Declining to address questions regarding valid copyright registrations, the U.S. Court of Appeals for the Eighth Circuit reversed a summary judgment order based on the premise that a software management company’s code copyright was invalid because of inaccuracies. <\/p>\n<\/div>\n

On Wednesday<\/a>, the federal appellate court determined there was a factual dispute regarding whether the plaintiff, LADS Network Solutions, had actual knowledge of an error in its source code for a trademark application. LADS, a software management company, filed suit in 2019 against the defendants, Agilis Systems and its subsidiaries, for copyright infringement, claiming Agilis continued to use its system, GPStrac, after its license expired.
