the verdict.<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p><i>Thanks for reading Critical Mass!
