Which is a creative way to describe leaving a job that <a href=\"https:\/\/abovethelaw.com\/2025\/08\/alina-habba-cant-pretend-to-be-u-s-attorney-anymore\/\" rel=\"nofollow noopener\" target=\"_blank\">the federal courts have ruled she doesn\u2019t actually hold<\/a>.<\/p>\n<p>Habba, the parking garage lawyer plucked from obscurity by Donald Trump <a href=\"https:\/\/abovethelaw.com\/2025\/11\/trump-and-habba-must-pay-million-dollar-stupid-tax-court-confirms\/\" rel=\"nofollow noopener\" target=\"_blank\">to help him rack up a million dollars in sanctions<\/a>, had served as Interim U.S. Attorney for the District of New Jersey until the statutory 120-day limit on that post expired. At that point, without a duly confirmed U.S. Attorney, the district judges fulfilled their legal duty and appointed one. Meanwhile, the administration gave Habba the job as First Assistant and <a href=\"https:\/\/abovethelaw.com\/2025\/07\/alina-habba-is-so-back-baby\/\" rel=\"nofollow noopener\" target=\"_blank\">pretended that she took over<\/a> as <em>Acting<\/em> U.S. Attorney at that point. The courts disagreed and most recently the Third Circuit affirmed that decision.<\/p>\n<p>Habba has now pretended to resign the job she\u2019s been pretending to have.<\/p>\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" width=\"1080\" height=\"1603\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2025\/12\/Habba.jpg?resize=1080%2C1603&#038;ssl=1\" alt=\"\" class=\"wp-image-1174288\" title=\"\"><figcaption><\/figcaption><\/figure>\n<p>Hardly the most consequential takeaway, but the decision to write, \u201cmy loyalty is not to\u2026 a ZIP code,\u201d followed by \u201cyou can take the girl out of New Jersey, but you cannot take New Jersey out of the girl,\u201d suggests the statement went through exactly as many drafts as you\u2019d expect.<\/p>\n<p>The Third Circuit affirmed what Judge Matthew Brann ruled back in August: you cannot play an elaborate game of musical chairs with interim appointments and \u201cspecial attorney\u201d designations to circumvent the Senate confirmation process. How is this not moot?<\/p>\n<p>Obviously, it behooves the DOJ to keep pushing this issue since this is <a href=\"https:\/\/abovethelaw.com\/2025\/11\/lindsey-halligan-manages-to-lose-two-cases-at-once-which-is-honestly-impressive\/\" rel=\"nofollow noopener\" target=\"_blank\">the same problem they\u2019ve got in the Eastern District of Virginia with Lindsey Halligan<\/a> \u2014 one of the few lawyers who makes Alina Habba look like Oliver Wendell Holmes since her incompetent handling of the <a href=\"https:\/\/abovethelaw.com\/2025\/11\/lindsey-halligan-officially-more-stupid-than-you-imagined\/\" rel=\"nofollow noopener\" target=\"_blank\">Comey<\/a> and <a href=\"https:\/\/abovethelaw.com\/2025\/12\/doj-adds-another-no-bill-to-its-trophy-case\/\" rel=\"nofollow noopener\" target=\"_blank\">James<\/a> cases really could not have been scripted any better \u2014 and <a href=\"https:\/\/abovethelaw.com\/2025\/07\/federal-judges-give-big-ol-nope-to-new-york-u-s-attorney-pick\/\" rel=\"nofollow noopener\" target=\"_blank\">in the Northern District of New York with John Sarcone III<\/a>. Perhaps Bondi\u2019s suggesting the DOJ will take their chances in other jurisdictions and try to use any victory there to ramrod Habba back in? WHO KNOWS?<\/p>\n<p>Thankfully for Habba, the Pam Bondi School for Wayward Lawyers still has a home for her.
