It\u2019s not a question. This was treason. It\u2019s time to go after people.\u201d<\/p>\n<p>Hmmm.\u00a0\u201cGo after people.\u201d\u00a0Going after people for treason sure sounds like criminal prosecutions to me.<\/p>\n<p>So let\u2019s think about what Trump, and others in his administration, said repeatedly about whether the government could \u201cgo after\u201d a former president of the United States when the Supreme Court was considering the possibility of presidential immunity from criminal prosecution.<\/p>\n<p>Trump\u2019s lawyer, John Sauer, now the solicitor general of the United States,\u00a0<a href=\"https:\/\/www.yahoo.com\/news\/articles\/immunity-not-thee-trump-flip-221406244.html\" rel=\"nofollow noopener\" target=\"_blank\">insisted<\/a>\u00a0that\u00a0\u201cWithout presidential immunity from criminal prosecution, there can be no presidency as we know it.\u201d<\/p>\n<p>Whoa! Obama sure needs immunity.\u00a0Without immunity, there\u2019d be \u201cno presidency.\u201d\u00a0That sounds mighty bad.<\/p>\n<p>Before the Supreme Court,\u00a0<a href=\"https:\/\/www.aclu.org\/press-releases\/supreme-court-grants-trump-broad-immunity-for-official-acts-placing-presidents-above-the-law\" rel=\"nofollow noopener\" target=\"_blank\">Trump argued<\/a>\u00a0that he had\u00a0absolute immunity for all acts unless Trump had been convicted after an impeachment trial.\u00a0The Supreme Court rejected that absurdity, characterizing it as endorsing a \u201cfar broader immunity than the limited one\u201d the court \u201crecognized\u201d today.\u00a0<\/p>\n<p>But they accepted another of Trump\u2019s arguments.\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\" rel=\"nofollow noopener\" target=\"_blank\">According to<\/a>\u00a0the Supreme Court:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Trump argued that all of the indictment\u2019s allegations fell within the core of his official duties.
