{"id":99243,"date":"2025-01-06T02:00:00","date_gmt":"2025-01-06T10:00:00","guid":{"rendered":"https:\/\/xira.com\/p\/2025\/01\/06\/it-is-what-it-is-can-you-plead-that-in-court\/"},"modified":"2025-01-06T02:00:00","modified_gmt":"2025-01-06T10:00:00","slug":"it-is-what-it-is-can-you-plead-that-in-court","status":"publish","type":"post","link":"https:\/\/xira.com\/p\/2025\/01\/06\/it-is-what-it-is-can-you-plead-that-in-court\/","title":{"rendered":"It Is What It Is \u2014 Can You Plead That in Court?"},"content":{"rendered":"<p>Teddy Snyder | You have a lot of ways to tell the story of your case, but are you doing it in the most effective way?<br \/>\nThe post It Is What It Is \u2014 Can You Plead That in Court? appeared first on Articles, Tips and Tech for Law Firms and Lawyers.<\/p>\n<p><strong><em>Can you plead that? \u201cIt is what it is\u201d (or \u201cHoc illud est quod est\u201d because when in court, it helps to make this argument in Latin) doesn\u2019t seem like much of a legal argument.<\/em><\/strong><\/p>\n<figure class=\"wp-block-image size-full\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"770\" height=\"495\" src=\"https:\/\/i0.wp.com\/www.attorneyatwork.com\/wp-content\/uploads\/2024\/12\/can-you-say-that.jpg?resize=770%2C495&#038;ssl=1\" alt=\"can you plead that\" class=\"wp-image-100038417\" title=\"\"><figcaption><\/figcaption><\/figure>\n<h2 class=\"wp-block-heading\" id=\"h-seems-like-you-can-if-you-say-it-in-latin\">Seems Like You Can If You Say It in Latin<\/h2>\n<p>\u201cIt is what it is.\u201d What does this ubiquitous phrase mean?<\/p>\n<p>Famed author <a href=\"https:\/\/en.wikipedia.org\/wiki\/William_Safire\" rel=\"nofollow noopener\" target=\"_blank\">William Safire<\/a> <a href=\"https:\/\/en.wikipedia.org\/wiki\/William_Safire\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">wrote about the phrase in <\/a>The New York Times Magazine edition of March 5, 2006. His research showed it first appeared in a 1949 article by Nebraska State Historical Society President J.E. Lawrence in The Nebraska State Journal. Lawrence wrote:<\/p>\n<p class=\"has-background\"><strong>\u201cNew land is harsh, and vigorous, and sturdy. It scorns evidence of weakness. There is nothing of sham or hypocrisy in it. It is what it is, without apology.\u201d <\/strong><\/p>\n<p>Notwithstanding this linguistic pedigree, Safire writes that the phrase is a \u201cdeliberate tautology,\u201d \u201cdesigned to define itself by repetition of itself [and] \u2026 used to deflect inquiry with panache.\u201d<\/p>\n<p>According to <a href=\"https:\/\/twominenglish.com\/it-is-what-it-is\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">TwoMinEnglish<\/a>, the sentence means \u201cthat a situation exists in its present form and cannot be changed, so it must be accepted as it is.\u201d Despite its pervasive use, this string of words is widely <a href=\"https:\/\/www.grammarphobia.com\/blog\/2008\/01\/it-is-what-it-is-or-is-it.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">criticized as meaningless<\/a>.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-the-judge-said-what\">The Judge Said What?<\/h2>\n<p>\u201cIt is what it is\u201d doesn\u2019t seem to be much of a legal argument. But that may have changed with the <a href=\"https:\/\/cases.justia.com\/delaware\/superior-court\/2024-k22c-03-022-rlg.pdf?ts=1717527769\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Delaware Superior Court opinion<\/a> in Noble Eagle Sales, LLC dba Shooter\u2019s Choice v. Mesa Underwriters Specialty Insurance Company et al.\u00a0<\/p>\n<p>The underlying case arose from the rental of a gun from a shooting range. The renter used that gun to commit suicide. The family sued the shooting range, which called upon its general liability insurer for a defense and coverage. Mesa denied coverage on the grounds that the policy excluded the rental of sporting equipment. Both sides filed motions for summary judgment. The pivotal issue was whether a gun rented from a shooting range is sporting equipment.<\/p>\n<p>The court\u2019s interpretation of the insurance contract is multifaceted and relies heavily on dictionary definitions. According to Merriam-Webster, \u201canything used in a sport can be sporting equipment depending on the context,\u201d says the opinion.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-the-conclusion-in-latin\">The Conclusion, in Latin<\/h2>\n<p>The court found, therefore, that the term \u201csporting equipment\u201d is ambiguous. Regardless of how it is used, \u201ca gun or firearm is always a weapon; foundationally, elementally, <em>hoc<\/em> <em>est quod est<\/em> (it is what it is).\u201d Therefore, Noble Eagle Sales was entitled to coverage.\u00a0<\/p>\n<p>Got that, counsel? When interpreting a contract term, look to the foundational, elemental meaning. No convoluted logic game can change that. Because it is what it is.<\/p>\n<figure class=\"wp-block-image size-full\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"770\" height=\"495\" src=\"https:\/\/i0.wp.com\/www.attorneyatwork.com\/wp-content\/uploads\/2025\/01\/Hoc-Illud-Est-Quod-Est-2.png?resize=770%2C495&#038;ssl=1\" alt=\"it is what it is or hoc illud est quod est\" class=\"wp-image-100038889\" title=\"\"><figcaption><\/figcaption><\/figure>\n<p>It helps to make this argument in Latin. My research shows that the correct Latin wording is <em>Hoc illud est quod est<\/em>. To prove it, Amazon offers 11 pages of <a href=\"https:\/\/amzn.to\/4giHoFS\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">merchandise emblazoned with this sentiment<\/a>.
