{"id":138164,"date":"2025-12-04T14:40:19","date_gmt":"2025-12-04T22:40:19","guid":{"rendered":"https:\/\/xira.com\/p\/2025\/12\/04\/fastcase-files-lawsuit-against-alexi-over-alleged-data-misuse-and-trademark-infringement\/"},"modified":"2025-12-04T14:40:19","modified_gmt":"2025-12-04T22:40:19","slug":"fastcase-files-lawsuit-against-alexi-over-alleged-data-misuse-and-trademark-infringement","status":"publish","type":"post","link":"https:\/\/xira.com\/p\/2025\/12\/04\/fastcase-files-lawsuit-against-alexi-over-alleged-data-misuse-and-trademark-infringement\/","title":{"rendered":"Fastcase Files Lawsuit Against Alexi Over Alleged Data Misuse And Trademark Infringement"},"content":{"rendered":"<p>The post <a href=\"https:\/\/www.lawnext.com\/2025\/12\/fastcase-files-lawsuit-against-alexi-over-alleged-data-misuse-and-trademark-infringement.html\" rel=\"nofollow noopener\" target=\"_blank\">Fastcase Files Lawsuit Against Alexi Over Alleged Data Misuse And Trademark Infringement<\/a> appeared first on <a href=\"https:\/\/abovethelaw.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Above the Law<\/a>.<\/p>\n<p>Legal research technology company <a href=\"https:\/\/www.fastcase.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Fastcase<\/a>, which is now owned by <a href=\"https:\/\/www.clio.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Clio<\/a>, has filed a federal lawsuit against AI-powered legal research platform <a href=\"https:\/\/www.alexi.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Alexi<\/a>, alleging breach of contract, trademark infringement and trade secret misappropriation, relating to its use of data licensed from Fastcase.<\/p>\n<p>The complaint, filed Nov. 26 in the U.S. District Court for the District of Columbia, accuses the Canadian company of transforming a limited data license into a competing commercial product.<\/p>\n<p>Although Alexi has not yet formally responded to the lawsuit, its founder and CEO <a href=\"https:\/\/www.linkedin.com\/in\/mark-doble\/\" rel=\"nofollow noopener\" target=\"_blank\">Mark Doble<\/a> told me yesterday afternoon that he denies any wrongdoing and that he believes the lawsuit is based on a misunderstanding of the original licensing agreement that came to light during Clio\u2019s recent <a href=\"https:\/\/www.lawnext.com\/2025\/11\/clio-completes-historic-1-billion-vlex-acquisition-announces-500-million-series-g-at-5-billion-valuation-plus-exclusive-interview-with-ceo-and-cfo.html\" rel=\"nofollow noopener\" target=\"_blank\">closing of its purchase of vLex<\/a>, which had <a href=\"https:\/\/www.lawnext.com\/2023\/04\/in-major-legal-tech-deal-vlex-and-fastcase-merge-creating-a-global-legal-research-company-backed-by-oakley-capital-and-bain-capital.html\" rel=\"nofollow noopener\" target=\"_blank\">merged with Fastcase in 2023<\/a>.<\/p>\n<p>According to the complaint, Fastcase and Alexi (formerly known as Alexsei) entered into a data license agreement in December 2021. At that time, the complaint says, Alexi operated as what it described as a \u201cresearch institution,\u201d employing staff attorneys who used AI-assisted passage-retrieval technology to prepare legal research memoranda for clients within 24 hours.<\/p>\n<p>The agreement, the complaint alleges, granted Alexi access to Fastcase\u2019s proprietary legal database solely for \u201cinternal research purposes\u201d \u2014 specifically, research conducted by Alexi\u2019s own lawyers in preparing client memoranda. The license explicitly prohibited using the data for commercial purposes, competitive purposes or publishing or distributing the data in any form, Fastcase alleges.<\/p>\n<p>(Although Fastcase filed a copy of the licensing agreement with the court, it did so under seal, so it cannot be viewed by the public.)<\/p>\n<p>Fastcase, founded in 1999, merged with vLex in 2023 and was subsequently <a href=\"https:\/\/www.lawnext.com\/2025\/11\/clio-completes-historic-1-billion-vlex-acquisition-announces-500-million-series-g-at-5-billion-valuation-plus-exclusive-interview-with-ceo-and-cfo.html\" rel=\"nofollow noopener\" target=\"_blank\">acquired by Clio for $1 billion<\/a> in a transaction that closed Nov. 10 \u2014 described in the complaint as \u201cone of the most significant transactions in legal technology history.\u201d<\/p>\n<h3>At Issue Is Fastcase Data<\/h3>\n<p>The lawsuit centers on Fastcase\u2019s claim that Alexi fundamentally changed its business model while continuing to rely on Fastcase\u2019s data under the original restricted license.<\/p>\n<p>Beginning in 2023, Fastcase alleges, Alexi shifted away from its lawyer-staffed memorandum service and began building a direct-to-consumer AI legal research platform that competes with Fastcase. According to the complaint, Alexi removed the \u201cinternal research\u201d component entirely and began publishing Fastcase-sourced case law directly to end users.<\/p>\n<p>The complaint cites public statements by Alexi\u2019s CEO Doble, including a March 2024 LinkedIn post in which he described Alexi as \u201cincreasingly a legitimate alternative to incumbent legal research providers.\u201d<\/p>\n<p>Doble reportedly stated that relative weaknesses including \u201caccess to additional content (primary &amp; secondary) and primary law meta-data (e.g. shepardizing)\u201d were \u201ceasily solvable in the next 3-6 months.\u201d<\/p>\n<p>Following an <a href=\"https:\/\/www.lawnext.com\/2024\/06\/a-slow-year-for-legal-tech-funding-over-400-million-invested-in-legal-tech-in-the-last-30-days.html\" rel=\"nofollow noopener\" target=\"_blank\">$11 million Series A funding round<\/a> in June 2024, the complaint alleges, Alexi expanded its platform to include document analysis, case management tools and other features typical of full-scale legal research providers.<\/p>\n<h3>Evidence Cited in the Complaint<\/h3>\n<p>As evidence of Alexi\u2019s unauthorized use, Fastcase\u2019s complaint points to several public demonstrations of Alexi\u2019s platform \u2014 including <a href=\"https:\/\/youtu.be\/3R7BIs1y_f8?si=1UXu1jffqkPljoAm\" rel=\"nofollow noopener\" target=\"_blank\">one I recorded with the company last May<\/a> for my <a href=\"https:\/\/www.youtube.com\/@LawSites_HowItWorks\" rel=\"nofollow noopener\" target=\"_blank\"><em>How It Works<\/em><\/a> video series. In that video, according to the complaint, Alexi\u2019s Chief Revenue Officer Daniel Diamond \u201cshowcased direct access to Fastcase Data and continued to use Fastcase\u2019s registered marks within its platform.\u201d<\/p>\n<div id=\"attachment_51826\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/i0.wp.com\/www.lawnext.com\/wp-content\/uploads\/2025\/12\/Screenshot-2025-12-01-194230.png?ssl=1\" rel=\"nofollow noopener\" target=\"_blank\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-51826\" class=\"wp-image-51826 size-large\" src=\"https:\/\/i0.wp.com\/www.lawnext.com\/wp-content\/uploads\/2025\/12\/Screenshot-2025-12-01-194230-1024x783.png?resize=1024%2C783&#038;ssl=1\" alt=\"\" width=\"1024\" height=\"783\" title=\"\"><\/a><\/p>\n<p id=\"caption-attachment-51826\" class=\"wp-caption-text\"><strong>The complaint includes this screencap of my \u2018How It Works\u2019 interview with Alexi, allegedly to show unauthorized use of Fastcase data and trademarks.<\/strong><\/p>\n<\/div>\n<p>The complaint also cites an October 2024 <a href=\"https:\/\/youtu.be\/vgr9kEOVek0?si=5aVr6y53-QIcSgYD\" rel=\"nofollow noopener\" target=\"_blank\">demonstration for HeyCounsel<\/a> in which Diamond presented Alexi\u2019s AI chat interface, stating that Alexi\u2019s model was \u201ctrained on over 30 million pairs of questions and answers that are derived from caselaw.\u201d<\/p>\n<p>The complaint includes screenshots from those two demos that show Alexi\u2019s interface displaying full-text case law with a button stating \u201cView this document on Fastcase,\u201d which Fastcase characterizes as unauthorized use of its trademark and an implied affiliation that was never authorized.<\/p>\n<p>Diamond also reportedly acknowledged that Alexi had moved beyond its original passage-retrieval tool and now acted \u201cas a wrapper on top of third-party AI models using Fastcase Data,\u201d the complaint alleges.<\/p>\n<h3>Alexi CEO Denies Wrongdoing<\/h3>\n<p>In an interview yesterday, Alexi CEO Doble denied that the company had violated its agreement with Fastcase and expressed his hope that the lawsuit can be resolved quickly.<\/p>\n<p>Although he told me that he is limited in what he can say because of the pendency of the lawsuit, he attributed it to a \u201cmassive miscommunication\u201d and said that Alexi is \u201cdoing everything we can to try and resolve it as fast as we can.\u201d<\/p>\n<p>The full text of the license agreement is under seal in the lawsuit at Clio\u2019s request. But Doble said he has always been careful never to operate beyond the license\u2019s scope.<\/p>\n<p>The reason it came to a head now, Doble suggested, is that Clio only became aware of the agreement during the final weeks before the Nov. 10 date on which it <a href=\"https:\/\/www.lawnext.com\/2025\/11\/clio-completes-historic-1-billion-vlex-acquisition-announces-500-million-series-g-at-5-billion-valuation-plus-exclusive-interview-with-ceo-and-cfo.html\" rel=\"nofollow noopener\" target=\"_blank\">completed its acquisition of vLex<\/a>.<\/p>\n<p>Until then, he said, no one at Fastcase or vLex had ever before questioned the licensing agreement or Alexi\u2019s actions under it. His relationship with both companies had always been cordial and cooperative, he said, even to the point of their engineers having worked together to develop some of the functionality now at issue.<\/p>\n<p>He disputes the complaint\u2019s allegation that Alexi shifted its business model after entering into the licensing agreement. From the company\u2019s founding, he said, its mission was always to fully automate the production of research memos. While it initially employed lawyers to control the accuracy of its memos, its goal was always to become fully automated, and that was clearly communicated to Fastcase, he said.<\/p>\n<p>Doble describes the misunderstanding around the terms of the agreement as being the result of a \u201cbit of broken telephone\u201d in the transitions over the years from Fastcase to vLex and then vLex to Clio.<\/p>\n<p>\u201cIt\u2019s clear there\u2019s a lot of information that Clio doesn\u2019t have that we have that now we\u2019re just trying to go through and work with them on explaining,\u201d he said.<\/p>\n<h3>October Notice of Breach<\/h3>\n<p>Doble said the first he heard of any problem was in late October, when he received a phone call from a vLex executive, which was then followed on Oct. 27 by vLex sending Alexi a \u201cNotice of Material Breach\u201d demanding the company cure its breaches within 30 days as required by the agreement.<\/p>\n<p>According to the complaint, Alexi\u2019s counsel responded on Nov. 3, denying any breach and expressly admitting that Alexi had used Fastcase data to train its generative AI models.<\/p>\n<p>The response stated: \u201cThe intention of the Agreement was never to preclude Alexi from using Fastcase Data as source material for Alexi\u2019s generative AI product; that is exactly what Alexi was paying Fastcase nearly a quarter million dollars for annually.\u201d<\/p>\n<p>Fastcase characterizes this as an acknowledgment of conduct prohibited by the agreement\u2019s plain terms and notes that Alexi stated its intention to continue using the data \u201cas it had been.\u201d<\/p>\n<p>After the 30-day cure period expired without resolution, Fastcase terminated the agreement and filed this lawsuit.<\/p>\n<p>A Clio spokesperson declined to say anything more about the allegations of the lawsuit beyond what is alleged in the complaint.<\/p>\n<p>\u201cClio takes its contractual obligations and our responsibility as stewards of our intellectual property very seriously,\u201d the spokesperson said. \u201cWe follow established processes to ensure our licensed data is used appropriately in order to protect the integrity of our content library.\u201d<\/p>\n<h3>Legal Allegations<\/h3>\n<p>The complaint alleges that Alexi materially breached the Data License Agreement by using Fastcase data to train and develop Alexi\u2019s commercial AI legal research product and in other ways.<\/p>\n<p>It also asserts that Alexi violated Fastcase\u2019s trademarks and used the Fastcase name and trademarks in its interface and marketing materials.<\/p>\n<p>Perhaps most significantly the complaint alleges that Alexi misappropriated trade secrets through its unauthorized use of Fastcase\u2019s database.<\/p>\n<p>Fastcase is seeking extensive remedies, including a declaratory judgement that Alexi materially breached the contract, a permanent injunction, compensatory damages, and disgorgement of all revenues and profits from unauthorized use.<\/p>\n<h3>\u2018A Huge Misunderstanding\u2019<\/h3>\n<p>Some of you reading this may be wondering if this is d\u00e9j\u00e0 vu\u00a0all over again, as this blog continues to follow the <a href=\"https:\/\/www.lawnext.com\/category\/thomson-reuters-v-ross\" rel=\"nofollow noopener\" target=\"_blank\">long-running litigation of Thomson Reuters v. ROSS Intelligence<\/a>.<\/p>\n<p>Yes, that lawsuit involves an established, Canada-based legal research company suing a Canada-based legal research startup, much as this one involves the Canada-based legal tech giant Clio suing the Canada-based Alexi.<\/p>\n<p>But in this case, Doble expressed hope that Canada connection would work in favor of a quick resolution.<\/p>\n<p>\u201cWe\u2019re a Canadian legal tech company and Clio is the Canadian darling legal tech company,\u201d he said. \u201cI still have a ton of respect for what they\u2019ve done \u2014 we all at Alexi look up to them. They\u2019re an amazing company. \u2026<\/p>\n<p>\u201cI just think there\u2019s a huge misunderstanding, miscommunication, and I\u2019m confident it\u2019ll be resolved pretty quickly.\u201d<\/p>\n<p>The case is assigned to Judge Richard J.
