True to form, the organization doesn\u2019t have much evidence backing up its crusade \u2014 yet! \u2014 but they\u2019ve got a plan. <\/p>\n<p>It\u2019s clumsy and amateurish, but it\u2019s a plan nonetheless.<\/p>\n<p>Jonathan Mitchell, who you might remember from masterminding the Texas abortion vigilante law that <a href=\"https:\/\/aws.abovethelaw.com\/2021\/11\/some-geniuses-crash-and-burn-as-supreme-court-mocks-texas-abortion-law\/?_ga=2.230374044.1037686279.1747059778-1910532964.1736435389\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">even this Supreme Court dismissed as rank clownery<\/a>, quarterbacks FASORP\u2019s latest effort <a href=\"https:\/\/chicagomaroon.com\/26482\/news\/uchicago-law-grad-sues-harvard-nyu-law-reviews-all\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">against his alma mater Chicago<\/a>. Mitchell and FASORP previously collaborated with Stephen Miller\u2019s \u201cwokeness ambulance chaser\u201d outfit America First Legal to go after crosstown law school Northwestern over faculty diversity arguing that the school\u2019s <a href=\"https:\/\/abovethelaw.com\/2024\/07\/northwestern-law-school-affirmative-action-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">83 percent white faculty wasn\u2019t white enough<\/a>. Unsurprisingly, the \u201c<a href=\"https:\/\/ballsandstrikes.org\/legal-culture\/northwestern-fasorp-affirmative-action-ugly-racism\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">There are Black people on this faculty, Your Honor<\/a>\u201d argument managed to succeed only in <a href=\"https:\/\/www.reuters.com\/legal\/legalindustry\/latham-northwestern-seek-fees-conservative-group-bias-case-2025-03-27\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">the school seeking attorneys fees<\/a>.<\/p>\n<p>Building on this track record of non-success, Mitchell\u2019s interested in Chicago\u2019s Law Review selection process. It\u2019s the same dreck from the threatened Michigan case: claiming that the use of personal statements in the process amounts to a backdoor diversity initiative \u201cwhich it then uses to to [sic] award race and preferences to students from so-called underrepresented demographics.\u201d<\/p>\n<p>Also \u201cso-called underrepresented demographics\u201d? That\u2019s just a math thing, dude. The proper dog whistle is to say that underrepresentation doesn\u2019t justify anything that might disadvantage a white guy, but you can\u2019t just wish away that these demographics are \u2014 statistically \u2014 underrepresented relative to the population. <\/p>\n<p>Starting to see why this guy had calculator trouble with the 83 percent white faculty at Northwestern.<\/p>\n<p>Anyway, he\u2019s farming for people to help him go after the Law Review:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>You are receiving this e-mail because you served on the University of Chicago Law Review at some point in the last 15 years and have also had some previous involvement with the Federalist Society, which I am using as a proxy (though an admittedly imperfect one) for identifying Law Review alums who are likely to oppose the current regime\u2019s use of race and sex preferences in the selection of Law Review members.<\/p>\n<\/blockquote>\n<p>But I thought the Federalist Society was just a non-partisan debating society?!? Is he suggesting there might be some sort of virulent anti-diversity bias dominating the ranks of an organization that insists on <a href=\"https:\/\/abovethelaw.com\/2025\/02\/dear-federalist-society-its-time-to-lay-off-the-chick-fil-a\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">only eating Chick-fil-A<\/a> because of a publicity stunt from over a decade ago? Perish that thought!<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>I want the complaint to contain as many anecdotes as possible of the Law Review\u2019s use of race and sex preferences, not only in the selection of student members but also articles. I am writing to invite you to submit evidence or anecdotes of race or sex preferences from your time on the Law Review. I am also interested in hearing from anyone who was privy to discussions about whether the Law Review should adopt a personal statement or a policy of awarding race and sex preferences, as my understanding is that these ideas were often proposed (and rejected) before they were finally implemented for the first time in 2017.<\/p>\n<\/blockquote>\n<p>In the immortal words of Lionel Hutz: \u201cWe\u2019ve got plenty of hearsay and conjecture, those are <em>kinds<\/em> of evidence.\u201d Nothing like building a case based on someone\u2019s 8-year-old office bitching. Most litigation sets the bar higher than a complaint made of anonymous anecdotes, but most litigation isn\u2019t breathtakingly stupid. Apparently these anecdotes are a higher priority than, say, an actual plaintiff because this is going out to people who actually made the law review. Not that FASORP puts much effort into finding real plaintiffs \u2014 an issue that\u2019s plagued their efforts for a while now. When they went after NYU Law Review, they could only find someone <a href=\"https:\/\/abovethelaw.com\/2023\/10\/stephen-miller-nyu-law-review-suit\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">who <em>might<\/em> get grades bad enough to miss law review<\/a>. And the Northwestern case comically alleged that FASORP only found people \u201cready and able\u201d to apply to the faculty as opposed to anyone who actually did and would put their name on that tripe.<\/p>\n<p>Ironically, for a case supposedly about meritocracy, building a case on the merits doesn\u2019t seem to be much of a priority.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>You are also welcome to send material over e-mail or Signal.\u00a0<\/p>\n<\/blockquote>\n<p>Whoa. Hold up, is law review gossip important enough for Signal? It\u2019s not like we\u2019re planning a bombing campaign from the Applebee\u2019s bar here.<\/p>\n<p>In ordinary times, we could just laugh at this nonsense and rely upon law schools to vigorously defend these dumb complaints \u2014 and preferably seek fees and sanctions on the back end \u2014 but in a world where the Trump administration is threatening universities for anything that remotely looks like diversity, will schools still try to fight? Some of the biggest law firms in the world have developed a cowardly streak and there\u2019s no reason to believe schools, who generally have fewer resources at their disposal, won\u2019t follow suit. <\/p>\n<p>In a world like that, a complaint filled with unsubstantiated, anonymous gossip might be just enough to extract concessions from a law school.
