And he\u2019s still in the infancy of his lifetime tenure, but Bove\u2019s showing that\u2019s enough time to already have an ethics complaint filed against him. Because you can put a political operative on the bench, but you can\u2019t take the political operative out of the judge\u2026 because the whole reason you put them on the bench was to stay a political operative.<\/p>\n<p>Bove spent his evening yesterday attending what can only be described as a full-throated MAGA campaign rally in Pennsylvania. And when reporters<a href=\"https:\/\/bsky.app\/profile\/weeknightmsnow.bsky.social\/post\/3m7lwvy42qc2w\" rel=\"nofollow noopener\" target=\"_blank\"> asked<\/a> why a sitting federal appellate judge was standing shoulder-to-shoulder with the red-hat faithful while Donald Trump railed against Democrats in a highly partisan speech, Bove shrugged it off with a breezy: \u201cJust here as a citizen coming to watch the President speak.\u201d<\/p>\n<p>Sir. You are a federal judge. You don\u2019t get to switch that off like a light switch so you can vibe at a rally where the headliner screams about \u201cradical left Democrats.\u201d This is why the Code of Conduct for US Judges says \u201ca judge should refrain from political activity\u201d and shouldn\u2019t go to events \u201csponsored by a political organization or candidate.\u201d<\/p>\n<p>To give a little flavor of the kind of partisan event we\u2019re talking about, Bloomberg Law<a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/emil-bove-attends-trump-rally-in-rare-move-for-federal-judge\" rel=\"nofollow noopener\" target=\"_blank\"> reports <\/a>Trump bashed \u201cthe radical left Democrats in Congress,\u201d criticized Joe Biden as \u201cthe worst president in the history of our country,\u201d called Minnesota Gov. Tim Walz \u201cone of the dumbest governors ever in our history,\u201d and said Rep. llhan Omar \u201cand the people from Somalia\u201d \u201chate our country\u201d and \u201cthink we\u2019re stupid people.\u201d<\/p>\n<p>Given the absolutely glaring problem here, it\u2019s no surprise that Gabe Roth at Fix the Court has already <a href=\"https:\/\/fixthecourt.com\/wp-content\/uploads\/2025\/12\/Bove-complaint-GR-12.10.25ff.pdf\" rel=\"nofollow noopener\" target=\"_blank\">filed a judicial ethics complaint <\/a>with the Third Circuit. And Roth\u2019s filing makes the obvious point that Bove\u2019s \u201cjust a citizen!\u201d excuse dissolves on contact with common sense.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>There is no prohibition, of course, against a federal judge attending an event at which a President is speaking. For example, Supreme Court justices attend the State of the Union each year as a show of unity among the branches and their shared commitment to our tripartite form of government, and judges and justices are at times guests at White House at state dinners.<\/p>\n<p>But last night\u2019s event in Pennsylvania \u2014 prominent conservative voices are calling it a \u201crally,\u201d so that\u2019s what I<br \/>will call it here \u2014 was a far cry from the State of the Union or a state dinner for its abject partisanship. It should have been obvious to Judge Bove, either at the start of the rally or fairly close to it, that this was a highly charged, highly political event that no federal judge should have been within shouting distance of.<\/p>\n<\/blockquote>\n<p>Listen, if Bove wanted a life of MAGA rallies, he had options. He could have stayed a political operative. Then he could have attended every MAGA-palooza up and down the East Coast.
