It\u2019s <a href=\"https:\/\/abovethelaw.com\/2015\/02\/drunk-justice-ruth-bader-ginsburg-wasnt-100-percent-sober-during-state-of-the-union-address\/\" rel=\"nofollow noopener\" target=\"_blank\">a speech that drove Justice Ginsburg to drink<\/a> and that was during a sane administration. Traditionally this is a drinking game, but obviously it doesn\u2019t have to be. For any of you concerned about crossing the line into substance abuse, feel free to play with any other metric you wish. Virgin margaritas, iced coffee, smacking yourself in the face with a hammer\u2026 whatever gets you through the spectacle of Donald Trump ambling through grievances while trying to avoid sharting himself\u2026 <a href=\"https:\/\/www.snopes.com\/news\/2026\/02\/02\/trump-poop-executive-order\/\" rel=\"nofollow noopener\" target=\"_blank\">again<\/a>? <\/p>\n<p>If you\u2019re one of the justices staying home because the president publicly called you an \u201cembarrassment to their families,\u201d maybe you can play along tonight, too!<\/p>\n<p>Unless otherwise noted, take a sip whenever these come up\u2026.<\/p>\n<p><strong>Every Absent Supreme Court Justice (one sip per empty seat)<\/strong>: Let\u2019s jump right in. Trump told the justices who ruled against his tariffs that they were \u201c<a href=\"https:\/\/www.cbsnews.com\/news\/trump-lashes-out-at-his-own-supreme-court-picks-over-tariff-ruling-an-embarrassment-to-their-families\/\" rel=\"nofollow noopener\" target=\"_blank\">barely invited<\/a>\u201d to tonight\u2019s speech and that he \u201ccouldn\u2019t care less if they come.\u201d <a href=\"https:\/\/abovethelaw.com\/2026\/02\/chief-justice-roberts-welcome-to-the-cuck-chair\/\" rel=\"nofollow noopener\" target=\"_blank\">He heaped insults upon Chief Justice Roberts and Justices Barrett and Gorsuch<\/a> for daring to read the IEEPA and agree with the conservative conventional wisdom that starting trade wars is bad for business. It was a stark contrast to last year, when <a href=\"https:\/\/abovethelaw.com\/2025\/03\/watch-the-exact-moment-john-roberts-realizes-he-whored-himself-out\/\" rel=\"nofollow noopener\" target=\"_blank\">Trump personally thanked John Roberts<\/a> for rewriting the Constitution to allow presidents to commit crimes as a treat. Chief Justice Roberts has maintained a perfect attendance record since 2005, but after the president\u2019s tantrum, the Court as an institution should consider a total boycott to maintain its dignity. They won\u2019t though\u2026 <em>Finish your drink<\/em> if every single justice boycotts.<\/p>\n<p><strong>Every Supreme Court namecheck<\/strong>: When President Obama called out the <em>Citizens United<\/em> opinion for inventing a new constitutional standard that opened the door for the sort of corrupt assault on democracy that\u2026 actually came to pass, he spoke about the Supreme Court as an institution, rather than calling out any individual justice. That\u2019s not Trump\u2019s style. As we saw on Friday, he\u2019s ready to get personal whether he\u2019s bashing Barrett or praising Kavanaugh. <\/p>\n<p><strong>Any Other Supreme Court Decision<\/strong>: He won\u2019t be able to help himself from talking tariffs, but what about <em>Roe<\/em> or <em>Dobbs<\/em> or <em>Obergefell<\/em>? Finish your drink if it\u2019s <em>Marbury v. Madison<\/em>.<\/p>\n<p><strong>Attacks Lower Court Judges<\/strong>: The current administration loves attacking judges. The Justice Department is explicitly at \u201c<a href=\"https:\/\/www.nycbar.org\/press-releases\/deputy-attorney-generals-war-on-the-judiciary-is-an-assault-on-judicial-independence\/\" rel=\"nofollow noopener\" target=\"_blank\">war<\/a>\u201d with them. A former senior official <a href=\"https:\/\/abovethelaw.com\/2025\/10\/things-at-the-doj-are-just-as-lawless-as-you-feared\/\" rel=\"nofollow noopener\" target=\"_blank\">instructed the DOJ to say \u201cfuck you\u201d to the courts<\/a>. All this has translated into a <a href=\"https:\/\/www.abajournal.com\/web\/article\/judges-demand-greater-security-amid-escalating-threats\" rel=\"nofollow noopener\" target=\"_blank\">327 percent increase in threats<\/a> against federal judges. As trial judges continue to act as the constitutional guardrail \u2014 with judges appointed by every president from Reagan on putting the brakes on the executive \u2014 they represent an enticing target for a president in mid-rage rant.<\/p>\n<p><strong>His Fake U.S. Attorneys<\/strong>: Among Trump\u2019s many beefs with lower courts is the fact that the lower courts have dutifully applied statutory requirements and disqualified his fake U.S. Attorney picks. <a href=\"https:\/\/abovethelaw.com\/2025\/12\/alina-habba-quits-job-she-never-legally-held\/\" rel=\"nofollow noopener\" target=\"_blank\">Alina Habba eventually got drummed out<\/a> of unlawfully serving as U.S. Attorney in New Jersey. Lindsey Halligan \u2014 a Florida insurance lawyer whose prior prosecutorial experience was exactly zero \u2014 got tossed from the Eastern District of Virginia after a judge ruled her appointment illegal and then she tried to stay on the job before <a href=\"https:\/\/abovethelaw.com\/2026\/01\/brutal-humiliating-benchslap-puts-an-end-to-lindsey-halligan-experiment\/\" rel=\"nofollow noopener\" target=\"_blank\">another judge stepped in and put an end to it<\/a>. Whenever one of these illegal appointments gets legally replaced, the DOJ fires that replacement (often <a href=\"https:\/\/www.cbsnews.com\/news\/white-house-fires-new-top-prosecutor-eastern-virginia-hours-after-he-was-hired-by-judges-james-hundley\/\" rel=\"nofollow noopener\" target=\"_blank\">over X<\/a>). If they come up, take a sip of water and pretend it\u2019s a real drink.<\/p>\n<p><strong>Threatens Lawsuit<\/strong>: Trump has claimed that his role as president means he doesn\u2019t have the time to be sued \u2014 national security requires too much of him to be a party to a lawsuit. Correction: a <em>defendant<\/em> in a lawsuit. Because he\u2019s shown no reciprocal hesitation in bringing lawsuits, including against the federal government itself, <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trumps-10-billion-suit-government-go-sideways-rcna257483\" rel=\"nofollow noopener\" target=\"_blank\">like the one seeking $10 billion<\/a> that Attorney General Pam Bondi will surely defend vigorously on behalf of American taxpayers.<\/p>\n<p><strong>The Dow Jones<\/strong>: As Pam Bondi pleaded with Congress, we should all be talking about the Dow being over 50000. Finish your drink if Trump \u2014 accurately \u2014 edits this to 49000.<\/p>\n<p><strong>Trump Claims Credit For Preventing\/Ending A War<\/strong>: While no one seems willing to ask him why his \u201cday one\u201d pledge to end the invasion of Ukraine never panned out, Trump is more than happy to take credit for ending wars that you never even imagined. He\u2019s claimed to <a href=\"https:\/\/www.the-independent.com\/news\/world\/americas\/us-politics\/trump-macron-war-france-speech-b2635176.html\" rel=\"nofollow noopener\" target=\"_blank\">stop all the wars with France<\/a>, which was news to the French. He used to take credit for <a href=\"https:\/\/www.theguardian.com\/world\/2025\/aug\/19\/trump-claims-to-have-ended-six-wars-is-that-true\" rel=\"nofollow noopener\" target=\"_blank\">resolving six wars<\/a>. Then <a href=\"https:\/\/www.thetimes.com\/us\/american-politics\/article\/what-8-eight-wars-did-trump-end-fact-checked-pxg9h6kxx?gaa_at=eafs&amp;gaa_n=AWEtsqd9BWlNiNQzfODIdHbIw6AGP5V4P0ahQP9MHZO80ofQzh93Lcq1A2Ol6c9N4ag%3D&amp;gaa_ts=699e0ce2&amp;gaa_sig=R2bCp6NOpwmEcUpx93lC8ruX99HlKuMKeYB9gAbF-QQmL067jOi2GCJM3HK5iQbXum_d3el3-0l92R33ysyz-w%3D%3D\" rel=\"nofollow noopener\" target=\"_blank\">it was eight<\/a>. Who knows, but you\u2019re sipping for however many it is.<\/p>\n<p><strong>The Nobel Prize<\/strong>: Relatedly, take a healthy sip if Trump renews his fixation with the Nobel Peace Prize, an award that he wants so badly he <a href=\"https:\/\/edition.cnn.com\/2026\/01\/19\/europe\/trump-norway-nobel-prize-snub-intl\" rel=\"nofollow noopener\" target=\"_blank\">issued a veiled threat to Norway\u2019s Prime Minister<\/a> because he didn\u2019t get one. He has since accepted the physical medal from Venezuelan opposition leader Mar\u00eda Corina Machado \u2014 <a href=\"https:\/\/www.aljazeera.com\/news\/2026\/1\/16\/venezuelas-machado-gives-trump-her-nobel-peace-prize-is-it-his-now\" rel=\"nofollow noopener\" target=\"_blank\">even though the prize cannot be transferred<\/a>. After years of snide commentary from conservatives about \u201cparticipation trophies\u201d in youth sports, Donald Trump now shows off a participation trophy from a game he didn\u2019t play. <em>Finish your drink<\/em> if he\u2019s wearing the medal tonight.<\/p>\n<p><strong>Commentator Refers to the State of the Union as \u201cConstitutionally Required\u201d<\/strong>: A know-it-all move, but as lawyers we can appreciate that.<\/p>\n<p><strong>Insults Olympians<\/strong>: Trump already called one U.S. athlete a \u201c<a href=\"https:\/\/www.cnn.com\/2026\/02\/08\/politics\/hunter-hess-trump-olympics-skier\" rel=\"nofollow noopener\" target=\"_blank\">real loser<\/a>\u201d for expressing mixed emotions about proudly representing the United States at the same time the nation debases itself on the world stage. The Women\u2019s hockey gold medalists have <a href=\"https:\/\/www.espn.com\/olympics\/story\/_\/id\/48017235\/us-women-hockey-declines-trump-invite-state-union\" rel=\"nofollow noopener\" target=\"_blank\">already declined an invitation to be in Trump\u2019s presence<\/a>, and should get the better of the deal since <a href=\"https:\/\/www.yahoo.com\/entertainment\/celebrity\/articles\/usa-womens-hockey-team-just-152412938.html\" rel=\"nofollow noopener\" target=\"_blank\">they\u2019re partying with Flavor Flav instead<\/a>.<\/p>\n<p><strong>Birthright Citizenship<\/strong>: He\u2019s going to talk about immigration \u2014 we aren\u2019t trying to get anyone\u2019s stomach pumped by including \u201cICE\u201d or anything like that in this game. But that doesn\u2019t mean we shouldn\u2019t have an item related to his go-to subject. Trump\u2019s been trying to end birthright citizenship by executive order since day one, and the courts have so far stuck to <a href=\"https:\/\/abovethelaw.com\/tag\/birthright-citizenship\/\" rel=\"nofollow noopener\" target=\"_blank\">the Fourteenth Amendment saying what it explicitly says<\/a>. Bonus if he ties birthright citizenship to attacking an Olympian.<\/p>\n<p><strong>Claims He Won the 2020 Election<\/strong>: Six years after the fact, Trump still seems interested in pretending he won the 2020 election. This is like winning the Super Bowl and spending the post-game press conference arguing about a regular season pass interference call from four years ago. Go ahead and finish your drink and make sure your passport is up-to-date if he says this is why he\u2019s going to seize control of future elections.<\/p>\n<p><strong>Legal Enemies List<\/strong>: Take a sip for any of the following mentioned by name: Merrick Garland, Jack Smith, Letitia James, James Comey, Fani Willis, or any of the January 6 Committee. Bonus sip if the words \u201clawfare\u201d or \u201cweaponization\u201d are used in the same train of thought.<\/p>\n<p><strong>Jeffrey Epstein<\/strong>: How do you set odds for this one? Is he going to pointedly avoid the document releases that implicate him thousands \u2014 if not a million \u2014 times while dragging his Attorney General Pam Bondi\u2019s malicious incompetence under a spotlight? Or does he return to the playbook that\u2019s incredibly served him so well for years and call his deep and meticulously detailed ties to a notorious sex trafficker \u201cfake news\u201d? Honestly, both seem entirely possible. He has since accepted the physical medal from Venezuelan opposition leader Mar\u00eda Corina Machado \u2014 <a href=\"https:\/\/www.aljazeera.com\/news\/2026\/1\/16\/venezuelas-machado-gives-trump-her-nobel-peace-prize-is-it-his-now\" rel=\"nofollow noopener\" target=\"_blank\">even though the prize cannot be transferred<\/a>. After years of snide commentary from conservatives about \u201cparticipation trophies\u201d in youth sports, Donald Trump now shows off a participation trophy from a game he didn\u2019t play. <em>Finish your drink<\/em> if he\u2019s wearing the medal tonight.<\/p>\n<p><strong>Commentator Refers to the State of the Union as \u201cConstitutionally Required\u201d<\/strong>: A know-it-all move, but as lawyers we can appreciate that.<\/p>\n<p><strong>Insults Olympians<\/strong>: Trump already called one U.S. athlete a \u201c<a href=\"https:\/\/www.cnn.com\/2026\/02\/08\/politics\/hunter-hess-trump-olympics-skier\" rel=\"nofollow noopener\" target=\"_blank\">real loser<\/a>\u201d for expressing mixed emotions about proudly representing the United States at the same time the nation debases itself on the world stage. The Women\u2019s hockey gold medalists have <a href=\"https:\/\/www.espn.com\/olympics\/story\/_\/id\/48017235\/us-women-hockey-declines-trump-invite-state-union\" rel=\"nofollow noopener\" target=\"_blank\">already declined an invitation to be in Trump\u2019s presence<\/a>, and should get the better of the deal since <a href=\"https:\/\/www.yahoo.com\/entertainment\/celebrity\/articles\/usa-womens-hockey-team-just-152412938.html\" rel=\"nofollow noopener\" target=\"_blank\">they\u2019re partying with Flavor Flav instead<\/a>.<\/p>\n<p><strong>Birthright Citizenship<\/strong>: He\u2019s going to talk about immigration \u2014 we aren\u2019t trying to get anyone\u2019s stomach pumped by including \u201cICE\u201d or anything like that in this game. But that doesn\u2019t mean we shouldn\u2019t have an item related to his go-to subject. Trump\u2019s been trying to end birthright citizenship by executive order since day one, and the courts have so far stuck to <a href=\"https:\/\/abovethelaw.com\/tag\/birthright-citizenship\/\" rel=\"nofollow noopener\" target=\"_blank\">the Fourteenth Amendment saying what it explicitly says<\/a>. Bonus if he ties birthright citizenship to attacking an Olympian.<\/p>\n<p><strong>Claims He Won the 2020 Election<\/strong>: Six years after the fact, Trump still seems interested in pretending he won the 2020 election. This is like winning the Super Bowl and spending the post-game press conference arguing about a regular season pass interference call from four years ago. Go ahead and finish your drink and make sure your passport is up-to-date if he says this is why he\u2019s going to seize control of future elections.<\/p>\n<p><strong>Legal Enemies List<\/strong>: Take a sip for any of the following mentioned by name: Merrick Garland, Jack Smith, Letitia James, James Comey, Fani Willis, or any of the January 6 Committee. Bonus sip if the words \u201clawfare\u201d or \u201cweaponization\u201d are used in the same train of thought.<\/p>\n<p><strong>Jeffrey Epstein<\/strong>: How do you set odds for this one? Is he going to pointedly avoid the document releases that implicate him thousands \u2014 if not a million \u2014 times while dragging his Attorney General Pam Bondi\u2019s malicious incompetence under a spotlight? Or does he return to the playbook that\u2019s incredibly served him so well for years and call his deep and meticulously detailed ties to a notorious sex trafficker \u201cfake news\u201d? Honestly, both seem entirely possible.
