Bush Judge Thinks This White House Argument Is Ridiculous"},"content":{"rendered":"<p>There are only so many times you can stand in federal court and insist that up is down, black is white, and bulldozing a historic wing of the White House is just a light home improvement project before a judge decides he\u2019s had enough.<\/p>\n<p>This week, in the <a href=\"https:\/\/abovethelaw.com\/2026\/01\/judge-gives-trumps-of-course-i-can-bulldoze-the-east-wing-if-i-wanna-argument-the-side-eye-it-deserves\/\" rel=\"nofollow noopener\" target=\"_blank\">ongoing \u201cWhite House ballroom\u201d litigation<\/a>, which to my continual shock is not a Veep subplot but actual reality, Judge Richard Leon finally let the exasperation show. (Also known as\u00a0the case brought by the National Trust for Historic Preservation over the Trump administration\u2019s unilateral demolition of the East Wing of the White House to build a $400 million White House ballroom \u2014 funded privately \u2014 with exactly zero Congressional approval or oversight.) And when the judge starts openly questioning your relationship with reality\u2026 it\u2019s not exactly a great sign for the government\u2019s case.<\/p>\n<p>At issue remains the Trump administration\u2019s apparent belief that the White House is less \u201cseat of government\u201d and more \u201cHGTV fixer-upper.\u201d According<a href=\"https:\/\/edition.cnn.com\/2026\/03\/17\/politics\/white-house-east-wing-alteration-brazen-interpretation-laws-vocabulary\" rel=\"nofollow noopener\" target=\"_blank\"> to reports<\/a>, the latest hearing made clear that the Department of Justice is still clinging to its argument that knocking down the East Wing to make room for a grotesque ballroom somehow qualifies as a mere \u201calteration.\u201d That thesaurus-based violence will not stand in Judge Leon\u2019s courtroom, he said calling the demo\u00a0\u201can alteration\u2026 takes some brazen interpretation of the laws of vocabulary.\u201d<\/p>\n<p>Yikes. That can\u2019t feel great. <\/p>\n<p>And if the DOJ thought it could smooth things over<a href=\"http:\/\/washingtonpost.com\/politics\/2026\/03\/17\/trump-ballroom-judge-hearing\/\" rel=\"nofollow noopener\" target=\"_blank\"> by analogizing<\/a> the White House to national parks, welp, Leon was equally unimpressed. The White House, he reminded everyone, \u201cis a special place,\u201d and this isn\u2019 swapping out a park bench at Yellowstone. Leon went even further, emphasizing a point that seems almost quaint in this litigation, that no matter how much cheap gold paint Donald Trump bathes the place in, he is not the owner of the White House, he\u2019s the current \u201csteward\u201d of an \u201can iconic symbol of this nation.\u201d <\/p>\n<p>Leon described the government\u2019s \u201cshifting theories and shifting dynamics\u201d which has become the defining feature of the case.
