As Marines descended upon Los Angeles to join the National Guard units already questionably legally called up, the Defense Department assured critics that they would only NOT arrest people \u2014 something they cannot legally do \u2014 but <em>merely<\/em> involuntarily detain people to hand over to local law enforcement.  <\/p>\n<p>Which is what the rest of us call \u201can arrest.\u201d<\/p>\n<p>The distinction lovingly crafted by the administration\u2019s Newspeak Generator matters so much because Trump has not invoked the full force of the Insurrection Act. It may be shocking to see <a href=\"https:\/\/www.cnbc.com\/2025\/06\/09\/photos-waymo-fire-la-protests.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">self-driving cars on fire<\/a> \u2014 or more accurately, shocking to see <a href=\"https:\/\/www.tesla-fire.com\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">self-driving cars that aren\u2019t Teslas<\/a> on fire \u2014 but a couple burning cars does not a rebellion make. When storming the Capitol to hang the vice president isn\u2019t an insurrection, it\u2019s hard to see where one even draws the line with this administration. But as long as the Insurrection Act remains holstered, the troops deployed to L.A. are <a href=\"https:\/\/www.thenation.com\/article\/society\/what-the-hell-is-posse-comitatus\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">constrained by Posse Comitatus<\/a>, barring law enforcement activity and limiting the units to support and logistics. In other words\u2026 no arresting people.<\/p>\n<p>As the commanding officer leading the Marine detachment explained, \u201cThey do not do any arrest, they are strictly there to detain, to wait for law enforcement to come and handle those demonstrators.\u201d <\/p>\n<p>Yep, that\u2019s an arrest. An arrest is effected once an individual is no longer free to walk away from the arresting official. It doesn\u2019t matter if they\u2019re being detained by a police officer or a Marine sent in to <a href=\"https:\/\/www.lawandchaospod.com\/p\/ice-riots-in-los-angeles\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">break up a rash of dancing<\/a> like the parents from <em>Footloose<\/em> except with assault rifles \u2014 which, in fairness, the parents from <em>Footloose<\/em> probably would have in 2025. That the detention is for the process of future prosecution only strengthens the case that a reasonable person would see this as an arrest.<\/p>\n<p>Because, you know, they\u2019re holding someone, domestically, so they can face enforcement\u2026 for some sort of law that\u2019s been violated. \u201cDomestic law enforcement,\u201d if you will. The thing that the military cannot do.<\/p>\n<p>At some point, the government will analogize the troops to a retail security guard nabbing a shoplifter and claim that this is no more than a \u201ccitizen\u2019s arrest,\u201d which somehow magically takes this outside the definition of law enforcement. Something about being ziptied by guys in body armor carrying automatic weapons sent there explicitly by order of the government pushes this past what a reasonable person would consider a mere citizen\u2019s arrest.<\/p>\n<p>A CNN report added that the Marines will only be allowed to make these detentions if de-escalation is not working. Yeah, that doesn\u2019t really change anything. A lot of arrests begin as an effort to de-escalate.<\/p>\n<p>As of now, the Marines aren\u2019t out there. They\u2019ve got to finalize their rules governing the use of force, which likely will take more time under the circumstances given that <em>domestic law enforcement is not one of the situations they ever prepared for since it\u2019s patently illegal<\/em>. But once they\u2019re out there, it won\u2019t be long until they \u201cdetain\u201d someone. <\/p>\n<p>Then we begin the countdown to a courtroom showdown over the scope of the executive\u2019s power to sic the armed forces on civilians. <\/p>\n<p>Just kidding. The Supreme Court already agreed that a <a href=\"https:\/\/abovethelaw.com\/2024\/07\/scotus-greenlights-seal-team-6-solution\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">president sending SEAL Team 6 to assassinate a political rival was legal<\/a>.
