Kicking back in a luxury ranch owned by a wealthy businessman to hang out with more rich people \u2014 \u201c<a href=\"https:\/\/www.vox.com\/2016\/2\/25\/11116742\/scalia-st-hubertus\" target=\"_blank\" rel=\"noopener nofollow\">a group of friends sympathetic to the justice\u2019s views<\/a>,\u201d as his host put it.<\/p>\n<blockquote>\n<p>Justice Scalia regularly accepted luxury travel and lodging from wealthy benefactors and failed to report the gifts on his financial disclosures, in contravention of federal law. From his confirmation in 1986 until his death in 2016, Justice Scalia took at least 258 subsidized trips, more than any other justice. Despite all of these trips being funded by private donors, many were only partially disclosed, while several dozen others appear to have never been disclosed. For instance, Justice Scalia would often disclose trips to give speeches, but fail to disclose hunting trips. Justice Scalia tragically passed away during one of these undisclosed hunting trips.<\/p>\n<\/blockquote>\n<p>All for a hunting excursion run by the Order of St. Hubertus, a hunting club of Eyes Wide Shut extras knighted by the King of Spain \u2014 though it seems Scalia at least had the good constitutional sense not to be knighted himself, <a href=\"https:\/\/abovethelaw.com\/2024\/10\/sam-alito-got-knighted-just-like-the-founding-fathers-explicitly-made-unconstitutional\/\" target=\"_blank\" rel=\"noopener nofollow\">unlike some justices we could mention<\/a>.<\/p>\n<p>As an aside, several FedSoc keyboard warriors tried to downplay Alito\u2019s decision to get knighted \u2014 despite Article I, Section 9 of the Constitution \u2014 by arguing that Alito\u2019s specific knighthood is \u201cjust an honorary title.\u201d <em>That\u2019s what knighthoods are! <\/em>He\u2019s not marching against the Starks under his personal sigil (<a href=\"https:\/\/abovethelaw.com\/2024\/05\/washington-post-alito-flag\/\" target=\"_blank\" rel=\"noopener nofollow\">upside-down flag, naturally<\/a>). The Brits don\u2019t actually expect Elton John to lead an expeditionary force against the French crown. Knighthoods haven\u2019t been more than an honorary title for centuries.<\/p>\n<p>In the Senate report \u2014 which dropped over the weekend before Christmas in a timing decision that could not better encapsulate Dick Durbin\u2019s tenure in charge of that body \u2014 the Judiciary Committee concluded that the Supreme Court needs an enforceable ethics code <a href=\"https:\/\/abovethelaw.com\/2023\/04\/roberts-senate-budget-cuts\/\" target=\"_blank\" rel=\"noopener nofollow\">which the Court would refuse to acknowledge<\/a> and the incoming Congress lacks any interest in pursuing. And while the Republican appointees star in the most egregious examples, the report doesn\u2019t ignore the publishing and teaching issues that justices across the spectrum have had.<\/p>\n<p>This instant investigation grew out of <a href=\"https:\/\/www.propublica.org\/article\/clarence-thomas-scotus-undisclosed-luxury-travel-gifts-crow\" target=\"_blank\" rel=\"noopener nofollow\">ProPublica\u2019s rockstar work<\/a> identifying half a million in gifts that Clarence Thomas took from billionaire Harlan Crow and <a href=\"https:\/\/www.propublica.org\/article\/samuel-alito-luxury-fishing-trip-paul-singer-scotus-supreme-court\" target=\"_blank\" rel=\"noopener nofollow\">Sam Alito\u2019s private jet trip as a guest of a man with business before the Court<\/a>. Alito attempted to <a href=\"https:\/\/www.wsj.com\/articles\/propublica-misleads-its-readers-alito-gifts-disclosure-alaska-singer-23b51eda\" target=\"_blank\" rel=\"noopener nofollow\">preemptively downplay<\/a> this report and <a href=\"https:\/\/abovethelaw.com\/2023\/06\/sam-alito-pro-publica-wall-street-journal-ethics\/\" target=\"_blank\" rel=\"noopener nofollow\">claim he barely knew<\/a> his benefactor \u2014 a claim that ran smack dab into <a href=\"https:\/\/abovethelaw.com\/2009\/11\/the-federalist-society-annual-dinner-lions-and-tigers-and-bears-oh-my\/\" target=\"_blank\" rel=\"noopener nofollow\">Above the Law\u2019s own reporting from 2009<\/a>. As the Senate dug deeper, they found Thomas <a href=\"https:\/\/abovethelaw.com\/2024\/08\/clarence-thomas-more-undisclosed-vacations\/\" target=\"_blank\" rel=\"noopener nofollow\">took even more undisclosed vacations<\/a> and had an <a href=\"https:\/\/abovethelaw.com\/2023\/08\/clarence-thomas-rv-supreme-court-ethics-scandal\/\" target=\"_blank\" rel=\"noopener nofollow\">RV purchased with help (in whole or in part) from a health care executive<\/a>.<\/p>\n<p>But for all the work Thomas and Alito have done to abuse the public trust and spit on the institution, they still have to take a back seat to the OG. Thomas may have collected more in gifts and <a href=\"https:\/\/abovethelaw.com\/2023\/05\/that-perfectly-innocent-way-one-funnels-money-to-the-spouse-of-a-supreme-court-justice-while-trying-to-avoid-a-paper-trail\/\" target=\"_blank\" rel=\"noopener nofollow\">have a wife taking money under the table<\/a> and Alito might be streets ahead of anything Scalia did when he\u2019s engaging in coup curious vexillology, but Scalia deserves top honors for developing the strategy to brazenly invoking the \u201cpersonal hospitality\u201d exception \u2014 designed to prevent judges from having to disclose flopping on their college roommate\u2019s couch \u2014 as a catch-all for \u201chundreds of subsidized trips, including several dozen hunting and fishing trips with prominent Republican donors and politicians\u201d in a bid to prevent the public from learning what goes on up there.<\/p>\n<blockquote>\n<p>FINDING 3: Justice Scalia misused the \u201cpersonal hospitality\u201d exemption to the Ethics in Government Act to hide or obscure lavish gifts. The Ethics in Government Act requires federal officials, including Supreme Court justices, to file financial disclosure reports. The law includes certain exemptions for what must be included in these reports, including a limited exemption for personal hospitality that applies only to food, lodging, or entertainment received from an individual. Justice Scalia regularly misused the personal hospitality exemption to improperly characterize travel-related gifts as reimbursements and failed to disclose transportation and trips in part or in whole.<\/p>\n<\/blockquote>\n<p>Aside from stretching the \u201cpersonal hospitality\u201d exception beyond all reasonable limits \u2014 and certainly beyond whatever \u201coriginal public meaning\u201d those words might bear \u2014 the idea that a justice is just \u201changin\u2019 with the boys\u201d when he jumps on a private jet to stay at a resort with a billionaire is deeply problematic. It\u2019s one thing, to use the above hypothetical, if their college roommate turned out to be a multimillionaire running a hedge fund cross-wise with the SEC, but these benefactors have zilch connection with the justices beyond their jobs.<\/p>\n<p>These mega rich \u201cbuddies\u201d wouldn\u2019t give Thomas or Alito the time of day if they were traffic court judges. They only have these friends offering \u201cpersonal hospitality\u201d by dint of the office and the prospect that the <a href=\"https:\/\/abovethelaw.com\/2023\/12\/clarence-thomas-thinks-he-was-practically-forced-to-take-all-that-under-the-table-money\/\" target=\"_blank\" rel=\"noopener nofollow\">ideological justices might leave if they aren\u2019t treated right<\/a>. Which, when you think about it, is really sad.
