A wild turn of events for a law school once called a \u201cmodel of complicity.\u201d Too bad it seems as though their parent university is still looking to cower.<\/p>\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.nytimes.com\/2026\/07\/07\/us\/yale-law-school-dean-trump-deal.html\" rel=\"nofollow noopener\" target=\"_blank\">According to the <em>New York Times<\/em><\/a>, Dean Cristina Rodriguez and her colleagues have been lobbying Yale\u2019s leadership to walk away from settlement talks over the ongoing DOJ investigation into admissions, arguing \u2014 correctly \u2014 that the administration cannot be trusted and that folding threatens both the university\u2019s independence and the rule of law. The report suggests that Dean Rodriguez may have even floated the idea that the law school be carved out of any agreement the university enters.<\/p>\n<p class=\"wp-block-paragraph\">Back in 2018, the school <a href=\"https:\/\/yaledailynews.com\/blog\/2022\/05\/22\/outpouring-of-protest-surrounds-kavanaugh-confirmation\/\" rel=\"nofollow noopener\" target=\"_blank\">cheered on alumnus Brett Kavanaugh<\/a> via official press release, and a Yale Law professor published a Wall Street Journal essay titled \u201cKavanaugh Is a Mentor to Women.\u201d Then Kavanaugh helped push <em>Students for Fair Admissions<\/em>, the 2023 decision ending race-conscious admissions, across the line. That ruling is the legal basis of the DOJ\u2019s effort to bully Yale into a series of concessions aimed at allowing the Trump administration to micromanage the school. Bang up job, you guys.<\/p>\n<p class=\"wp-block-paragraph\">\u201cYale\u2019s leaders have privately contended that they may need to strike a deal to ensure the university continues to receive federal funding,\u201d a source told the <em>Times<\/em>. Interesting theory\u2026 as it happens, there\u2019s a control group.<\/p>\n<p class=\"wp-block-paragraph\">Harvard <a href=\"https:\/\/www.cnn.com\/2025\/09\/03\/politics\/harvard-trump-first-amendment-funding-cuts\" rel=\"nofollow noopener\" target=\"_blank\">sued and won<\/a> when the administration came for their funding. A federal judge found the government had used antisemitism as a smokescreen for an ideological assault and ordered roughly $2.7 billion in grants restored. Harvard <a href=\"https:\/\/abovethelaw.com\/2025\/10\/trump-makes-big-claim-about-a-500m-harvard-settlement\/\" rel=\"nofollow noopener\" target=\"_blank\">may have flirted with writing a check too<\/a>, though Trump himself floated the potential $500 million settlement from Harvard, in the same register that he keeps telling us that he\u2019s <a href=\"https:\/\/apnews.com\/article\/fact-check-trump-prescription-drug-prices-drop-b3e5bf8a98310de45e39d3911d112979\" rel=\"nofollow noopener\" target=\"_blank\">cut drug prices 1500 percent<\/a>, so take it with several grains of salt.<\/p>\n<p class=\"wp-block-paragraph\">Yale University leaders seem to be ceding their inferiority to Harvard, which should mark the quiet end to any serious comparison of the two institutions if Yale stays the course. It\u2019s also, bizarrely, embarking on this path long after the administration established a solid record of breaching its agreements. After Columbia bent over for the administration, <a href=\"https:\/\/www.politico.com\/news\/2025\/03\/21\/columbia-university-agrees-to-trump-demands-to-restore-federal-funding-00243919\" rel=\"nofollow noopener\" target=\"_blank\">agreeing to multiple demands in March 2025<\/a> and Trump just came back and demanded another $200 million. Biglaw firms making deals with Trump rapidly <a href=\"https:\/\/abovethelaw.com\/2025\/04\/biglaw-firms-making-trump-deals-reaching-the-find-out-phase\/\" rel=\"nofollow noopener\" target=\"_blank\">found themselves in the \u201cand Find Out\u201d stage<\/a> when the administration <a href=\"https:\/\/abovethelaw.com\/2025\/04\/pray-i-dont-alter-it-any-further-what-darth-vader-should-teach-law-firms-about-settling-with-trump\/\" rel=\"nofollow noopener\" target=\"_blank\">altered the deals<\/a>. We\u2019ve had a peace deal with Iran supposedly in place for weeks now. It\u2019s simply not worth trying to deal with these buffoons.<\/p>\n<p class=\"wp-block-paragraph\">UVA also made a deal with the Trump administration, leading to UVA\u2019s president, James Ryan, <a href=\"https:\/\/www.notus.org\/education\/justice-department-investigation-university-virginia-jim-ryan\" rel=\"nofollow noopener\" target=\"_blank\">resigning under DOJ pressure<\/a> and the school promising to hand over quarterly compliance certifications for years. That experience should serve as a warning for Yale on another level. Yale has hired McGuireWoods to handle its negotiations \u2014 the same firm that represented UVA.<\/p>\n<p class=\"wp-block-paragraph\">Ryan later wrote a long letter about the experience, and one line stands out:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">I do not know if [McGuire Woods attorneys] were exercising their independent judgment or receiving directions from a board member and\/or the attorney general\u2019s office.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">The AG in that instance was a Republican working with Trump. So a former client is saying, in writing, that he could not tell whether his own lawyers were working for him or for the people across the table. If Yale Law wants a professional responsibility issue-spotter, that allegation is one of the most damning an exam could pose. Strip out a lawyer\u2019s independent professional judgment and you don\u2019t have counsel as much as a chaperone walking your surrender across the street. <\/p>\n<p class=\"wp-block-paragraph\">It doesn\u2019t exactly help the optics that one of the McGuireWoods lawyers on the matter <a href=\"https:\/\/www.notus.org\/education\/justice-department-investigation-university-virginia-jim-ryan\" rel=\"nofollow noopener\" target=\"_blank\">had worked on Project 2025<\/a>. For its part, McGuireWoods did not respond to the <em>Times<\/em> when the paper asked for comment.<\/p>\n<p class=\"wp-block-paragraph\">When it comes to hiring McGuireWoods, UVA had a structural reason that Yale does not. Virginia is a public university, and its counsel is effectively appointed through the state attorney general \u2014 a Republican ally of the administration \u2014 which is how UVA wound up, as UVA\u2019s former university counsel <a href=\"https:\/\/uvamagazine.org\/articles\/mounting_pressure\" rel=\"nofollow noopener\" target=\"_blank\">put it<\/a>, \u201csaddled with counsel aligned with the other side.\u201d But Yale can hire whoever they want! With the entire American legal market available to the Ivy League institution, it saw a firm whose last foray into <em>this exact issue<\/em> ended with its client publicly wondering if the firm acted to undermine the school, and thought: \u201cperfect!\u201d<\/p>\n<p class=\"wp-block-paragraph\">The <em>Times<\/em> piece cites former dean Robert Post saying that the university\u2019s leaders don\u2019t confront the law school faculty on legal issues as much as they should.
