The VPPA prohibited disclosure by the seemingly outdated term \u201ca video tape service provider\u201d of \u201cpersonally identifiable information concerning any consumer of such provider\u201d without the consumer\u2019s consent. \u201cVideo tape service provider\u201d was defined in \u00a72710(a)(4) as \u201cany person, engaged in the business \u2026\u00a0of rental, sale, or delivery\u00a0of prerecorded video cassette tapes or similar audio visual materials.\u201d<\/p>\n<\/div>\n<div data-v-e97bc92c=\"\">\n<p>In <i>Osheske v. Silver Cinemas Acquisition Co.<\/i>, 23-3882, Ninth Circuit federal appeals court Judge M. Margaret McKeown noted in a March 27, 2025, ruling on the VPPA: \u201cThe original impetus for the VPPA arose during President Ronald Reagan\u2019s contested [and rebuked] nomination of Judge Robert Bork to the Supreme Court, when the\u00a0<i>Washington City Paper<\/i>\u00a0published a profile of Judge Bork based on a leaked list of 146 films that he and his family had rented from a local video store.\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The VPPA may be nearly four-decades old and video-rental stores largely a thing of the past, but the rise of online content, streaming services and ancillary activities has brought with it frequent litigation based on the VPPA.
