As the months dragged on, and the firms lost <a href=\"https:\/\/abovethelaw.com\/2025\/05\/paul-weiss-rainmakers-bolt-to-start-new-firm-free-of-trump-deal-restrictions\/\" rel=\"nofollow noopener\" target=\"_blank\">more talent<\/a> and <a href=\"https:\/\/abovethelaw.com\/2025\/05\/microsoft-boots-trump-capitulator-simpson-thacher-awards-business-to-jenner-block\/\" rel=\"nofollow noopener\" target=\"_blank\">more clients<\/a>, stories started cropping up suggesting that the firms viewed the deals as unenforceable all along and that it\u2019s business as usual over there. The firms never <em>officially<\/em> said this, of course. None of them would stick their head above the trench to say such a thing directly. But news article fodder kept drip, drip, dripping out that the firms were really just fine \u2014 in fact, they still take on a few matters that challenge the administration! Earlier this week, <a href=\"https:\/\/www.law.com\/americanlawyer\/2025\/08\/18\/in-trumps-battle-with-big-law-has-leverage-shifted\/\" rel=\"nofollow noopener\" target=\"_blank\">the American Lawyer<\/a> ran a piece wondering \u201chas leverage shifted?\u201d in the Trump-Biglaw relationship, chronicling work the firms are doing against the administration. <\/p>\n<p>At the time, I mused that the headline all but guaranteed the other shoe was about to drop. And here we are.<\/p>\n<p>It turns out, despite the firms providing the media with flashy exceptions to prove the rule, the Trump administration indeed still holds the leverage. The New York Times reported last week that Kirkland and Skadden were doing trade work for the Commerce Department, but couldn\u2019t confirm if they were getting paid for it. Now the Times can confirm that Kirkland <em>and Paul Weiss<\/em> are <a href=\"https:\/\/www.nytimes.com\/2025\/08\/20\/us\/politics\/law-firms-free-work-trump-administration.html\" rel=\"nofollow noopener\" target=\"_blank\">repping the Commerce Department for free<\/a>, presumably as part of their pro bono payola deals. Skadden\u2019s situation is still up in the air.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>In the past, some law firms have done work for the federal government at a reduced rate. But coming just months after they struck deals with the president, the free work is likely to raise new questions about whether the firms felt compelled to do so to stay in Mr. Trump\u2019s good graces.<\/p>\n<\/blockquote>\n<p>So much for those grand declarations the firms <a href=\"https:\/\/abovethelaw.com\/2025\/05\/trumps-biglaw-bootlickers-letters-to-congress\/\" rel=\"nofollow noopener\" target=\"_blank\">sent to Congress just a few months back<\/a>. Despite explicit claims from the administration that, under the deal, the firms would be conscripted to <a href=\"https:\/\/www.wsj.com\/livecoverage\/stock-market-trump-tariffs-trade-war-04-08-25\/card\/trump-floats-enlisting-law-firms-for-pro-bono-help-with-tariffs-NXwch72Zjc35w1cKIYsD?gaa_at=eafs&amp;gaa_n=ASWzDAhuuTjEbNx6NUYdRG1RyZbpEAsxQsUvrHoLlR1PhVolpYAmoeftcOl3YYnXfUo%3D&amp;gaa_ts=68a73c40&amp;gaa_sig=llQ7l1pQrMjqaJ_1BgJn40V4D-zULskJOmn1xntqg39DX8vLKPlUXaG016MbIy1mEsasYOpBtkqPiWVUQNC72Q%3D%3D\" rel=\"nofollow noopener\" target=\"_blank\">paper up nonsense tariff deals<\/a>, the firms hand-waved it all away as preposterous. Nonetheless, those letters dripped with bravado about how the firm would <em>never<\/em> be coerced into abandoning principles. Paul Weiss specifically promised that its free work would be limited \u201cto assist our nation\u2019s veterans, to combat anti-Semitism, and to promote the fairness of the justice system.\u201d Kirkland\u2019s response offered fewer specifics but declared that its pro bono work would be delivered on \u201ca non-partisan basis to a wide range of underserved populations.\u201d Apparently, the <em>Commerce Department<\/em> is one of those underserved populations. It\u2019s not established that Skadden is doing this work for free, but its response to Congress included similar bullshit.<\/p>\n<p>We didn\u2019t believe them at the time. It\u2019s refreshing when cynicism ages like a fine wine.<\/p>\n<p>Could the firms be doing more objectionable work for the administration? Sure! The Trump administration suggested drafting the firms to <a href=\"https:\/\/abovethelaw.com\/2025\/04\/biglaw-firms-in-league-with-donald-trump-now-have-to-defend-cops-that-kill-black-and-brown-people\/\" rel=\"nofollow noopener\" target=\"_blank\">defend police brutality claims<\/a>. They aren\u2019t doing that\u2026 yet. But this misses the point. Pro bono work is, functionally, zero-sum. Law firms aren\u2019t giving up billable time to other pro bono tasks after sacrificing $125 million to the feds. Every hour spent trying to convince <a href=\"https:\/\/www.bbc.com\/news\/articles\/ce84jr5mvnno\" rel=\"nofollow noopener\" target=\"_blank\">Penguin Island<\/a> to import more, I don\u2019t know, more Trump 2028 hats or something, isn\u2019t going to a homeless shelter. And all that time has to be made up by real, paying work to pay for those partner summer homes.<\/p>\n<p>Not that this is really \u201cpro bono publico\u201d work. The fact that it was even a question whether or not this was paid work, demonstrates how phony the \u201cpro bono\u201d claim is. Not all free legal services are pro bono or everyone would claim summer associate write-offs as pro bono. The Model Rules specifically frame pro bono \u2014 even pro bono work for the government \u2014 as services in support of those with \u201climited means\u201d or where normal fees would \u201csignificantly deplete\u201d organizational resources. The U.S. government, shockingly, is not indigent \u2014 though the Trump tax cuts may drive it there soon enough.<\/p>\n<p>Nor can lawyers claim the community service they\u2019re doing to clear up that DUI toward their pro bono awards either.
