It\u2019s pretty simple: Article III-appointed judges are to hold their office during good behavior. It seems like the U.S. Court of Appeals for the Federal Circuit has taken it upon themselves to redefine \u201cgood behavior\u201d to include not making everyone else on the panel look foolish by dissenting and then having your opinion taken up by the Supreme Court. Newman has made a habit of this, even having one of her opinions <a href=\"https:\/\/ipwatchdog.com\/2024\/04\/16\/newmans-counsel-says-supreme-courts-agreement-dissent-proves-mental-fitness\/id=175364\/\" rel=\"nofollow noopener\" target=\"_blank\">affirmed by the Supreme Court <em>during<\/em> the Federal Circuit\u2019s<\/a> decision to functionally impeach her. Despite the Supreme Court and <a href=\"https:\/\/abovethelaw.com\/2024\/09\/huge-development-in-pauline-newmans-case-the-test-results-are-in\/\" rel=\"nofollow noopener\" target=\"_blank\">several medical doctors<\/a> supporting her mental acuity, the Federal Circuit has decided to renew her suspension. <a href=\"https:\/\/www.reuters.com\/legal\/legalindustry\/us-appeals-court-extends-suspension-98-year-old-judge-fitness-probe-2025-07-28\/\" rel=\"nofollow noopener\" target=\"_blank\">Reuters<\/a> has coverage:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The U.S. Court of Appeals for the Federal Circuit said on Monday that it would extend its suspension of 98-year-old judge Pauline Newman for another year after determining that she had not complied with an internal investigation into her fitness to serve on the Washington, D.C.-based court.<\/p>\n<\/blockquote>\n<p>The Court justified their decision by saying that Judge Newman \u2014 despite already submitting to neurological tests by lead doctors in the field \u2014 must take a \u201ca full neuropsychological battery of tests\u201d to determine if she is capable of serving as a judge. This reasoning shouldn\u2019t be unfamiliar to readers who saw <a href=\"https:\/\/abovethelaw.com\/2023\/10\/pauline-newman-speaks-atl-interviews-the-judge-whos-fighting-to-do-her-job\/\" rel=\"nofollow noopener\" target=\"_blank\">our Q&amp;A with Newman from about two years ago<\/a>. In it, she half-jokingly responded to the then accusation that she wasn\u2019t fit to judge because she suffered a heart attack:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>[S]aying and publishing that I had a heart attack when I never did, saying that I have a stent. It\u2019s easy enough to find if someone has a stent. To which my answer was, I have no need to go through a head to toe MRI.
