Four different district court judges from\u00a0<a href=\"https:\/\/abovethelaw.com\/2025\/03\/not-one-but-two-george-w-bush-appointed-judges-grant-restraining-orders-against-trumps-biglaw-executive-orders\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">across the political spectrum<\/a>\u00a0have all ruled that EOs aimed at\u00a0<a href=\"https:\/\/abovethelaw.com\/2025\/05\/its-official-executive-order-targeting-perkins-coie-is-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Perkins Coie<\/a>,<a href=\"https:\/\/abovethelaw.com\/2025\/05\/executive-order-against-jenner-block-is-null-and-void\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">\u00a0Jenner &amp; Block<\/a>,\u00a0<a href=\"https:\/\/abovethelaw.com\/2025\/05\/trump-gets-ass-kicked-again-this-time-its-the-order-against-wilmer\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">WilmerHale<\/a>, and\u00a0<a href=\"https:\/\/abovethelaw.com\/2025\/06\/trump-is-0-4-defending-his-biglaw-executive-orders\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Susman Godfrey<\/a>, respectively, are unconstitutional on a variety of grounds. Yet, the administration is\u00a0<a href=\"https:\/\/www.bloomberglaw.com\/public\/desktop\/document\/JENNERBLOCKLLPvUSDEPARTMENTOFJUSTICEetalDocketNo125cv00916DDCMar2\/15?doc_id=X3DQS4U52E396AQ90HHMQPJ8R8J\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">appealing the Jenner &amp; Block case<\/a>, and the <a href=\"https:\/\/www.law.com\/americanlawyer\/2025\/07\/25\/doj-files-appeal-in-wilmer-executive-order-case\/\" rel=\"nofollow noopener\" target=\"_blank\">WilmerHale <\/a>case, and the <a href=\"https:\/\/abovethelaw.com\/2025\/07\/despite-series-of-losses-trump-is-trying-again-to-defend-his-biglaw-executive-orders\/\" rel=\"nofollow noopener\" target=\"_blank\">Perkins Coie one <\/a>too. So, not terribly surprising that, on Friday, the Department of Justice filed an appeal in the fourth Biglaw EO case \u2014 the one targeting Susman Godfrey.<\/p>\n<p>Susman\u2019s spokesperson came out swinging in response to the appeal, saying, \u201cThe courts have spoken clearly and decisively: the administration\u2019s executive orders targeting law firms violate the Constitution and undermine Americans\u2019 right to choose a lawyer without fear. Susman Godfrey challenged this order because we believe in the rule of law. That belief continues to guide us as we fight the administration\u2019s unwarranted appeal and continue to defend the rights of our clients and our colleagues.\u201d<\/p>\n<p>But the rub is that the Supreme Court is <a href=\"https:\/\/abovethelaw.com\/2025\/08\/supreme-court-just-calvinball-jurisprudence-with-a-twist-writes-justice-jackson\/\" rel=\"nofollow noopener\" target=\"_blank\">disturbingly willing<\/a> to eschew legal norms and bend over backwards for Trump, so what should be an easy call at the High Court becomes an open question. And <a href=\"https:\/\/abovethelaw.com\/2025\/07\/trump-wont-give-up-on-his-biglaw-executive-orders-until-he-gets-in-front-of-the-supreme-court\/\" rel=\"nofollow noopener\" target=\"_blank\">Trump is hoping to capitalize on that <\/a>and is pushing to get in front of <a href=\"https:\/\/abovethelaw.com\/2025\/03\/watch-the-exact-moment-john-roberts-realizes-he-whored-himself-out\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">his favorite justices<\/a>.
