Would you look at that?<\/p>\n<p>After months of bluster, threats, and performative chest-thumping, the Trump administration is reportedly slinking away from its own unconstitutional tantrum.<\/p>\n<p>According to <a href=\"https:\/\/www.wsj.com\/us-news\/law\/trump-administration-to-drop-defense-of-law-firm-sanctions-cb839c39\" rel=\"nofollow noopener\" target=\"_blank\">The Wall Street Journal<\/a>, the Department of Justice \u201cas soon as Monday is expected to drop its appeals of four trial-court rulings that struck down President Donald Trump\u2019s actions against law firms Jenner &amp; Block, WilmerHale, Perkins Coie, and Susman Godfrey.\u201d<\/p>\n<p>Let\u2019s just sit with that for a second.<\/p>\n<p>These were the <a href=\"https:\/\/abovethelaw.com\/tag\/executive-orders\/\" rel=\"nofollow noopener\" target=\"_blank\">executive orders<\/a> that were supposedly so urgent, so righteous, so necessary to punish Biglaw for its perceived sins: representing the \u201cwrong\u201d clients, supporting diversity initiatives, not sufficiently genuflecting before MAGA orthodoxy. The administration went out of its way to make an example of firms like Jenner &amp; Block, WilmerHale, Perkins Coie, and Susman Godfrey.<\/p>\n<p>And what happened?<\/p>\n<p>Judge after judge \u2014 <a href=\"https:\/\/abovethelaw.com\/2025\/03\/not-one-but-two-george-w-bush-appointed-judges-grant-restraining-orders-against-trumps-biglaw-executive-orders\/\" rel=\"nofollow noopener\" target=\"_blank\">across ideological lines <\/a>\u2014 looked at these orders and said <em>absolutely the hell not<\/em>. The orders were unconstitutional and retaliatory abuses of executive power, and the courts fiercely swatted them down.<\/p>\n<p>The <a href=\"https:\/\/abovethelaw.com\/2025\/07\/trump-wont-give-up-on-his-biglaw-executive-orders-until-he-gets-in-front-of-the-supreme-court\/\" rel=\"nofollow noopener\" target=\"_blank\">administration appealed<\/a>. Because you can\u2019t build a culture war brand upon quietly accepting limitations, no matter how clearly articulated by the basic rule of law. But after all the posturing \u2014 and, presumably, under the distracting cover a war with Iran \u2014 the administration is dropping the appeals to avoid more humiliating losses.<\/p>\n<p>All of which places a rather uncomfortable spotlight on <a href=\"https:\/\/abovethelaw.com\/2025\/04\/biglaw-is-under-attack-heres-what-the-firms-are-doing-about-it\/\" rel=\"nofollow noopener\" target=\"_blank\">the nine firms<\/a> that <a href=\"https:\/\/abovethelaw.com\/2025\/10\/playing-the-blame-game-over-the-biglaw-trump-deals\/\" rel=\"nofollow noopener\" target=\"_blank\">bent a knee<\/a> and traded their dignity to the administration rather than fight.<\/p>\n<p>Those firms agreed to pony up a jaw-dropping $940 million in pro bono commitments \u2014 <a href=\"https:\/\/abovethelaw.com\/tag\/pro-bono-payola\/\" rel=\"nofollow noopener\" target=\"_blank\">payola<\/a> dressed up as patriotism \u2014 because they were afraid of these very executive orders. They calculated that it was safer to write a massive check in free legal services on behalf of\u00a0<a href=\"https:\/\/abovethelaw.com\/2025\/04\/biglaw-firms-in-league-with-donald-trump-now-have-to-defend-cops-that-kill-black-and-brown-people\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">conservative clients or approved causes<\/a> than to risk being on the receiving end of a retaliatory EO. And their explicit acts of capitulation had a documented <a href=\"https:\/\/abovethelaw.com\/2025\/05\/biglaws-trump-deals-have-chilling-effect-on-pro-bono\/\" rel=\"nofollow noopener\" target=\"_blank\">chilling effect<\/a> on the entire industry.<\/p>\n<p>Now even the government concedes that the orders were indefensible.<\/p>\n<p>Imagine being in the next partnership meeting, listening to leadership explain that \u201cWe had to make a deal. The executive orders were too dangerous!\u201d Along the way, the firms became infamous with law students and a lot of clients, all to avoid executive orders that the MAGA faithful at the DOJ have decided aren\u2019t even worth defending anymore.<\/p>\n<p>With the appeals being quietly ushered offstage, the contrast couldn\u2019t be sharper. Some firms bet on the courts and the rule of law. Others bet on appeasement.<\/p>\n<p>Only one group looks good today.
