Aside from the <a href=\"https:\/\/abovethelaw.com\/2017\/11\/trump-judicial-nominee-is-a-ghost-hunter-proving-the-bar-can-always-go-a-little-lower\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">occasional ghost hunter<\/a>, the GOP-controlled Senate would, by and large, end up confirming them anyway and they would quickly confirm the ABA was <a href=\"https:\/\/abovethelaw.com\/2021\/08\/newsflash-unqualified-federal-judges-are-unqualified\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">right about them all along<\/a>. <\/p>\n<p>But no more!<\/p>\n<p>The Department of Justice just officially cut the American Bar Association out of the judicial nomination vetting process, unmooring the process from any neutral evaluation process and turning it all over to Trump\u2019s gut feeling and Senator Kennedy\u2019s <a href=\"https:\/\/abovethelaw.com\/2017\/12\/senator-embarrassing-judicial-nominees-with-remedial-law-school-questions\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">stupid-ass remedial bar prep questioning<\/a>. Frankly, it\u2019s not even clear we can trust the Federalist Society to have <a href=\"https:\/\/abovethelaw.com\/2025\/05\/trump-reportedly-eyes-emil-bove-for-third-circuit-as-were-now-wistful-for-era-of-random-unqualified-fedsoc-hacks\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">vetted these people at this point<\/a>.<\/p>\n<p>It\u2019s probably not an accident that this comes immediately after Trump nominated Emil Bove to the Third Circuit. The ABA deep dive into bargain bin Roy Cohn promised to be amusing.<\/p>\n<p>Honestly, I thought the administration would pull this stunt sooner. The administration is already slap-fighting with the ABA as <a href=\"https:\/\/abovethelaw.com\/2025\/03\/abas-diversity-requirement-suspension-not-enough-for-pam-bondi\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">the designated law school accreditator<\/a> and the right-wing echo chamber started <a href=\"https:\/\/www.abajournal.com\/news\/article\/aba_president_defends_ratings_of_judicial_nominees_after_gop_senators_claim\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">complaining about the ABA\u2019s judicial vetting function as far back as 2017<\/a>. Making a big production out of cutting off the ABA was as inevitable as Thanos. And so, in a letter so melodramatic it may as well have been delivered via fainting couch, Attorney General Pam Bondi informed the ABA today that it would henceforth be treated like any other \u201cactivist organization.\u201d<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Unfortunately, the ABA no longer functions as a fair arbiter of nominees\u2019 qualifications, and its ratings invariably and demonstrably favor nominees put forth by Democratic administrations. <\/p>\n<\/blockquote>\n<p>You know, Occam\u2019s Razor might have something to say about why Democratic nominees keep scoring better. Something about how the Democrats aren\u2019t <a href=\"https:\/\/abovethelaw.com\/2020\/09\/shocking-no-one-aba-thinks-biglaw-associate-not-ready-for-federal-bench\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">nominating frickin\u2019 associates to the federal bench<\/a>, perhaps? Because it\u2019s worth noting that a LOT of Trump nominees actually have received qualified and well qualified rankings.
