FBI Director Kash Patel posted a photo of Wisconsin Judge Hannah Dugan\u2019s arrest, accusing her of \u201cintentionally misdirect[ing] federal agents away from the subject to be arrested in her courthouse,\u201d unposted it when every lawyer on social media pointed out that he was poisoning the jury pool and violating prosecutorial ethics, and then <a href=\"https:\/\/x.com\/FBIDirectorKash\/status\/1915920876215701639\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">reposted<\/a> it because FUCKIT WE BALL.<\/p>\n<p>Attorney General Bondi followed up the next day on Fox.<\/p>\n<p>\u201cShe put the lives of our law enforcement officers at risk. She put the lives of citizens at risk,\u201d she <a href=\"https:\/\/www.newsweek.com\/doj-inspector-general-judge-hannah-dugan-fbi-arrest-2066934\" rel=\"nofollow noopener\" target=\"_blank\">vamped<\/a>. \u201cWhat has happened to our judiciary is beyond me\u2026. They are deranged is all I can think of.\u201d<\/p>\n<p>On Tuesday of this week, a grand jury <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.wied.111896\/gov.uscourts.wied.111896.6.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">indicted<\/a> Judge Dugan on two counts of obstructing an arrest. And on Wednesday she filed a banger of a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.wied.111896\/gov.uscourts.wied.111896.15.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">motion to dismiss<\/a>. <\/p>\n<p>Exhibit 1: <em>Trump v. United States<\/em>, 603 U.S. 593 (2024).<\/p>\n<p>\u201cThe problems with this prosecution are legion, but most immediately, the government cannot prosecute Judge Dugan because she is entitled to judicial immunity for her official acts,\u201d she wrote, pointing to the Supreme Court\u2019s decision blowing up the prosecution of the president by inventing a magical cloak of perpetual immunity. \u201cImmunity is not a defense to the prosecution to be determined later by a jury or court; it is an absolute bar to the prosecution at the outset.\u201d<\/p>\n<p>If Donald Trump can\u2019t go to jail for \u201cpresident stuff,\u201d up to and including obstructing Congress, then judges can\u2019t be prosecuted for telling defendants to go out a side door.<\/p>\n<p>Particularly since the affirmative acts listed in the indictment are pretty clearly part of the judge\u2019s official duties to manage her own courtroom and courthouse. Those include: telling ICE to get out of the hallway; demanding a judicial, rather than administrative warrant; telling a defendant in her courtroom he could go out the jury exit; speaking to the Chief Judge; and allowing the defendant to appear remotely for his next hearing.<\/p>\n<p>Yes, even if the judge\u2019s motivation was to ensure that the defendant didn\u2019t get arrested by ICE in her courthouse.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Judge Dugan\u2019s subjective motivations are irrelevant to immunity. \u201cJudges are entitled to absolute immunity for their judicial acts, without regard to the motive with which those acts are allegedly performed.\u201d Id.; accord Trump v. United States, 603 U.S. at 618 (\u201cIn dividing official from unofficial conduct, courts may not inquire into the President\u2019s motives\u201d).<\/p>\n<\/blockquote>\n<p>\u201cThe immunity and federalism issues must be resolved swiftly because the government has no basis in law to prosecute her,\u201d Judge Dugan\u2019s lawyers argued, echoing the exact same arguments that (now) Solicitor General John Sauer made in <em>Trump v. US<\/em>. \u201cThe prosecution against her is barred. The Court should dismiss the indictment.\u201d<\/p>\n<p>Judge Lynn Adelman is an 85-year-old Clinton appointee who spent 20 years in the Wisconsin legislature before joining the federal bench in 1997. In February of 2020, Judge Adelman wrote a <a href=\"https:\/\/journals.law.harvard.edu\/lpr\/wp-content\/uploads\/sites\/89\/2020\/03\/Adelman.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">banger of his own<\/a> in the Harvard Law and Policy Review, where he excoriated the Roberts Court for \u201cactively participating in undermining American democracy.\u201d<\/p>\n<p>\u201cThe Court\u2019s decisions are undermining the democratic republic that the American people, often led by subordinated groups, have fought for,\u201d he wrote. \u201cAnd this is happening at a time when democratic institutions need strengthening.\u201d<\/p>\n<p>The court has not yet ruled on Judge Dugan\u2019s motion to dismiss, but the one promises to be AMAZING.<\/p>\n<p><a href=\"https:\/\/www.courtlistener.com\/docket\/70255566\/united-states-v-dugan\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">US v.
