Threats about losing accreditation, snatching away billions in ear marked federal funding\u2026 dire consequences all around. Given the climate, universities \u2014 especially public ones \u2014 are and should be on high alert to punish and distance themselves from actual instances of antisemitism. Being associated with a student who boldly declared that \u201cJews must be abolished by any means\u201d definitely wasn\u2019t a good look for University of Florida.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">My position on Jews is simple: whatever Harvard professor Noel Ignatiev meant by his call to \u201cabolish the White race by any means necessary\u201d is what I think must be done with Jews. Jews must be abolished by any means necessary.<\/p>\n<p>\u2014 Preston Damsky (@preston_terry_) <a href=\"https:\/\/twitter.com\/preston_terry_\/status\/1903171971812036796?ref_src=twsrc%5Etfw\" rel=\"nofollow noopener\" target=\"_blank\">March 21, 2025<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p>This student also gained infamy for <a href=\"https:\/\/abovethelaw.com\/2025\/06\/trump-judge-gives-nazi-sympathizing-law-student-high-marks-for-rehashing-klan-legal-theory-calling-for-minority-disenfranchisement-and-murdering-immigrants\/\" rel=\"nofollow noopener\" target=\"_blank\">writing a White supremacist constitutional law paper<\/a> that advocated for, among other things, shoot to kill orders at the border. Once word of his digital footprint got out, the university expelled Preston Damsky from the school. The expulsion prompted Damsky to sue the school for violating his right to free speech. <a href=\"https:\/\/www.gainesville.com\/story\/news\/state\/2025\/10\/29\/free-speech-fight-in-court-after-uf-expels-law-student\/86975802007\/\" rel=\"nofollow noopener\" target=\"_blank\">The Gainsville Sun<\/a> has coverage:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>A federal judge heard arguments Oct. 29 in the case of a <a href=\"https:\/\/www.gainesville.com\/story\/news\/local\/state\/2025\/09\/09\/watchdog-gives-florida-low-grade-on-university-free-speech-policies\/86040211007\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">University of Florida<\/a> law student <a href=\"https:\/\/www.gainesville.com\/story\/news\/local\/state\/2025\/06\/25\/self-described-white-nationalist-says-uf-violated-free-speech-rights-first-amendment\/84318355007\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">expelled for antisemitic tweets<\/a>.<br \/>\u2026<br \/>[Damsky\u2019s lawyer] said Damsky\u2019s statements were not literal or targeted. \u201cIt was basically trolling,\u201d he said. Damsky tweeted that Jews should be abolished to around 25 followers. It wasn\u2019t until a UF law professor responded, asking if Damsky would murder her and her family, that the tweet raised broad concerns among UF law students and faculty.<\/p>\n<\/blockquote>\n<p>\u201cYour Honor, my client would have been fine if one of his teachers just kept her mouth shut.\u201d Nice way to deflect the blame on to a professor asking questions about safety!<\/p>\n<p>The tension between \u201climiting free speech off campus\u201d and the duty to protect students and faculty from threats is palpable. It would be an easier question if Damsky ended his tweet with \u201cand I will do my part,\u201d but the tweet\u2019s lack of immediacy makes it harder to read as a time-sensitive \u201ctrue threat.\u201d That said, the tone and context can still reasonably be received as threatening or at least the intentional creation of a hostile environment. Legal scholars have <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4989853\" rel=\"nofollow noopener\" target=\"_blank\">taken a turn<\/a> at navigating the conflict between protecting speech and protecting victims of discriminatory acts. Can institutions even fulfill their legal obligations to students without punishing other students in ways that suppress political speech? <\/p>\n<p>Academic questions aside, one thing to know about trolling is that the trolls are going to keep pushing the limit as far as they can. The point is to use their freedom to make others feel threatened or excluded, and they\u2019ve gotten very good at it over the history of the country. So whatever the law concludes, if Damsky wins this case, expect that he and others will take it and be emboldened to go out and make similar tweets in the future.
