Bush\u2013appointed judge has been increasingly exasperated with the Trump administration\u2019s approach to immigration enforcement in Minnesota, in particular ICE\u2019s apparent allergy to complying with court orders. In a prior order, Schiltz took the extraordinary step of ordering Todd Lyons, ICE\u2019s acting director, to personally appear in court to explain why the agency should not be held in contempt. Because the government finally released the detained individual at the center of the case, Schiltz canceled the hearing that would have required Lyons to appear. ICE, at least this time, blinked. But Schiltz made very clear that compliance under threat does not erase a pattern of misconduct.<\/p>\n<p>Yesterday, Schiltz <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.230171\/gov.uscourts.mnd.230171.10.0_1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">issued an order<\/a> \u2014 a biting one at that \u2014 that the release of one individual after the threat of sanctions \u201cdoes not end the Court\u2019s concerns.\u201d And went on <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.230171\/gov.uscourts.mnd.230171.10.1_1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">to list some 96!<\/a> other immigration cases where the government is ignoring court orders. \u201cICE is not a law unto itself. ICE has every right to challenge the orders of this<br \/>Court, but, like any litigant, ICE must follow those orders unless and until they are overturned or vacated,\u201d Schiltz wrote.<\/p>\n<p>\u201cThis list should give pause to anyone \u2014 no matter his or her political beliefs \u2014 who cares about the rule of law,\u201d he explained.
