Pauline Newman, supported by a <a href=\"https:\/\/abovethelaw.com\/2026\/04\/judges-and-former-clerks-encourage-scotus-to-hear-judge-pauline-newmans-case\/\" rel=\"nofollow noopener\" target=\"_blank\">slew of judges and former clerks<\/a>, asked the Supreme Court to give her case a once over. The hope was that the glaring due process issues would catch Court\u2019s eye. The notion that a panel of judges could oust a coworker without going through the constitutionally mandated procedure of rounding up Congress to vote is a chilling thought \u2014 one that may have led a noted drop in federal dissents since Newman was shadow impeached by her colleagues. The way that the Federal Circuit has robbed Newman of due process (<a href=\"https:\/\/abovethelaw.com\/2026\/05\/federal-circuit-releases-its-own-theme-song-managing-to-be-both-embarrassing-and-damning\/\" rel=\"nofollow noopener\" target=\"_blank\">and School House of Rock-esque informational content)<\/a> should be under review, but the Supreme Court has opted out of being the one to do it. <a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-pauline-newman-judge-federal-circuit-suspension\/\" rel=\"nofollow noopener\" target=\"_blank\">CBS News<\/a> has coverage:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The Supreme Court on Monday turned away Judge Pauline Newman\u2019s bid to return to service on a federal appeals court after she was suspended from hearing cases due to concerns about her fitness to serve.<br \/>\u2026<br \/>\u201cIt is a dark day for the independence of the federal judiciary,\u201d Mark Chenoweth, the [New Civil Liberties Alliance\u2019s] president, said in a statement. \u201cThe cert denial in this case means that Judge Newman\u2019s due process and other complaints about the way Chief Judge Moore and the Federal Circuit Judicial Council have treated her never have and never will receive a merits decision from an Article III court. That is utterly inexcusable and truly inexplicable.\u201d<\/p>\n<\/blockquote>\n<p>What would it take? Maybe if a Trump-appointed judge got accused of mental shortcomings <a href=\"https:\/\/abovethelaw.com\/2023\/03\/kyle-duncan-stanford-law-school\/\" rel=\"nofollow noopener\" target=\"_blank\">because they yelled at a bunch of law students for asking questions<\/a> or <a href=\"https:\/\/abovethelaw.com\/2023\/09\/fifth-circuits-battling-over-meaning-of-bible-verses-because-thats-how-they-make-law\/\" rel=\"nofollow noopener\" target=\"_blank\">turned a judicial decision in to Biblical amateur hour<\/a> and were suspended until they were evaluated by that court\u2019s cherry-picked experts the Court would have more interest? Quick, somebody get on that <a href=\"https:\/\/abovethelaw.com\/2026\/04\/the-alito-retirement-denial-has-been-upgraded\/\" rel=\"nofollow noopener\" target=\"_blank\">before Alito retires<\/a>.<\/p>\n<p>The situation reads like Moore &amp; The Gang chose favorites, the D.C.
