A series of federal judges in different jurisdictions \u2014 and appointed by a variety of presidents, <a href=\"https:\/\/abovethelaw.com\/2025\/03\/not-one-but-two-george-w-bush-appointed-judges-grant-restraining-orders-against-trumps-biglaw-executive-orders\/\" rel=\"nofollow noopener\" target=\"_blank\">both Democratic and Republican<\/a> \u2014 have determined the EOs violate the Constitution in an array of ways (specifically the First, Fifth, and Sixth Amendments). Indeed, every Biglaw firm (<a href=\"https:\/\/abovethelaw.com\/2025\/05\/its-official-executive-order-targeting-perkins-coie-is-unconstitutional\/\" rel=\"nofollow noopener\" target=\"_blank\">Perkins Coie<\/a>, <a href=\"https:\/\/abovethelaw.com\/2025\/05\/executive-order-against-jenner-block-is-null-and-void\/\" rel=\"nofollow noopener\" target=\"_blank\">Jenner &amp; Block<\/a>, <a href=\"https:\/\/abovethelaw.com\/2025\/05\/trump-gets-ass-kicked-again-this-time-its-the-order-against-wilmer\/\" rel=\"nofollow noopener\" target=\"_blank\">WilmerHale<\/a>, and<a href=\"https:\/\/abovethelaw.com\/2025\/06\/trump-is-0-4-defending-his-biglaw-executive-orders\/\" rel=\"nofollow noopener\" target=\"_blank\"> Susman Godfrey<\/a>) that challenged the EOs in court were granted summary judgment.<\/p>\n<p>But you just know Trump isn\u2019t going to rest until Sam Alito has an opportunity to weigh in. <\/p>\n<p>That\u2019s right, the Department of Justice filed a <a href=\"https:\/\/assets.law360news.com\/2359000\/2359342\/https-ecf-dcd-uscourts-gov-doc1-045111476983.pdf\" rel=\"nofollow noopener\" target=\"_blank\">notice of appeal<\/a> to the D.C. Circuit in the Perkins Coie matter, chronologically<a href=\"https:\/\/abovethelaw.com\/2025\/03\/perkins-coie-drags-trump-administration-clear-to-hell-in-new-lawsuit\/\" rel=\"nofollow noopener\" target=\"_blank\"> the first case to challenge the Biglaw EOs<\/a>. While the basis for the appeal isn\u2019t listed, we know the <a href=\"https:\/\/abovethelaw.com\/2025\/05\/the-biglaw-executive-orders-get-the-fedsoc-echo-chamber-treatment\/\" rel=\"nofollow noopener\" target=\"_blank\">MAGA legal brain trust has been test driving arguments<\/a> in defense of the EOs that all basically boil down to \u201cI\u2019m the president and I can do what I want.\u201d Which might sound vapid and unserious, but <a href=\"https:\/\/abovethelaw.com\/2025\/06\/supreme-court-declares-open-season-on-public-education\/\" rel=\"nofollow noopener\" target=\"_blank\">after the<\/a> latest<a href=\"https:\/\/abovethelaw.com\/2025\/06\/sam-alito-provides-breath-of-fresh-air-in-transgender-care-case-vile-bigoted-fresh-air-but-fresh-air-nonetheless\/\" rel=\"nofollow noopener\" target=\"_blank\"> eye-popping<\/a> set of <a href=\"https:\/\/abovethelaw.com\/2025\/06\/supreme-court-unpersons-nationwide-injunctions-babies-rule-of-law\/\" rel=\"nofollow noopener\" target=\"_blank\">decisions <\/a>from the Supreme Court, well, you\u2019d be justified in being at least a little nervous.<\/p>\n<p>But\u00a0Perkins Coie is projecting nothing but confidence and strength, saying in a statement, \u201cThe courts have permanently blocked all four unlawful executive orders targeting law firms because those orders violate core constitutional freedoms.\u201d<\/p>\n<p>\u201cWe look forward to presenting our case to the D.C.
