No Hocus, Just Focus: Tame the Notification Gremlins

Like pesky, after-hours trick-or-treaters, constant pop-up distractions and notification alerts shatter focus. They increase the risk of making data entry errors, missing calendar deadlines, overwriting master documents, or firing off careless messages to the wrong clients in a rush (see Tip 2).

The Fix: Tweak Your Settings to Eliminate Pop-Ups and Clutter

Set aside a few minutes to take control of your operating system and application notification settings. Turn off non-essential desktop banners and audio pings so you can focus on drafting and reviewing those high-stakes documents without bouncing back to your inbox or messaging app. If you are a multi-tasking-prone Chrome user with a “too many open tabs” habit, try switching to Chrome’s new vertical browser tabs, and set up tab groups for different tasks and activities.

Bonus tip: To prevent overwriting a critical template or accidentally deleting an active brief, use a cloud-based document management system (DMS) with automated version tracking. Never rely on a single, locally saved file that lacks automated backups or revision logs. As Turk and Colletti explain, a cloud-based system centralizes your firm’s documents in a secure, searchable, versioned repository. Unlike a shared network drive, a proper DMS provides access controls, audit trails, version history, and remote access from any device. This means your documents are backed up automatically and protected by enterprise-grade security.

When drafting new master documents in Word, be sure to save your master as a Word Template (.dotx) instead of a standard Word document (.docx). This way, when a user double-clicks a .dotx file, Word will automatically open a new, unsaved copy (named “Document 1”). It is impossible to save over the master without explicitly choosing to overwrite it. You can also restrict editing to protect documents, or set the file to “read-only” at the system level.

2. Banish All Email Horror Stories

Hitting “send” too early, replying to “all” by mistake, or attaching confidential case files to the wrong email can trigger a highly embarrassing situation among peers and colleagues — and a disastrous confidentiality breach.

The Fix: Use Email Buffers and Scheduled Delivery to Prevent Accidental Sends

Turk and Colletti recommend using an outgoing mail buffer in your email client, or scheduling emails instead of hitting send immediately. A 1-to-2-minute hold on outgoing messages gives you a safety net to catch missing attachments, typos, or the wrong recipients.

Outlook’s Delay Delivery option lets you write an email now and schedule it to send at a future date or time — or delay by minutes. This comes in handy when you want to send emails around a particular event — or when you’d rather your email arrive first thing in the morning and not at 2 a.m. when you finished writing it. Simply compose your email, then click on Options and Delay Delivery. Set the date and time under “Do not deliver before.”

You can also schedule and undo emails in Gmail.

Note that in classic desktop Outlook, you can still use the delayed send rule to apply the two-minute rule globally to all emails.

3. Breached! Practice Impeccable Password and Credential Hygiene

We’ve been preaching password paranoia since the original “Halloween” movie (and a young Jamie Lee Curtis) achieved cult status, but let’s repeat: The weak passwords you’ve been using since the “Shaun of the Dead” will not protect you from the armies of undead cybercriminals and AI bots that want to steal your client data, confidential case files and financial credentials. If they get it because you choose to stick with Password123!? It’s not just your client data and funds at risk; it’s your professional standing. “Technical competency” is a big deal to the bar.

The Fix: Upgrade to Password Managers, MFA, and Phishing Awareness

Colletti and Turk say switching to an enterprise-grade password manager such as 1Password, OnePassword, Bitwarden, or LastPass is table stakes. So is using multi-factor authentication (MFA). They want you to use it everywhere: email, practice management system, cloud document storage, bank and financial accounts, domain registrar, and social media and marketing accounts.

Since phishing emails remain one of the biggest cyber risks, firms should also be training lawyers and staff to recognize red flags like mismatched sender addresses, suspicious links, and requests for payments, wire transfers or credentials. (KnowBe4 and Proofpoint will send simulated phishing emails to staff and track who clicks.)

Read “Cybersecurity for Law Firms That Don’t Want to Be in the Headlines” for tips from Sharon Nelson and Mike Mashke.

4. Exorcise the Undead: The “Zombie Client Matter”

Ah, the closed or dormant case that never officially dies because the lawyer forgot to send a formal disengagement or closing letter. These “zombie matters” wander the legal landscape indefinitely, blurring the statute of limitations for malpractice liability and haunting your active file lists.

The Fix: Automate Closing Letters and Disengagement Workflows

Treat every concluded representation with absolute finality. Turk suggests using your case management platform’s automated workflows or task templates to trigger a definitive closing letter the moment a matter wraps up, putting a hard stop on the relationship and burying potential liability for good.

Read “A Letter of Closure For All the Right Reasons” for guidance on what the client letter should include.

5. Ghosted! Faulty Wire Transfers, Chargebacks and ACH Nightmares

The horror of watching money you’ve earned vanish from your account is, unfortunately, more common for small firms — especially when the economy is in the ditch. Here are three nightmare scenarios and ways to handle them.

First, the credit card chargeback. When a client disputes a credit card charge, the payment network usually initiates a chargeback—freezing funds in your account while they investigate. Beware that a poorly handled dispute or lack of upfront documentation can mean lost revenue and a black mark on your credit card.

The Fix: Protect Firm Funds With Strict Authorization and Fast Action Rules

Always maintain an airtight paper trail by securing a signed engagement letter, clear fee agreement, and detailed billing statements upfront. If a chargeback hits, send a clear rebuttal with documentation and act immediately. You typically have a strict window of 7 to 30 days to respond, and missing the deadline means an automatic loss. Keep in mind that legal industry payment processors, like LawPay, understand trust accounting and provide dispute support tailored to attorneys.

Second, wire transfer fraud. This has long been a risk in real estate transactions, but it is escalating in other practices as well. If a wire is sent to the wrong account, you have a short window — a few hours — to act before the funds are gone. But even then, says Turk, chances of recovery are slim.

Turk’s steps: Act fast and call your bank to initiate a wire recall (ask to file a SWIFT gpi trace if it’s international), then file an FBI complaint at ic2.gov. Notify your insurance carriers (malpractice and cyber insurance). “Document everything,” she says. “Every call, every time stamp.”

Finally, ACH disputes arise when a client claims a bank transfer was unauthorized or in error. Did you know consumers have up to 60 days to dispute a personal bank account transaction? And if your client disputes within that time, the funds revert to the client while the bank figures it out. Your best defense, says Turk, is to get signed authorization when clients sign their retainer agreement, and use an ACH authorization form that explicitly documents the consent, the amount, and the account information. Also: Act fast!

Happy Halloween!

This Halloween weekend, we hope you’re happily managing tiny ghouls and ghosts and fun-sized candy consumption — and not scary clients or tech gremlins. November, however, is the ideal time to begin confronting any practice management hobgoblins that put your firm at risk.

The complete 60-tip presentation is packed with practical tips and is available to Smokeball Spark attendees on the resources page here.

Featured Image Licenses Under the Unsplash License.

The most terrifying threats facing your law firm aren’t paranormal—they’re self-inflicted operational misfires: missed deadlines, data breaches, and accidental email sends.
