Constitutional advocacy really matters when our foundational values are in tension with state interest and polarizing effect. While I had to try my damnedest to stay awake during the dormant commerce clause lectures 1L year, I didn\u2019t have that problem with the protest modules because it centered on what we could and couldn\u2019t take for granted during times of unrest. Given our country\u2019s history, <a href=\"https:\/\/transnational.live\/2022\/04\/15\/the-us-has-been-at-war-225-out-of-243-years-since-1776\/\" rel=\"nofollow noopener\" target=\"_blank\">that\u2019s about 92% of the time<\/a>. And while Supreme Court cases can make for a go-to litmus test of what flies at a given point in our history, most of what is actually happening on the ground never makes it that far. That said, this small case coming out of D.C. could be some history in the making. <a href=\"https:\/\/www.axios.com\/2025\/10\/24\/trump-dc-national-guard-star-wars-darth-vader-imperial-march\" rel=\"nofollow noopener\" target=\"_blank\">Axios<\/a> has coverage:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The American Civil Liberties Union <a href=\"https:\/\/archive.is\/o\/xBHdq\/https:\/\/www.acludc.org\/app\/uploads\/2025\/10\/20251023-OHARA-COMPL-FILED.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">filed <\/a>the suit on behalf of Sam O\u2019Hara against four Metropolitan Police Department officers and a member of the Ohio National Guard seeking damages for alleged First and Fourth Amendment violations, false arrest\/imprisonment; battery.<br \/>\u2026<br \/>[An] Ohio guardsman \u201cwas not amused by this satire\u201d and \u201cthreatened to call D.C. police officers to \u2018handle\u2019 the protester if he persisted\u201d when the incident took place on Sept. 11, the ACLU attorneys allege in their complaint, filed in the U.S. District Court of Colombia.<\/p>\n<\/blockquote>\n<p>You can see some of the arrest-worthy footage below:<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">In late August, Sam O\u2019Hara began filming National Guard troops in D.C. while playing \u201cThe Imperial March\u201d from his phone or a handheld speaker and posted the videos to his TikTok account. <\/p>\n<p>He was detained Sept. 11. <a href=\"https:\/\/t.co\/38HEc2EUwk\" rel=\"nofollow\">pic.twitter.com\/38HEc2EUwk<\/a><\/p>\n<p>\u2014 The Washington Post (@washingtonpost) <a href=\"https:\/\/twitter.com\/washingtonpost\/status\/1981356570777673997?ref_src=twsrc%5Etfw\" rel=\"nofollow noopener\" target=\"_blank\">October 23, 2025<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p>Soon after the camouflaged, uniformed man whined to a blue-uniformed man about the unwanted soundtrack, O\u2019Hara was tightly handcuffed for 15-20 minutes.<\/p>\n<p>The degree and arbitrariness of the punishment makes for quite a small tyranny, but it is tyrannical nonetheless. Liberty is in danger the easier it is to arrest citizens for what amounts to \u2014 at worst \u2014 a constitutionally protected annoyance. O\u2019Hara was obviously caught on camera, but is it too far off to imagine the police arresting someone without cause and justifying it by saying they were caught playing the \u201cImperial March\u201d or \u201cF*ck The Police\u201d? What\u2019s the point of the First and the Fourth if song selection is all that stands between freedom and being hauled off in handcuffs?<\/p>\n<p>This could be a great test case to see what, if anything, is left of the First Amendment.
