Court of Appeals has maintained that she is unable to perform her duties because of her <s>heart attack<\/s> failure to submit to their cherry picked means of evaluation. Newman has since made repeated attempts to appeal, her most recent one was heard by a U.S. appeals court. <a href=\"https:\/\/www.reuters.com\/legal\/government\/98-year-old-us-appeals-judge-loses-bid-revive-lawsuit-over-her-suspension-2025-08-22\/\" rel=\"nofollow noopener\" target=\"_blank\">Reuters<\/a> has coverage: <\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>A U.S. appeals court on Friday denied a bid by U.S. Circuit Judge Pauline Newman to reinstate a lawsuit challenging her suspension from serving on the U.S. Court of Appeals for the Federal Circuit, where she had heard cases since 1984.<\/p>\n<p>A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit rejected Newman\u2019s argument that the law governing her suspension was unconstitutional.<\/p>\n<\/blockquote>\n<p>Responding to the ruling, Newman appears more adamant than ever about her cause:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe issues of judicial independence that are at stake here seem to loom larger and larger with each decision adverse to me,\u201d Newman said. \u201cI just don\u2019t see how, in good conscience, I can walk away from this, no matter how fed up I am with everything that\u2019s going on.\u201d<\/p>\n<\/blockquote>\n<p>A small silver of hope is that panel \u2014 in about the most \u201cthis is bullshit but what can you do shrug emoji\u201d way that a judicial panel could acknowledge that their hands are forced in an opinion, had this to say:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>[E]ven though Newman had raised \u201cimportant and serious\u201d constitutional questions about her treatment, it could only consider her challenge to the law governing judicial suspensions, and that \u201cany recourse for Judge Newman must come from a judicial council or from the Judicial Conference.\u201d<\/p>\n<\/blockquote>\n<p>Newman has no plans to stop.
