The threats against federal judges \u2014 <a href=\"https:\/\/abovethelaw.com\/2026\/03\/ill-put-a-bullet-in-your-head-the-disturbing-reality-of-being-a-judge-in-america\/\" rel=\"nofollow noopener\" target=\"_blank\">primarily lower court judges ruling against the Trump administration<\/a> \u2014 are well-documented and the federal judiciary seeks approximately 10 percent more funding to address the threat. Though, if they\u2019re being honest, the budget increase isn\u2019t just for the personal security of the judges, as it also covers enhancements to the courts\u2019 <a href=\"https:\/\/abovethelaw.com\/2026\/01\/supreme-court-hacked-proving-its-cybersecurity-is-as-robust-as-its-ethical-code\/\" rel=\"nofollow noopener\" target=\"_blank\">abysmal cybersecurity<\/a>. But it\u2019s a lot easier sell to focus on <a href=\"https:\/\/abovethelaw.com\/2026\/07\/when-being-a-scotus-justice-means-explaining-bulletproof-vests-to-your-kids\/\" rel=\"nofollow noopener\" target=\"_blank\">protecting judges<\/a> from violent extremists than to point out <a href=\"https:\/\/abovethelaw.com\/2025\/08\/pacer-gets-pwned-hackers-breach-dinosaur-filing-system\/\" rel=\"nofollow noopener\" target=\"_blank\">that PACER sucks<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">Given that Supreme Court justices don\u2019t appear before Congress every day \u2014 in part because Chief Justice Roberts takes the position that testifying before the public <a href=\"https:\/\/abovethelaw.com\/2023\/04\/roberts-senate-budget-cuts\/\" rel=\"nofollow noopener\" target=\"_blank\">is a separation of powers violation<\/a> \u2014 the hearing touched on a number of topics that the justices rarely have to talk about. Including the infamous shadow docket.<\/p>\n<p class=\"wp-block-paragraph\">On that subject, Alex Aronson of <a href=\"https:\/\/www.courtaccountability.org\/\" rel=\"nofollow noopener\" target=\"_blank\">Court Accountability<\/a> flagged this key nugget of Barrett\u2019s testimony:<\/p>\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><a href=\"https:\/\/bsky.app\/profile\/alexaronson.bsky.social\/post\/3mqmjkyj3n22n\" rel=\"nofollow noopener\" target=\"_blank\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"948\" height=\"308\" src=\"https:\/\/i0.wp.com\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2026\/07\/Screenshot-2026-07-14-at-3.18.48-PM.jpg?resize=948%2C308&#038;ssl=1\" alt=\"\" class=\"wp-image-1187778\" title=\"\"><\/a><figcaption><\/figcaption><\/figure>\n<p class=\"wp-block-paragraph\">In 2022, Justice Barrett <a href=\"https:\/\/abovethelaw.com\/2022\/04\/read-the-opinion-urges-supreme-court-justice-constantly-ruling-without-written-opinions\/\" rel=\"nofollow noopener\" target=\"_blank\">scolded the public to \u201cread the opinion.\u201d<\/a> Speaking at the Ronald Reagan library, she tut-tutted those who would accuse the Supreme Court of imposing its naked policy preferences that reading the Court\u2019s considered opinions would illuminate their deep and abiding commitment to the neutral application of the rule of law. Today, her stance on citizens who want to understand the Supreme Court\u2019s reasoning is: <\/p>\n<figure class=\"wp-block-image aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/cdn.bsky.app\/img\/feed_thumbnail\/plain\/did:plc:tw2e2xumdrrz7hvkpdouunov\/bafkreic3fi25hh7gr6jj4qpbdxxirqc7az7tmah6ccg47u5xj6bmulefda\" alt=\"Top Gun: I could tell you but then I&#039;d have to kill you.\" title=\"\"><figcaption><\/figcaption><\/figure>\n<p class=\"wp-block-paragraph\">Golly, it\u2019s almost like she was spouting disingenuous bullshit the whole time!<\/p>\n<p class=\"wp-block-paragraph\">For the uninitiated, the shadow docket is the informal name of the Supreme Court\u2019s practice of issuing increasingly expansive orders without argument or written explanation. It\u2019s a tactic that we\u2019ve recently learned grew out of the Chief\u2019s desire to <a href=\"https:\/\/abovethelaw.com\/2026\/04\/the-shadow-docket-memos-are-damning-so-naturally-the-right-is-talking-about-the-leak\/\" rel=\"nofollow noopener\" target=\"_blank\">gut Obama-era environmental regulations despite lacking a legal justification<\/a>, and has since metastasized into what <a href=\"https:\/\/abovethelaw.com\/2025\/08\/supreme-court-just-calvinball-jurisprudence-with-a-twist-writes-justice-jackson\/\" rel=\"nofollow noopener\" target=\"_blank\">Justice Jackson described as Calvinball<\/a> \u2014 the fictional game from comic strip <em>Calvin &amp; Hobbes<\/em> where the rules constantly change.<\/p>\n<p class=\"wp-block-paragraph\">When Barrett tried to gaslight the country with her \u201cread the opinion\u201d speech, she added \u201c[d]oes [the decision] read like\u00a0something that was purely results driven and designed to impose\u00a0the policy preferences of the majority, or does this read like it actually is an honest effort and persuasive effort, even if one you ultimately don\u2019t agree with, to determine what the Constitution and precedent requires?\u201d fully aware that the Court was already heavily leaning on unexplained shadow docket orders on issues ranging from abortion to vaccinations to voting rights.<\/p>\n<p class=\"wp-block-paragraph\">Four years and scores of unsigned emergency orders later, the work is gone and the pitch is <em>how dare you question us?<\/em><\/p>\n<p class=\"wp-block-paragraph\">In fairness to Justice Barrett, there is a reason why the Court historically did little to explain its shadow docket orders. When the use of the shadow docket more accurately fit the title \u201cemergency docket,\u201d these decisions amounted to glorified preliminary injunctions. Write too much about a case that nobody briefed, with a record nobody built, and the Court could accidentally send a premature and improper signal about its sense of the merits. As one justice recently wrote about the practice, it\u2019s designed to strike a balance between \u201cthe lock-in risk of saying too much against the transparency cost of saying too little.\u201d<\/p>\n<p class=\"wp-block-paragraph\">That was Justice Barrett incidentally.<\/p>\n<p class=\"wp-block-paragraph\">But that argument doesn\u2019t withstand contact with reality. Avoiding a lock-in risk only matters if everyone agrees that these orders aren\u2019t binding beyond the parties in the case and exist solely to maintain the status quo. Justice Gorsuch went out of his way to disabuse us of that notion. In a separate opinion, Gorsuch growled that judges \u201cmay sometimes disagree with this Court\u2019s decisions, but they are never free to defy them,\u201d referring to lower court judges continuing to follow existing caselaw rather than vibe check new precedent from between the lines of one-sentence shadow docket orders. In response to this aggressive expansion of shadow docket authority, Judge William Young apologized \u2014 though \u201cpassive aggressively quipped\u201d is probably more accurate \u2014 on the record that he \u201csimply did not understand that orders on the emergency docket were precedent.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Which, of course, no one did because they never were before.<\/p>\n<p class=\"wp-block-paragraph\">The cases that Barrett\u2019s Republican majority chose to decide under the cloak of the shadow docket further undermine this <em>it\u2019s just an interim order<\/em> canard. Rather than seek to maintain the status quo, the majority aggressively used shadow orders to bless Trump administration actions upending years \u2014 indeed, <em>decades<\/em> \u2014 of existing precedent. As the Court repeatedly ruled this Term, the harm of the Trump administration not getting to do whatever it wants, whenever it wants is an irreparable harm even if it\u2019s taking unprecedented action.<\/p>\n<p class=\"wp-block-paragraph\">The majority\u2019s shadow docket strategy is designed, to borrow from Barrett\u2019s past remarks, to be \u201cpurely results driven and designed to impose\u00a0the policy preferences of the majority\u201d without having to put in \u201can honest effort and persuasive effort.\u201d Part of it is a cynical ploy to give the Trump administration freedom of action while preserving actual precedent so they can <a href=\"https:\/\/abovethelaw.com\/2025\/09\/supreme-courts-shadow-docket-scam-collides-with-reality\/\" rel=\"nofollow noopener\" target=\"_blank\">turn around and tell a future Democratic administration that these were mere interim orders<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">But more fundamentally, the conservative justices are sick and tired of accountability. They threw a collective fit when their refusal to explain themselves <a href=\"https:\/\/abovethelaw.com\/2025\/06\/sotomayor-outlawyers-supreme-court-majority-in-shadow-docket-deportation-ruling\/\" rel=\"nofollow noopener\" target=\"_blank\">accidentally left a loophole that the dissent jumped on<\/a>. Sam Alito broke decorum <a href=\"https:\/\/abovethelaw.com\/2026\/06\/sam-alito-takes-unusual-step-of-whining-from-the-bench-after-getting-called-out-for-lazy-hackery\/\" rel=\"nofollow noopener\" target=\"_blank\">to complain from the bench<\/a> when Justice Sotomayor dismantled his opinion a couple weeks ago. And Justice Barrett <a href=\"https:\/\/abovethelaw.com\/2025\/09\/amy-coney-barrett-forced-to-discuss-destroying-constitutional-precedent-during-family-trip\/\" rel=\"nofollow noopener\" target=\"_blank\">bemoaned in her memoir<\/a> that she had to spend her vacation defending the <em>Dobbs<\/em> decision to her brother-in-law. Defending your political priorities in the face of overwhelming legal precedent is hard. They don\u2019t like it. <\/p>\n<p class=\"wp-block-paragraph\">With apologies to <em>Love Story<\/em>: life tenure means never having to say your reasoning.<\/p>\n<p class=\"wp-block-paragraph\">But, as Aronson notes, \u201cthe reasoning is the whole point.\u201d Judge Michael Luttig \u2014 a conservative\u2019s conservative if there ever was one \u2014 <a href=\"https:\/\/abovethelaw.com\/2025\/10\/district-judges-fight-to-save-the-rule-of-law-while-doj-and-supreme-court-snicker\/\" rel=\"nofollow noopener\" target=\"_blank\">made the exact same point<\/a> at the Society for the Rule of Law conference:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The Supreme Court has no power at all in our system and government, except that power that comes to it by virtue of [its] reasoned opinions of constitutional law. Whenever the Supreme Court is acting without opinions of law \u2014 at all \u2014 let alone, reasoned opinions of law. It is acting illegitimately, period. It doesn\u2019t have the power of the purse. It doesn\u2019t have the power of the sword. The only power it has, and the only power that it has to wield on behalf of the American people is the power of its persuasion.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">Judge Nancy Gertner put it even more bluntly, explaining that the shadow docket has \u201c<a href=\"https:\/\/contrarian.substack.com\/p\/no-apology-necessary\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">all the formality of notes on a napkin<\/a>.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Which brings us all the way back around to the security funds that Kagan and Barrett came to Congress for in the first place. The Supreme Court\u2019s steadfast refusal to explain its decisions while summarily overturning lower court judges ruling against the Trump administration inspired 12 judges to place blame squarely on the Supreme Court for its role in\u00a0<a href=\"https:\/\/abovethelaw.com\/2025\/09\/in-a-bold-move-federal-judges-are-calling-out-the-supreme-courts-bullsht\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">driving violent threats against the judiciary<\/a>.\u00a0Every time the Supreme Court knocks down crystal clear precedent without deigning to explain themselves, they leave a lower court judge looking like they were just \u201cout to get Trump.\u201d And while violence is hardly the province of one end of the political spectrum, the dudes who stormed the Capitol looking to hang Mike Pence are more likely to escalate their threats than a soccer mom with a peace sign on her SUV.<\/p>\n<p class=\"wp-block-paragraph\">The threats facing judges are real. Justice Barrett and her fellow travelers have made it worse because they care more about imposing\u00a0the policy preferences of their majority. But maybe they\u2019ll get a few extra bucks for more federal marshals. It\u2019s a tactic that we\u2019ve recently learned grew out of the Chief\u2019s desire to <a href=\"https:\/\/abovethelaw.com\/2026\/04\/the-shadow-docket-memos-are-damning-so-naturally-the-right-is-talking-about-the-leak\/\" rel=\"nofollow noopener\" target=\"_blank\">gut Obama-era environmental regulations despite lacking a legal justification<\/a>, and has since metastasized into what <a href=\"https:\/\/abovethelaw.com\/2025\/08\/supreme-court-just-calvinball-jurisprudence-with-a-twist-writes-justice-jackson\/\" rel=\"nofollow noopener\" target=\"_blank\">Justice Jackson described as Calvinball<\/a> \u2014 the fictional game from comic strip <em>Calvin &amp; Hobbes<\/em> where the rules constantly change.<\/p>\n<p class=\"wp-block-paragraph\">When Barrett tried to gaslight the country with her \u201cread the opinion\u201d speech, she added \u201c[d]oes [the decision] read like\u00a0something that was purely results driven and designed to impose\u00a0the policy preferences of the majority, or does this read like it actually is an honest effort and persuasive effort, even if one you ultimately don\u2019t agree with, to determine what the Constitution and precedent requires?\u201d fully aware that the Court was already heavily leaning on unexplained shadow docket orders on issues ranging from abortion to vaccinations to voting rights.<\/p>\n<p class=\"wp-block-paragraph\">Four years and scores of unsigned emergency orders later, the work is gone and the pitch is <em>how dare you question us?<\/em><\/p>\n<p class=\"wp-block-paragraph\">In fairness to Justice Barrett, there is a reason why the Court historically did little to explain its shadow docket orders. When the use of the shadow docket more accurately fit the title \u201cemergency docket,\u201d these decisions amounted to glorified preliminary injunctions. Write too much about a case that nobody briefed, with a record nobody built, and the Court could accidentally send a premature and improper signal about its sense of the merits. As one justice recently wrote about the practice, it\u2019s designed to strike a balance between \u201cthe lock-in risk of saying too much against the transparency cost of saying too little.\u201d<\/p>\n<p class=\"wp-block-paragraph\">That was Justice Barrett incidentally.<\/p>\n<p class=\"wp-block-paragraph\">But that argument doesn\u2019t withstand contact with reality. Avoiding a lock-in risk only matters if everyone agrees that these orders aren\u2019t binding beyond the parties in the case and exist solely to maintain the status quo. Justice Gorsuch went out of his way to disabuse us of that notion. In a separate opinion, Gorsuch growled that judges \u201cmay sometimes disagree with this Court\u2019s decisions, but they are never free to defy them,\u201d referring to lower court judges continuing to follow existing caselaw rather than vibe check new precedent from between the lines of one-sentence shadow docket orders. In response to this aggressive expansion of shadow docket authority, Judge William Young apologized \u2014 though \u201cpassive aggressively quipped\u201d is probably more accurate \u2014 on the record that he \u201csimply did not understand that orders on the emergency docket were precedent.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Which, of course, no one did because they never were before.<\/p>\n<p class=\"wp-block-paragraph\">The cases that Barrett\u2019s Republican majority chose to decide under the cloak of the shadow docket further undermine this <em>it\u2019s just an interim order<\/em> canard. Rather than seek to maintain the status quo, the majority aggressively used shadow orders to bless Trump administration actions upending years \u2014 indeed, <em>decades<\/em> \u2014 of existing precedent. As the Court repeatedly ruled this Term, the harm of the Trump administration not getting to do whatever it wants, whenever it wants is an irreparable harm even if it\u2019s taking unprecedented action.<\/p>\n<p class=\"wp-block-paragraph\">The majority\u2019s shadow docket strategy is designed, to borrow from Barrett\u2019s past remarks, to be \u201cpurely results driven and designed to impose\u00a0the policy preferences of the majority\u201d without having to put in \u201can honest effort and persuasive effort.\u201d Part of it is a cynical ploy to give the Trump administration freedom of action while preserving actual precedent so they can <a href=\"https:\/\/abovethelaw.com\/2025\/09\/supreme-courts-shadow-docket-scam-collides-with-reality\/\" rel=\"nofollow noopener\" target=\"_blank\">turn around and tell a future Democratic administration that these were mere interim orders<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">But more fundamentally, the conservative justices are sick and tired of accountability. They threw a collective fit when their refusal to explain themselves <a href=\"https:\/\/abovethelaw.com\/2025\/06\/sotomayor-outlawyers-supreme-court-majority-in-shadow-docket-deportation-ruling\/\" rel=\"nofollow noopener\" target=\"_blank\">accidentally left a loophole that the dissent jumped on<\/a>. Sam Alito broke decorum <a href=\"https:\/\/abovethelaw.com\/2026\/06\/sam-alito-takes-unusual-step-of-whining-from-the-bench-after-getting-called-out-for-lazy-hackery\/\" rel=\"nofollow noopener\" target=\"_blank\">to complain from the bench<\/a> when Justice Sotomayor dismantled his opinion a couple weeks ago. And Justice Barrett <a href=\"https:\/\/abovethelaw.com\/2025\/09\/amy-coney-barrett-forced-to-discuss-destroying-constitutional-precedent-during-family-trip\/\" rel=\"nofollow noopener\" target=\"_blank\">bemoaned in her memoir<\/a> that she had to spend her vacation defending the <em>Dobbs<\/em> decision to her brother-in-law. Defending your political priorities in the face of overwhelming legal precedent is hard. They don\u2019t like it. <\/p>\n<p class=\"wp-block-paragraph\">With apologies to <em>Love Story<\/em>: life tenure means never having to say your reasoning.<\/p>\n<p class=\"wp-block-paragraph\">But, as Aronson notes, \u201cthe reasoning is the whole point.\u201d Judge Michael Luttig \u2014 a conservative\u2019s conservative if there ever was one \u2014 <a href=\"https:\/\/abovethelaw.com\/2025\/10\/district-judges-fight-to-save-the-rule-of-law-while-doj-and-supreme-court-snicker\/\" rel=\"nofollow noopener\" target=\"_blank\">made the exact same point<\/a> at the Society for the Rule of Law conference:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The Supreme Court has no power at all in our system and government, except that power that comes to it by virtue of [its] reasoned opinions of constitutional law. Whenever the Supreme Court is acting without opinions of law \u2014 at all \u2014 let alone, reasoned opinions of law. It is acting illegitimately, period. It doesn\u2019t have the power of the purse. It doesn\u2019t have the power of the sword. The only power it has, and the only power that it has to wield on behalf of the American people is the power of its persuasion.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">Judge Nancy Gertner put it even more bluntly, explaining that the shadow docket has \u201c<a href=\"https:\/\/contrarian.substack.com\/p\/no-apology-necessary\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">all the formality of notes on a napkin<\/a>.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Which brings us all the way back around to the security funds that Kagan and Barrett came to Congress for in the first place. The Supreme Court\u2019s steadfast refusal to explain its decisions while summarily overturning lower court judges ruling against the Trump administration inspired 12 judges to place blame squarely on the Supreme Court for its role in\u00a0<a href=\"https:\/\/abovethelaw.com\/2025\/09\/in-a-bold-move-federal-judges-are-calling-out-the-supreme-courts-bullsht\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">driving violent threats against the judiciary<\/a>.\u00a0Every time the Supreme Court knocks down crystal clear precedent without deigning to explain themselves, they leave a lower court judge looking like they were just \u201cout to get Trump.\u201d And while violence is hardly the province of one end of the political spectrum, the dudes who stormed the Capitol looking to hang Mike Pence are more likely to escalate their threats than a soccer mom with a peace sign on her SUV.<\/p>\n<p class=\"wp-block-paragraph\">The threats facing judges are real. Justice Barrett and her fellow travelers have made it worse because they care more about imposing\u00a0the policy preferences of their majority. But maybe they\u2019ll get a few extra bucks for more federal marshals.
