It was less than a month ago that U.S. Attorney for the Eastern District of Virginia Erik Siebert <a href=\"https:\/\/abovethelaw.com\/2025\/09\/federal-prosecutor-removed-from-office-for-not-pressing-charges-against-trumps-political-enemies\/\" rel=\"nofollow noopener\" target=\"_blank\">was forced out of a job<\/a> for refusing to bring charges against New York Attorney General Letitia James and other Trump foes. The utterly unqualified Lindsey Halligan <a href=\"https:\/\/abovethelaw.com\/2025\/09\/trump-will-jail-his-enemies-if-he-has-to-burn-down-the-doj-to-do-it\/\" rel=\"nofollow noopener\" target=\"_blank\">was installed<\/a> in his place and immediately s<a href=\"https:\/\/abovethelaw.com\/2025\/09\/trump-indicts-comey-for-torpedoing-hillary-clintons-2016-presidential-campaign\/\" rel=\"nofollow noopener\" target=\"_blank\">lapped together some charges<\/a> against another Trump target, former FBI Director <a href=\"https:\/\/abovethelaw.com\/2025\/09\/james-comey-taps-small-law-to-defend-him-against-witch-hunt\/\" rel=\"nofollow noopener\" target=\"_blank\">James Comey<\/a>, as the statute of limitations was expiring, while the witch hunts against other political enemies continued.<\/p>\n<p>Elizabeth Yusi, head of major criminal prosecutions in the Norfolk office of the Eastern District of Virginia, took the lead on the James investigation (in an apparent effort to insulate her staff from the political pressure of the case). And MSNBC is <a href=\"https:\/\/www.msnbc.com\/msnbc\/news\/top-prosecutor-trump-pressure-charge-new-york-ag-rcna235922\" rel=\"nofollow noopener\" target=\"_blank\">reporting<\/a> Yusi sees no probable cause to seek mortgage fraud charges \u2014 the right\u2019s <a href=\"https:\/\/abovethelaw.com\/2025\/09\/trump-asks-supreme-court-to-pretend-it-didnt-just-tell-him-he-cant-fire-the-fed\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">go-to investigation\u00a0<\/a>for Trump\u2019s political enemies \u2014 against James. And she\u2019s willing to lose her job over it, according to two sources who spoke with MSNBC, as she readies to present her conclusion to Halligan.<\/p>\n<p>And Seibert and Yusi aren\u2019t the only prosecutors in that office who are opting to follow the law, rather than the politics of the moment.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>On Friday, the top national security prosecutor in Virginia\u2019s Eastern District railed against Justice Department political appointees for carrying out Trump\u2019s directives rather than fulfilling their oath to \u201cfollow the facts and the law wherever they lead, free from fear or favor, and unhindered by political interference.\u201d<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The prosecutor, Michael Ben\u2019Ary, had been fired after a Trump ally questioned his loyalty to Trump in a social media post.
