When d<a href=\"https:\/\/abovethelaw.com\/2025\/04\/trump-is-coming-for-biglaw-heres-what-the-firms-are-doing-about-it\/\" rel=\"nofollow noopener\" target=\"_blank\">irectly confronted <\/a>with <a href=\"https:\/\/abovethelaw.com\/2025\/05\/its-official-executive-order-targeting-perkins-coie-is-unconstitutional\/\" rel=\"nofollow noopener\" target=\"_blank\">unconstitutional <\/a>Executive Orders targeting firms on Trump\u2019s list for retribution, more than twice as many major law firm were willing to promise the president nearly a billion dollars in <a href=\"https:\/\/abovethelaw.com\/tag\/pro-bono-payola\/\" rel=\"nofollow noopener\" target=\"_blank\">pro bono payola<\/a> for <a href=\"https:\/\/abovethelaw.com\/2025\/04\/biglaw-firms-in-league-with-donald-trump-now-have-to-defend-cops-that-kill-black-and-brown-people\/\" rel=\"nofollow noopener\" target=\"_blank\">conservative causes or clients<\/a> as were willing to fight the EOs in court. Not a great look for the supposed best in the legal industry.<\/p>\n<p>Part of Biglaw\u2019s reticence to stand up for the rule of law is the <a href=\"https:\/\/abovethelaw.com\/2025\/06\/biglaw-firms-that-capitulated-to-trump-reveal-deep-divide-between-corporate-lawyers-and-litigators\/\" rel=\"nofollow noopener\" target=\"_blank\">tension between corporate lawyers and litigators<\/a>. Corporate types want to stay on the <a href=\"https:\/\/abovethelaw.com\/2025\/07\/this-biglaw-firms-chair-is-trying-to-steer-clear-of-trumps-wrath\/\" rel=\"nofollow noopener\" target=\"_blank\">good side<\/a> of the administration to grease the wheels for deals. Conversely, litigators worried they were signaling that if a firm won\u2019t stand up to the bullying of the Trump administration for themselves,<a href=\"https:\/\/abovethelaw.com\/2025\/05\/the-stench-of-capitulation-lingers-on-biglaw-firms-in-league-with-trump\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">\u00a0they wouldn\u2019t be able to do it for clients<\/a>.<\/p>\n<p>So what if the answer is a firm that doesn\u2019t have that inherent conflict built into its business model? The Wall Street Journal <a href=\"https:\/\/www.wsj.com\/us-news\/law\/trial-separation-courtroom-lawyers-are-breaking-up-with-big-law-e22655b4\" rel=\"nofollow noopener\" target=\"_blank\">investigates<\/a> the rise of the litigation boutique. Certainly elite litigation boutiques aren\u2019t a new concept, but they\u2019re getting increasingly popular in the Trump era.<\/p>\n<p>Whether it\u2019s the high-profile (<a href=\"https:\/\/abovethelaw.com\/2025\/07\/new-elite-boutique-law-firm-picks-up-more-talent-from-biglaw-cowards\/\" rel=\"nofollow noopener\" target=\"_blank\">and growing<\/a>) Dunn Isaacson created <a href=\"https:\/\/abovethelaw.com\/2025\/05\/paul-weiss-rainmakers-bolt-to-start-new-firm-free-of-trump-deal-restrictions\/\" rel=\"nofollow noopener\" target=\"_blank\">by former Paul Weiss partners <\/a>(the first firm to <a href=\"https:\/\/abovethelaw.com\/2025\/03\/paul-weiss-grovels-to-trump-gets-out-from-under-executive-order\/\" rel=\"nofollow noopener\" target=\"_blank\">fold to Donald Trump\u2019s pressure<\/a>), the <a href=\"https:\/\/abovethelaw.com\/2025\/05\/trump-represents-a-boom-in-business-for-one-prominent-lawyer\/\" rel=\"nofollow noopener\" target=\"_blank\">Abbe Lowell boutique<\/a> \u2014 <a href=\"https:\/\/abovethelaw.com\/2025\/05\/another-lawsuit-filed-over-vindictive-executive-orders-targeting-lawyers\/\" rel=\"nofollow noopener\" target=\"_blank\">staffed with lawyers<\/a> who left their capitulating Biglaw firm, Paul Clement\u2019s boutique <a href=\"https:\/\/abovethelaw.com\/2025\/04\/paul-clement-takes-his-seat-at-the-resistance-table\/\" rel=\"nofollow noopener\" target=\"_blank\">coming out swinging<\/a> against the Trump administration and <a href=\"https:\/\/abovethelaw.com\/2025\/03\/wilmerhale-strikes-back-with-paul-clement-lawsuit-over-retaliatory-trump-order\/\" rel=\"nofollow noopener\" target=\"_blank\">defending Biglaw<\/a> against the EOs, or Roberta Kaplan\u2019s boutique <a href=\"https:\/\/abovethelaw.com\/2025\/06\/another-litigator-dips-from-a-biglaw-firm-that-caved-to-trump\/\" rel=\"nofollow noopener\" target=\"_blank\">getting more talent<\/a>, these small but mighty firms are poised to take on some of the biggest cases. As Karen Dunn noted, \u201cClients are comfortable with boutique firms handling their most consequential litigation.\u201d\u00a0<\/p>\n<p>And that smaller size is actually an advantage when taking on clients with disputes with the government.
