As the Department of Homeland Security disappears suspected migrants without due process, arbitrarily harasses citizens, and point blank kills innocent people on camera, a shocked public has learned what lawyers have talked about for years: <a href=\"https:\/\/abovethelaw.com\/2026\/01\/ice-kills-a-woman-in-minneapolis-and-will-probably-get-away-with-it\/\" rel=\"nofollow noopener\" target=\"_blank\">the government has stacked the immunity deck<\/a> to functionally shield law enforcement from accountability. But Congress could, if it wanted to, put a stop border enforcement\u2019s cheat codes by statutorily authorizing lawsuits against federal officers for constitutional violations.<\/p>\n<p>As <a href=\"https:\/\/www.thenation.com\/article\/politics\/ice-accountability-lawsuit-student-letter\/\" rel=\"nofollow noopener\" target=\"_blank\">reported by The Nation<\/a>, the effort grew out of a late-night idea by Berkeley Law students \u2014 including Amelia Dal Pra, Zadie Adams, Isaiah Paik, Shree Mehrotra, and Kaylana Mueller-Hsia \u2014 <a href=\"https:\/\/www.nytimes.com\/2026\/01\/14\/opinion\/renee-good-civil-rights-constitution.html\" rel=\"nofollow noopener\" target=\"_blank\">inspired by <em>Times<\/em> opinion piece<\/a> from Berkeley Law Dean Erwin Chemerinsky and NYU professor emeritus Burt Neuborne. Within one week, the letter attracted signatures from 146 legal academics, 22 law student governments, and 224 law student organizations.<\/p>\n<p>If you fit one of those descriptions and haven\u2019t signed on yet, <a href=\"https:\/\/federalaccountabilitynow.org\/#sign-petition\" rel=\"nofollow noopener\" target=\"_blank\">here\u2019s your opportunity<\/a>.<\/p>\n<p>Section 1983 allows individuals to sue state and local officers for constitutional violations since 1871. As appellate attorney Chris Truax <a href=\"https:\/\/thehill.com\/opinion\/judiciary\/5712552-ice-border-patrol-violence-accountability\/\" rel=\"nofollow noopener\" target=\"_blank\">put it in The Hill<\/a>, Section 1983 is \u201ckryptonite for nascent tyranny.\u201d That\u2019s a tad overstated since Superman doesn\u2019t get to avoid kryptonite just by telling a court he was following standard procedure. The judicially contrived defense of \u201cqualified immunity\u201d \u2014 <a href=\"https:\/\/abovethelaw.com\/2022\/08\/police-can-legally-set-you-on-fire-because-someone-in-the-1800s-made-a-copying-error\/\" rel=\"nofollow noopener\" target=\"_blank\">the most consequential typo in American law<\/a> \u2014 frustrates most 1983 cases, giving law enforcement a \u201cGet Out of Responsibility Free\u201d card as long as they can sell a judge that it\u2019s totally normal police procedure <a href=\"https:\/\/www.techdirt.com\/2021\/07\/01\/judge-don-willett-calls-out-appeals-court-saying-setting-suicidal-man-fire-didnt-violate-his-rights\/\" rel=\"nofollow noopener\" target=\"_blank\">to light a man on fire<\/a>. Superman wishes his heat vision could do that!<\/p>\n<p>But to the most egregious police conduct <em>occasionally<\/em> results in some 1983 accountability it puts some brakes on police misconduct to know they might have to justify their actions in court if they go full jackboot.<\/p>\n<p>Federal law enforcement has no such check. <\/p>\n<p>The Supreme Court briefly created a workaround to hold federal agents to account in <em>Bivens v. Six Unknown Named Agents<\/em>. But since that 1971 opinion, the Supreme Court has methodically dismantled that remedy. In <em>Egbert v. Boule<\/em> (2022), the Court all but closed the door entirely, reasoning that if Congress wants people to be able to sue federal officers, Congress should pass a law. <\/p>\n<p>These law students take the Court at its word.<\/p>\n<p>Their proposed text of the Federal Officer Accountability Act mirrors Section 1983\u2019s language, extended to those acting under the authority of federal law. But it also adds the kicker that officers found to have used excessive force cannot be shielded by qualified immunity. <\/p>\n<p>Minnesota is presently a constitutional law dumpster fire. The Constitutional Accountability Center identifies <a href=\"https:\/\/www.theusconstitution.org\/news\/five-constitutional-amendments-trump-is-ignoring-in-minnesota\/\" rel=\"nofollow noopener\" target=\"_blank\">at least five constitutional amendments<\/a> that the Trump administration is repeatedly violating on the ground. Federal agents have killed American citizens Ren\u00e9e Good and Alex Pretti <em>on film<\/em> during immigration enforcement operations. <a href=\"https:\/\/democrats-homeland.house.gov\/imo\/media\/doc\/chs_letter_to_noem_re_ice_and_cbp_condemning_deaths.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Over 50 people have died<\/a> in ICE detention under this administration. A federal judge in Minnesota has cataloged <a href=\"https:\/\/www.nytimes.com\/2026\/01\/28\/us\/politics\/judge-minnesota-ice-court-orders.html\" rel=\"nofollow noopener\" target=\"_blank\">ICE violating 96 court orders in 74 cases<\/a> since January 1, 2026 \u2014 a stunning series of contemptuous failures that led <a href=\"https:\/\/abovethelaw.com\/2026\/02\/doj-lawyer-asks-to-be-held-in-contempt-so-she-can-sleep\/\" rel=\"nofollow noopener\" target=\"_blank\">one government lawyer to a bit of an in-court breakdown<\/a>. ICE has taken the position that the Fourth Amendment <a href=\"https:\/\/abovethelaw.com\/2026\/01\/ice-can-bust-into-houses-without-warrants-based-on-memo-so-cool-and-legal-they-keep-it-hidden\/\" rel=\"nofollow noopener\" target=\"_blank\">doesn\u2019t apply<\/a> to noncitizens. The need for a federal 1983 is as pronounced as ever.<\/p>\n<p>Under the current legal framework, the families of the dead have essentially no civil remedy against the individual officers. Even the state courts are closed off because federal agents can automatically remove to federal court. They can\u2019t rely upon internal review \u2014 the FBI had a warrant to investigate Renee Good\u2019s murder <a href=\"https:\/\/www.nytimes.com\/2026\/02\/07\/us\/renee-good-investigation-minnesota-trump.html\" rel=\"nofollow noopener\" target=\"_blank\">and Trump officials called it off<\/a>. <\/p>\n<p>The law students are shouldering the nation\u2019s ethical and constitutional burdens while government lawyers run roughshod.<\/p>\n<p>Administration lawyers are filing baseless charges against <a href=\"https:\/\/abovethelaw.com\/2025\/11\/lindsey-halligan-manages-to-lose-two-cases-at-once-which-is-honestly-impressive\/\" rel=\"nofollow noopener\" target=\"_blank\">the administration\u2019s political enemies<\/a> and <a href=\"https:\/\/abovethelaw.com\/2026\/01\/its-flood-the-zone-friday-as-doj-arrests-black-journalists-under-kkk-act-probes-criminal-charges-for-minneapolis-and-drops-a-sliver-of-the-epstein-files\/\" rel=\"nofollow noopener\" target=\"_blank\">arresting journalists<\/a>, advancing facially frivolous legal theories. As they rack up clear and public violations of the code we are supposedly bound to uphold, the most pressing professional obligation upon the rest of us is to <a href=\"https:\/\/abovethelaw.com\/2026\/01\/disbar-them-all-the-only-accountability-left-for-trumps-lawyers\/\" rel=\"nofollow noopener\" target=\"_blank\">make sure these lawyers never practice again<\/a>. But while these bottom-feeders trash their oaths providing cover for constitutional abuses, law students read an op-ed, recognized a repairable problem in American law, and built a nationwide coalition in seven days. They managed to draft a concrete solution to a problem Congress hasn\u2019t managed to figure out for decades.<\/p>\n<p>The kids, as they say, are all right.
