It\u2019s sort of a Temu Schoolhouse Rock \u2014 the sort of artistic homage\/ripoff befitting the court charged with unique power over intellectual property \u2014 offering civic education without any of the enduring catchiness. <\/p>\n<p>It makes \u201c<a href=\"https:\/\/abovethelaw.com\/2007\/08\/nixon-peabody-themesonggate-a-synopsis\/\" rel=\"nofollow noopener\" target=\"_blank\">Everyone\u2019s A Winner At Nixon Peabody<\/a>\u201d look positively dignified.<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube\">\n<div class=\"wp-block-embed__wrapper\">\n<\/div>\n<\/figure>\n<p>It opens on a cartoon monkey riding a rocket ship, then an uncharacteristically spry Ronald Reagan leads a conga line, and the court flexes about its authority over international trade policy right as the current administration screams bloody murder over tariffs.<\/p>\n<p>But one verse stands out:<\/p>\n<p><em>Now, you might\u00a0ask, who wears the robe? <br \/>Who gets to judge cases we know. <br \/>The president picks. That\u2019s how it\u2019s done. <br \/>Then the Senate confirms each one. <br \/>They serve for life to stay independent and fair.<\/em><\/p>\n<p>For life, you say? Because this would be news to Judge Pauline Newman, who is \u2014 as of this writing \u2014 in active litigation against her Federal Circuit colleagues. Judge Newman has asked the <a href=\"https:\/\/abovethelaw.com\/2026\/03\/pauline-newman-petitions-supreme-court-to-hear-her-case\/\" rel=\"nofollow noopener\" target=\"_blank\">Supreme Court to hear her case<\/a> after the circuit court, led by Chief Judge Kimberly Moore, suspended her from hearing new cases in September 2023 and have now renewed that suspension annually \u2014 making it <a href=\"https:\/\/nclalegal.org\/press_release\/ncla-asks-scotus-to-mandate-review-of-unlawful-orders-removing-federal-circuit-judge-newman\/\" rel=\"nofollow noopener\" target=\"_blank\">the longest suspension of a federal judge in American history<\/a>. Her panel colleagues claim they have the authority to lock her out in perpetuity based upon her mental fitness, citing the D.C. Circuit ruling that <a href=\"https:\/\/reason.com\/volokh\/2026\/03\/12\/is-judge-pauline-newman-entitled-to-her-day-in-court\/\" rel=\"nofollow noopener\" target=\"_blank\">judicial conduct and disability determinations are unreviewable<\/a>. Even though she has submitted to three independent expert evaluations by three different doctors, all of whom have <a href=\"https:\/\/abovethelaw.com\/2024\/09\/huge-development-in-pauline-newmans-case-the-test-results-are-in\/\" rel=\"nofollow noopener\" target=\"_blank\">concluded she is fit to perform her duties<\/a>, the rest of the circuit has shrugged its shoulders and asserted the authority to pocket impeach one of their active colleagues.<\/p>\n<p>Life tenure for judges is a stupid holdover from an era where the Framers expected federal judges wouldn\u2019t view the gig as a birthright. To get technical about it, the Constitution doesn\u2019t propose life tenure, it just sets the only removal mechanism as congressional impeachment and courts have interpreted that to mean judges must otherwise serve for life. The idea that life tenure shields the judiciary from politics didn\u2019t survive Chief Justice Marshall. If anything, life tenure now artificially constricts the judicial talent pool to whoever the administration thinks has the best actuarial chance to deliver dead hand policy influence for decades to come. <\/p>\n<p>But until we change the law, judges serve for life. Whether Judge Newman should continue hearing cases or not is a matter for Congress, not an unreviewable set of her fellow judges. <\/p>\n<p>Which makes the theme song\u2019s cheerful invocation of life tenure so insane.
