This week Alina Habba went on The View to tell those godless liberals what\u2019s up. She was asked about the shooting at the White House Correspondents\u2019 Dinner. (\u201cStill rattled.\u201d) She was asked about healthcare. (\u201cConcepts of a plan.\u201d) The $1 million sanctions order she got from Judge Donald Middlebrooks for filing a frivolous RICO suit against Hillary Clinton, James Comey, and half the Democrats in DC. (\u201cA Hillary Clinton-appointed judge sanctioned me for suing Hillary Clinton.\u201d)<\/p>\n

But no one was interested in Habba\u2019s take on drug prices. (\u201cGoing down.\u201d) Less than 24 hours after the Justice Department indicted Comey for posting seashells on Insta, Habba was invited on to be the heel. Her job was to indignantly insist that Comey had been threatening to assassinate Trump, and then absorb the audience\u2019s inevitable scorn \u2026 which she did.<\/p>\n

But Habba did more than just defend the indictment. She also claimed that law enforcement routinely charges defendants under 18 USC \u00a7 875 for using the number \u201c86.\u201d<\/p>\n

\u201cA gentleman posted that about me. He posted on Twitter 86 Habba and he was also charged,\u201d she huffed. \u201cHe was charged in Florida. He was held accountable because you cannot do it.\u201d<\/p>\n

Was he now?<\/em><\/p>\n

On June 25, 2025, an Orlando man named Salvatore Russotto was charged<\/a> under \u00a7 875 for making true threats to Habba. He did indeed tweet \u201c86 HABBA\u201d multiple times. As part of an extended social media bender<\/a> the prior month, Russotto called to \u201c86\u201d Chuck Schumer, Rep. Hakeem Jeffries, Joe Biden, Jim Comey, Justice Ketanji Brown Jackson, Canada, \u201call demonRATS,\u201d and Black people. Only he didn\u2019t say \u201cBlack people.\u201d<\/p>\n

Russotto was not<\/em> charged with threatening Canada or Biden or Comey, whom he said \u201cneeds to die a slow and painful death\u201d and \u201cmust be eliminated.\u201d He was only charged with threatening Habba, the president\u2019s former personal lawyer who was then LARP-ing as US Attorney for New Jersey. <\/p>\n

This is not terrific evidence of even-handed administration of justice. On the other hand, Russotto did tweet at<\/em> Habba nine times in an hour on May 20. In addition to calling to \u201c86\u201d her, he repeatedly wished for her \u201cslow and painful death\u201d and demanded that she get the death penalty. <\/p>\n

Arguably, Russotto\u2019s tweets are protected First Amendment speech under Watts v. US<\/a><\/em> and Counterman v. Colorado<\/a><\/em>. We\u2019ll never find out, though, since he took a plea, agreeing to spend a year on probation and get mental health treatment. In any event, this is clearly closer to a \u201ctrue threat,\u201d than tweeting a picture of seashells at no one in particular. And a cursory examination of the exhibits in Russotto\u2019s prosecution actually highlights how un<\/em>evenly Trump\u2019s DOJ treats these supposed threats. <\/p>\n

Sadly, Habba is unlikely to make an encore appearance to correct the record with the ladies of The View. Host Sunny Hostin, a former federal prosecutor, mercilessly skewered Habba, reminding her that the 11th Circuit was no more impressed with that RICO trollsuit than that \u201cHillary Clinton appointee.\u201d Time to run back to the Fox greenroom!<\/p>\n

But perhaps those \u201c86 Comey\u201d tweets will come up in a motion to dismiss for selective and vindictive prosecution in the Eastern District of North Carolina.<\/p>\n
