Texas alleges that the doctor mailed mifepristone to a 20-year-old woman in Collin County, Texas, who was later turned in by her romantic partner. Dr. Carpenter is also under <a href=\"https:\/\/www.nytimes.com\/2025\/01\/31\/health\/abortion-louisiana-new-york-prosecution-shield-law.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">criminal indictment<\/a> in Louisiana for helping a woman there. <\/p>\n<p>Under New York\u2019s shield law, passed in 2023 after the <em>Dobbs<\/em> decision, the state will not cooperate with out-of-state civil or criminal process relating to abortion (as well as gender-affirming care). Last month, the state denied a demand to extradite the doctor to Louisiana, and now it\u2019s refusing to register the civil judgment against her.<\/p>\n<p>\u201cToday, I informed Texas State Attorney General Ken Paxton that the Ulster County Clerk\u2019s Office will not be filing a summary judgment against a New Paltz physician who is facing charges in Texas for providing mifepristone via telehealth to a Texas resident,\u201d Acting Clerk Taylor Bruck <a href=\"https:\/\/clerk.ulstercountyny.gov\/news\/countyclerk\/327-clerk-rejects-filing-texas-attorney\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">said<\/a> in a statement on the county\u2019s website. \u201cIn accordance with the New York State Shield Law, I have refused this filing and will refuse any similar filings that may come to our office.\u201d<\/p>\n<p>The Times Union, which <a href=\"https:\/\/www.timesunion.com\/hudsonvalley\/news\/article\/abortion-shield-law-texas-ulster-county-lawsuit-20242224.php\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">originally reported<\/a> the story, interviewed Bruck, who clearly understands that he\u2019s about to be in middle of a maelstrom that may turn him into the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Kim_Davis\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Kim Davis<\/a> of the left. <\/p>\n<p>\u201cAny future lawsuit will provide the answers for what we have to do going forward, what all clerks will have to do going forward. It will set the precedent,\u201d Bruck told the local paper. \u201cIt\u2019s a bit nerve-wracking just because of the unknown, but it\u2019ll be good to get some answers out of it.\u201d<\/p>\n<p>For his part, Paxton is itching to sue, and his office has already called multiple times demanding an update, despite the state\u2019s 30-day window to domesticate a foreign judgment. He\u2019s got to run again next year, and so the window to get himself in front of the Supreme Court taking on the godless libruls in New York is tight.<\/p>\n<p>But unlike Kim Davis, who <a href=\"https:\/\/www.lawdork.com\/p\/kim-davis-loses-again\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">recently lost<\/a> a protracted appeal to avoid personal liability, Bruck has the support of local politicians and law enforcement. (And New York AG Letitia James is not exactly afraid of the spotlight either.)<\/p>\n<p>\u201cThe anti-woman, anti-abortion zealots are at it again,\u201d Governor Kathy Hochul <a href=\"https:\/\/www.governor.ny.gov\/news\/statement-governor-kathy-hochul-68\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">said<\/a> this morning, thanking Bruck \u201cfor his courage and common sense.\u201d\u00a0<\/p>\n<p>\u201cTexas AG Ken Paxton chose the wrong community to mess with,\u201d agreed Bruck\u2019s US Rep.
