It makes sense that there would be pushback for stances like \u201c<a href=\"https:\/\/abovethelaw.com\/2025\/08\/aba-strikes-back-at-trump-condemning-his-attacks-on-lawyers-and-the-rule-of-law\/\" rel=\"nofollow noopener\" target=\"_blank\">the rule of law is good and worth defending<\/a>\u201d at a time when the collective shrugs off <a href=\"https:\/\/www.npr.org\/2025\/04\/29\/g-s1-63187\/trump-courts-immigration-judges-due-process\" rel=\"nofollow noopener\" target=\"_blank\">the due-process-skirting president<\/a> being touted as a King:<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">TWO KINGS. \ud83d\udc51 <a href=\"https:\/\/t.co\/iPVUxc4i4H\" rel=\"nofollow\">pic.twitter.com\/iPVUxc4i4H<\/a><\/p>\n<p>\u2014 The White House (@WhiteHouse) <a href=\"https:\/\/twitter.com\/WhiteHouse\/status\/2049208884280062270?ref_src=twsrc%5Etfw\" rel=\"nofollow noopener\" target=\"_blank\">April 28, 2026<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p>As stupid as it is to argue that the ABA should be abandoned as an accrediting body because it is \u201cforcing DEI down our throats\u201d is (it has been <a href=\"https:\/\/abovethelaw.com\/2024\/02\/aba-committee-decides-to-diversify-diversity-it-should-come-with-a-clear-reason-why-thats-important\/\" rel=\"nofollow noopener\" target=\"_blank\">retreating from DEI for years<\/a> and just went race neutral with their <a href=\"https:\/\/abovethelaw.com\/2026\/04\/aba-settlement-over-legal-opportunity-scholarship-fund-goes-about-how-youd-expect-it-to\/\" rel=\"nofollow noopener\" target=\"_blank\">Legal Opportunity Scholarship Fund<\/a>), there\u2019s a colorable argument that by supporting diversity the ABA is no longer neutral, an argument that flies especially well when the party in power is <a href=\"https:\/\/www.pbs.org\/newshour\/show\/trump-administration-posts-echo-rhetoric-linked-to-extremist-groups\" rel=\"nofollow noopener\" target=\"_blank\">White supremacy posting on main<\/a>. But even among these heavy hitters, the ABA is an evil monopoly angle is particularly weak considering that it does its job at accreditation pretty well. Nonetheless, the FTC is stepping in to ask state supreme courts to take on extra burdens to usurp the ABA;s powers. <a href=\"https:\/\/www.abajournal.com\/news\/article\/ftc-calls-on-tennessee-supreme-court-to-end-reliance-on-aba-law-school-accreditation\" rel=\"nofollow noopener\" target=\"_blank\">ABA Journal<\/a> has coverage:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Brendan Chestnut, the director of the FTC\u2019s Office of Policy Planning, and Daniel Guarnera, director of its Bureau of Competition, wrote in an <a href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/FTCDOJLettertoTennesseeSupremeCourt.pdf\" rel=\"nofollow noopener\" target=\"_blank\">April 30 letter<\/a> that the state supreme court should reassess its \u201creliance on American Bar Association law school accreditation.\u201d They said allowing the ABA to determine educational requirements for taking the bar exam and practicing law in Tennessee \u201craises serious competitive risks.\u201d<\/p>\n<\/blockquote>\n<p>Are the serious competitive risks in the room with us?<\/p>\n<p>The argument is that the ABA\u2019s monopoly as an accrediting institution \u201cthwart[s] lower cost alternatives for legal education.\u201d But here\u2019s the thing: consumers are benefitted when lawyers (like most professions) are held to a quality baseline level. You may have a jump in lawyers if bypassing the ABA lets DeVry become a lawyer mill, but who would want them as their attorney? And on the other side of the set-up, what prospective students in their right mind would want to go to a law school that doesn\u2019t fall within the ABA\u2019s cut-offs for education quality and bar passage rates? Of course the school could be held to some other accrediting body\u2019s standards, but let\u2019s be honest when someone is going through a lot of effort to reinvent the wheel. When Texas\u2019s Supreme Court decided to become a law school accrediting body, <a href=\"https:\/\/abovethelaw.com\/2026\/01\/texas-supreme-court-takes-on-role-as-law-school-accreditor\/\" rel=\"nofollow noopener\" target=\"_blank\">they effectively copy and pasted ABA standards 316, 502(a)-(c), 503, and 509<\/a>. What good did that do except give the justices some additional paper work?<\/p>\n<p>The biggest issue with knighting some other body to hand out law school accreditation is portability. As it stands, the ABA is the gold standard. The Texas and Florida supreme courts may vet law schools in their state, but why should employers in New Jersey or Minnesota respect the vetting? They will probably cross reference the school with the ABA\u2019s rating of them. If they pass ABA muster, the state supreme courts\u2019 thumbs up was superfluous. If the school gets a court\u2019s approval but not the ABA\u2019s, why risk it?<\/p>\n<p>It\u2019s an uphill battle to switch off the ABA. But hey, good luck to the FTC and Tennessee.
