You\u2019d think that legal ethics news would slow down a bit during the summer, but no. It was a busy week, so you get 15 headlines instead of your usual ten. It\u2019s notable to me that two involve lawyers protesting, both in the US and abroad. Highlights from Last Week \u2013 Top\u00a015 Headlines \ud83d\udcf0<\/h3>\n

#1 \u201cMore Than 70 Legal Ethics Experts Warn DOJ Is Trying to Put Its Lawyers Above the Law.\u201d\u00a0<\/strong>From\u00a0Democracy Defenders Fund:\u00a0<\/strong>\u201cMore than 70 legal ethics scholars and experts filed an amicus brief urging the U.S. District Court for the District of Columbia to reject the DOJ\u2019s attempt to stop disciplinary proceedings against former Department official\u00a0Jeffrey Clark<\/strong>. #2 \u201cJudicial Ethics Proposals on Financial Conflicts, FOIA Revived.\u201d\u00a0<\/strong>From\u00a0Bloomberg Law:\u00a0<\/strong>\u201cA Democratic senator is proposing a trio of bills that would crack down on conflicts of interest and allow public records requests into the federal judiciary, as part of a push to increase transparency in the federal courts.\u00a0Sen. Adam Schiff<\/strong>\u00a0(D-Calif.), a Judiciary Committee member, will reintroduce the measures on Monday as a package, according to his office. Two of the bills aim to prevent Supreme Court justices and lower court judges from handling litigation in which they have a financial interest. The measures would\u00a0expand<\/a><\/strong>\u00a0conflicts of interest rules that apply to the executive branch to the judiciary and\u00a0require<\/a><\/strong>\u00a0justices and judges to put certain financial assets in a blind trust. #3 \u201c6-Month Suspension for Toronto Lawyer Who Cited Fake ChatGPT Cases, Blamed Law Student, Faced Contempt of Court Hearing, Went Back to ChatGPT For Advice.\u201d\u00a0<\/strong>From the\u00a0Toronto Star:\u00a0<\/strong>\u201cA Toronto lawyer who cited fake cases generated by AI in a civil court matter \u2013 and then lied by trying to blame her law student \u2013 has been suspended from practising for six months. As jointly requested by the parties, the Law Society Tribunal suspended\u00a0Mary Hyun-Sook (Jisuh) Lee<\/strong>\u00a0on Thursday and ordered that she pay $10,000 in costs, in what may be the first decision by a\u00a0legal\u00a0regulator punishing a lawyer for misusing AI in court. \u2026 Lee is not the first lawyer caught misusing AI in court, but the Law Society Tribunal\u2019s decision appears to be the first publicized ruling from a\u00a0legal\u00a0regulator handing out punishment for that misconduct, said\u00a0Amy Salyzyn<\/strong>, a University of Ottawa law professor who specializes in\u00a0legal\u00a0ethics. \u2018The sanctions in this case, which are significant, send an important message to the\u00a0legal\u00a0profession that the misuse of AI that results in fake or misleading\u00a0legal\u00a0authorities being included in court submissions is a serious violation of their professional responsibilities,\u2019 Salyzyn said.\u201d Read more\u00a0here<\/a><\/strong>.<\/a><\/p>\n

#7 \u201cNew Jersey Bars Lawyers From Having Sex With Clients.\u201d\u00a0<\/strong>From the\u00a0New Jersey Globe:\u00a0<\/strong>\u201cNew Jersey lawyers will be prohibited from beginning sexual relationships with clients under a new ethics rule adopted by the state Supreme Court. The amendment to the Rules of Professional Conduct, announced Thursday, takes effect September 1 and creates a clear conflict-of-interest rule covering attorneys who become sexually involved with people they represent. \u2026 New Jersey had been one of only ten states without an explicit rule prohibiting lawyers from having sexual relations with clients, according to the Supreme Court\u2019s Professional Responsibility Rules Committee.\u201d Read more\u00a0here<\/a><\/strong>.<\/p>\n

The thrill comes from seeing a path to a desperately needed reform laid out before you with such clarity and rigor, with the most serious objections addressed head-on and refuted. This is how change happens, friends! Much of the last several decades of American politics have felt like an exercise in futility, as long-simmering problems only get worse and we are told there\u2019s no way to fix them.
