This morning <\/span><a href=\"https:\/\/abovethelaw.com\/2025\/03\/jenner-block-to-trump-see-you-in-court-not-on-our-knees\/\" rel=\"nofollow noopener\" target=\"_blank\">Jenner &amp; Block<\/a><span> and <\/span><a href=\"https:\/\/abovethelaw.com\/2025\/03\/wilmerhale-strikes-back-with-paul-clement-lawsuit-over-retaliatory-trump-order\/\" rel=\"nofollow noopener\" target=\"_blank\">WilmerHale<\/a><span> filed separate lawsuits challenging the Trump administration\u2019s retaliatory executive orders against them.<\/span><\/p>\n<p>Judge Beryl Howell, the judge overseeing the similar Perkins Coie case, <a href=\"https:\/\/abovethelaw.com\/2025\/03\/biglaw-suits-against-trump-both-reassigned-to-new-judges\/\" rel=\"nofollow noopener\" target=\"_blank\">was spared<\/a> the other Biglaw cases and two judges appointed by George W. Bush got the cases instead. Judge John Bates pulled the Jenner case and Richard Leon nabbed the WilmerHale case. But despite the far right\u2019s obsessive insistence that the only reason the Trump administration keeps losing in court is politics, these two conservative judges issued TROs the same day that the lawsuits were filed.<\/p>\n<p>As Judge Leon wrote:\u00a0<\/p>\n<blockquote>\n<p>\u201cThis prohibition includes retaliatory actions based on perceived viewpoint. The retaliatory nature of the Executive Order at issue here is clear from its face \u2013 not only from Section 1, but also from the Fact Sheet published the same day. Indeed, the Executive Order requires government contracting agencies to disclose , review , and terminate all contracts with the plaintiff \u2013 that is Section 3 \u2013 and restricts WilmerHale employees from access to federal officials, buildings, and employment \u2013 that is Section 5.
