During the scuffle, FBI Agent Eugenia Bates bruised her knuckles, and Pirro\u2019s office charged Reid with assaulting an officer \u2026 <em>or tried to anyway<\/em>.<\/p>\n<figure class=\"wp-block-image size-large\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"899\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2025\/10\/Screenshot-2025-10-19-at-8.55.01-PM-1024x899.png?resize=1024%2C899&#038;ssl=1\" alt=\"\" class=\"wp-image-1171244\" title=\"\"><figcaption><\/figcaption><\/figure>\n<p>After wasting the magistrate\u2019s time with a <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284133\/gov.uscourts.dcd.284133.1.0.pdf\">criminal complaint<\/a>, the government took to social media to congratulate themselves for being so big and tough.<\/p>\n<p>\u201cAssault an officer or agent \u2014 get arrested. It\u2019s not rocket science,\u201d ICE\u2019s official account <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/x.com\/ICEgov\/status\/1950677951852278240\">tweeted<\/a>.<\/p>\n<p>But grand jurors had other ideas, with three separate panels returning a no bill on the alleged assault.<\/p>\n<p>On August 25, with the 30 days to indict expiring, the DOJ was forced to <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284133\/gov.uscourts.dcd.284133.16.0.pdf\">walk of shame<\/a> itself back into court and admit that it had come up empty. To save face, Pirro\u2019s office announced that it was charging Reid with <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284133\/gov.uscourts.dcd.284133.17.0.pdf\">misdemeanor assault<\/a>, which doesn\u2019t require a grand jury to sign the prosecution\u2019s permission slip.<\/p>\n<p>In fact, Pirro\u2019s office has <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/www.lawandchaospod.com\/p\/where-is-doj-getting-no-billed-today\">gotten no-billed<\/a> at least a dozen times in the past four months \u2014 an astonishing record. Pirro raced to Fox to explain that this is because jurors in DC don\u2019t understand the lawless hellhole they live in.<\/p>\n<p>\u201cThere are a lot of people who sit on juries, and they live in Georgetown or in Northwest, or in some of these better areas, and they don\u2019t see the reality of crime that is occurring,\u201d she <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2025\/09\/04\/judge-criticizes-trump-surge-pirro\/\">blathered<\/a>. \u201cAnd my office has been instructed to move for the highest crime possible consistent with the law, the statute and the evidence.\u201d<\/p>\n<p>Reid was assigned two highly competent federal public defenders, Tezira Abe and Eugene Ohm, who informed the court that she would not be waiving her speedy trial rights, <em>thankyouverymuch<\/em>. She\u2019d like to go to trial immediately, while the memory of living under de facto military obligation was fresh in her fellow citizens\u2019 minds.<\/p>\n<p>The prosecution was an epic shitshow. The DOJ filed a <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284133\/gov.uscourts.dcd.284133.55.0_1.pdf\">superseding criminal information<\/a> on October 10, claiming that Reid assaulted not just Bates, but also ICE Officer Vincent Laing because, while being manhandled, Reid\u2019s knee jerked in his general direction leaving him in fear of injury. Judge Sparkle Sooknanan eventually threw out that part of the charge.<\/p>\n<p>On the eve of trial, the prosecution admitted that a security camera which they\u2019d claimed was inoperable had in fact captured the entire event. <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/www.wusa9.com\/article\/news\/crime\/missing-videos-mar-first-day-of-trial-for-woman-accused-of-assaulting-fbi-agent-during-ice-arrest-sidney-reid\/65-dd95da65-1746-4b64-b012-5e87ae2cf87d\">WUSA9<\/a>, the local CBS affiliate, reports that Judge Sooknanan struck a government witness as sanction for the screw up:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cEither your agent lied, or DOC lied, or someone was sloppy,\u201d Sooknanan said.<\/p>\n<p>Prosecutors said it was unclear whether the video was ever uploaded to a server by the DOC and, if so, if it was ever downloaded by the U.S. Attorney\u2019s Office. Assistant U.S. Attorney Travis Wolfe said the server is emptied every 60 days to save storage space.<\/p>\n<p>\u201cYour honor, I\u2019m as frustrated as you are,\u201d Wolfe said.<\/p>\n<p>\u201cYeah, but you\u2019re prosecuting a defendant in a criminal case, so your frustration rings a little hollow compared to hers or mine,\u201d Sooknanan said.<\/p>\n<\/blockquote>\n<p>The law enforcement agents involved also sent each other copious text messages chortling about the interaction with Reid and sharing social media videos of the scuffle. So much respect!\u201d<\/p>\n<p>Prosecutors requested the messages from Bates several times over the past two weeks, but it wasn\u2019t until Wednesday morning that Bates actually turned over the messages. Wolfe argued that she may have made a mistake while screenshotting the messages, instead of intentionally leaving it out.<\/p>\n<p>\u201cThat seems to be a common theme with all your witnesses. Did they lie, or did they continuously make mistakes?\u201d Sooknanan told Wolfe.<\/p>\n<\/blockquote>\n<p>Judge Sooknanan issued a couple of key rulings in the defendant\u2019s favor, including with respect to the jury instructions. The DOJ was forced to <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284133\/gov.uscourts.dcd.284133.35.0_1.pdf\">admit<\/a> that there was no template for an instruction charging 8 USC \u00a7 111 as a misdemeanor, since no prior US Attorney would have bothered to go to trial after getting no-billed on the felony. The court issued an <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284133\/gov.uscourts.dcd.284133.71.0_1.pdf\">instruction<\/a> requiring the jury to find that Reid had assaulted Bates, not simply obstructed her in her official duties.<\/p>\n<p>In the event, it took the jurors less than two hours to return a unanimous verdict of not guilty.<\/p>\n<figure class=\"wp-block-image size-large\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"878\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2025\/10\/Screenshot-2025-10-19-at-5.07.37-PM-1024x878.png?resize=1024%2C878&#038;ssl=1\" alt=\"\" class=\"wp-image-1171245\" title=\"\"><figcaption><\/figcaption><\/figure>\n<p>Pirro did at least manage to avoiding insulting the citizens of the District this time, simply releasing a statement to <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/www.the-independent.com\/news\/world\/americas\/us-politics\/jeanine-pirro-dc-sydney-reid-not-guilty-b2846934.html\"><em>The Independent<\/em><\/a> conceding that \u201cthe jury has spoken and we accept their decision.\u201d<\/p>\n<p>But Reid\u2019s lawyers issued a blistering statement rebuking the DOJ for bringing \u201ca case that has no place in a free democracy.\u201d<\/p>\n<p>\u201cThe Department of Justice can continue to take these cases to trial to suppress dissent and to try and intimidate the people,\u201d Abe and Ohm told the <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/www.huffpost.com\/entry\/sidney-lori-reid-not-guilty_n_68f154a8e4b017d85b748cf0\">Huffington Post<\/a>. \u201cBut in the end, as long as we have a jury system, our citizens will continue to rebuke the DOJ through speedy acquittals.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-bluesky-social wp-block-embed-bluesky-social\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"bluesky-embed\" data-bluesky-uri=\"at:\/\/did:plc:4vsredzl23vimaneyvzxzrdq\/app.bsky.feed.post\/3m3dpkh5vok2b\" data-bluesky-cid=\"bafyreia53562wcnexfaqnpymia5vjnscfkefpicpkqnrl4glod5aqj6pbm\">\n<p lang=\"en\">Wow. Dunn quickly became a folk hero, and Pirro\u2019s team got no billed when it tried to indict him for assault. As with Reid, they <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284294\/gov.uscourts.dcd.284294.7.0_5.pdf\">refiled<\/a> the case as a misdemeanor, and Dunn\u2019s trial begins on November 3.<\/p>\n<p>Pirro\u2019s office is also <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/abovethelaw.com\/2025\/10\/after-getting-no-billed-doj-tries-presenting-case-to-local-grand-jury-court-not-amused\/\">locked in a battle<\/a> with DC Magistrate Judge Zia Faruqui, who blocked the US Attorney from going to a grand jury in DC Superior Court after the federal grand jurors no-billed charges against a guy who got caught with an illegal gun in his car. The DOJ was forced to <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284133\/gov.uscourts.dcd.284133.35.0_1.pdf\">admit<\/a> that there was no template for an instruction charging 8 USC \u00a7 111 as a misdemeanor, since no prior US Attorney would have bothered to go to trial after getting no-billed on the felony. The court issued an <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284133\/gov.uscourts.dcd.284133.71.0_1.pdf\">instruction<\/a> requiring the jury to find that Reid had assaulted Bates, not simply obstructed her in her official duties.<\/p>\n<p>In the event, it took the jurors less than two hours to return a unanimous verdict of not guilty.<\/p>\n<figure class=\"wp-block-image size-large\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"878\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2025\/10\/Screenshot-2025-10-19-at-5.07.37-PM-1024x878.png?resize=1024%2C878&#038;ssl=1\" alt=\"\" class=\"wp-image-1171245\" title=\"\"><figcaption><\/figcaption><\/figure>\n<p>Pirro did at least manage to avoiding insulting the citizens of the District this time, simply releasing a statement to <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/www.the-independent.com\/news\/world\/americas\/us-politics\/jeanine-pirro-dc-sydney-reid-not-guilty-b2846934.html\"><em>The Independent<\/em><\/a> conceding that \u201cthe jury has spoken and we accept their decision.\u201d<\/p>\n<p>But Reid\u2019s lawyers issued a blistering statement rebuking the DOJ for bringing \u201ca case that has no place in a free democracy.\u201d<\/p>\n<p>\u201cThe Department of Justice can continue to take these cases to trial to suppress dissent and to try and intimidate the people,\u201d Abe and Ohm told the <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/www.huffpost.com\/entry\/sidney-lori-reid-not-guilty_n_68f154a8e4b017d85b748cf0\">Huffington Post<\/a>. \u201cBut in the end, as long as we have a jury system, our citizens will continue to rebuke the DOJ through speedy acquittals.\u201d<\/p>\n<p>Reid called the president \u201ca crazy person,\u201d but also expressed optimism at the verdict: \u201cKnowing that I can stand in front of 12 of my fellow citizens and be found not guilty for standing up for basic human rights makes me feel like, despite the scary times we live in, we have hope for the future.\u201d<\/p>\n<p>In the immediate future, the DOJ will try to convict another notorious miscreant, Sean \u201cHoagie Hero\u201d Dunn, who threw a sub at a CBP agent on August 10. Dunn quickly became a folk hero, and Pirro\u2019s team got no billed when it tried to indict him for assault. As with Reid, they <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284294\/gov.uscourts.dcd.284294.7.0_5.pdf\">refiled<\/a> the case as a misdemeanor, and Dunn\u2019s trial begins on November 3.<\/p>\n<p>Pirro\u2019s office is also <a target=\"_blank\" rel=\"noreferrer noopener nofollow\" href=\"https:\/\/abovethelaw.com\/2025\/10\/after-getting-no-billed-doj-tries-presenting-case-to-local-grand-jury-court-not-amused\/\">locked in a battle<\/a> with DC Magistrate Judge Zia Faruqui, who blocked the US Attorney from going to a grand jury in DC Superior Court after the federal grand jurors no-billed charges against a guy who got caught with an illegal gun in his car.
