The shenanigans have been extensive, but briefly \u2026<\/p>\n<p>In March, Trump installed Matthew Giordano, an experienced prosecutor and campaign donor, as US Attorney for the District of New Jersey. Three weeks later, he shoved Giordano aside, mumbling that he was honoring him with an appointment as ambassador to Namibia. Instead Trump <a href=\"https:\/\/abovethelaw.com\/2025\/03\/alina-habba-named-interim-u-s-attorney-for-new-jersey\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">installed<\/a> his personal lawyer Alina Habba, a loyalist with zero prosecutorial experience. Trump nominated Habba for a full term, but the Senate never took up her appointment \u2014 and indeed she appears never to have even bothered to <a href=\"https:\/\/newjerseyglobe.com\/congress\/senate-judiciary-chair-says-that-habba-didnt-have-the-votes-to-pass-senate\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">fill out the paperwork<\/a>. On the eve of (what we all assumed was) the <a href=\"https:\/\/abovethelaw.com\/2025\/07\/alina-habba-to-let-the-screen-door-hit-her-on-her-way-out-of-u-s-attorney-job-or-maybe-not\/\" rel=\"nofollow noopener\" target=\"_blank\">expiration of her term<\/a>, federal judges in New Jersey exercised their statutory right to appoint someone to the vacant office, tapping Habba\u2019s deputy Desiree Grace. This so enraged Attorney General Pam Bondi that she attempted to <a href=\"https:\/\/abovethelaw.com\/2025\/07\/trump-dojs-keystone-kops-fire-alina-habba-replacement-without-realizing-that-has-nothing-to-do-with-it\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">jujitsu her prot\u00e9g\u00e9 back<\/a> into place by firing Grace, appointing Habba as her own deputy and then allowing her to succeed herself in office. And on August 21, Judge Matthew Brann, a Pennsylvania judge sitting by special designation over the New Jersey case, agreed. Indeed, he <a href=\"https:\/\/abovethelaw.com\/2025\/08\/alina-habba-cant-pretend-to-be-u-s-attorney-anymore\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">found<\/a> that Bondi\u2019s appointment clock started with Giordano, not Habba, and thus her actions for much of July were unauthorized. <\/p>\n<p>Knowing that the administration would appeal, which it did, the judge stayed his order pending review by the Third Circuit. And so Habba remains in office, but in a liminal purgatory where no one knows if she was legally appointed.<\/p>\n<p>Welcome to hot mess summer!<\/p>\n<p>As detailed in the <em>Times<\/em>, \u201ccourts are bracing for the possibility that any proceedings Ms. Habba has touched, or those involving prosecutors she supervises, could be challenged by defense lawyers.\u201d Cases are being stayed and trials postponed. Defendants remain inside or outside of jail indefinitely. The system has effectively ground to a halt. <\/p>\n<p>Does Habba feel a twinge of guilt at occasioning paralysis across an entire state\u2019s criminal justice system?<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Ms. Habba could reduce the risk to current and future cases by recusing herself until the appeals court makes a decision, but has thus far declined to do so.\u00a0<\/p>\n<\/blockquote>\n<p>Let\u2019s go with <em>NO<\/em>. She will make New Jersey great again, if she has to let hundreds of criminal cases die for violating the speedy trial requirement to do it. That\u2019s on the Sixth Amendment, not her! Or probably it\u2019s on those dastardly judges, for failing to recognize her authority as Trump\u2019s own anointed one. <\/p>\n<p>It\u2019s not clear why the administration is digging in so aggressively on this issue. Even under the DOJ\u2019s cockeyed interpretation of the Federal Vacancies Reform Act, Habba would be limited to 210 days in office , not a full term. But perhaps the DOJ views Habba as a test case, since it has at least a dozen acting US Attorneys who are staring down the end of their 120-day appointments with no possibility of Senate confirmation or renomination by the district judges. They\u2019ve also tried a similar <em><a href=\"https:\/\/www.nytimes.com\/2025\/07\/16\/nyregion\/sarcone-albany-us-attorney.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">I\u2019m my own first assistant!<\/a><\/em> maneuver in the Northern District of New York.<\/p>\n<p>Tapping out on Habba risks conceding that none of the hacks they\u2019ve loosed on prosecutors\u2019 offices are legit.
