Attorneys from Cooley and Bursor & Fisher informed a federal judge March 14 that they have reached an $8.9 million settlement agreement in a consumer class action against the advertised benefits of Poppi’s Prebiotic Sodas.

VNGR Beverage, doing business as Poppi, and a class of plaintiffs indicated to the U.S. District Court for the Northern District of California that they settled, according to a March 14 motion that asked the court to approve the agreement. According to the plaintiffs’ unopposed motion for preliminary approval of class action settlement, the parties reached a resolution that establishes a total settlement fund of $8.9 million to be used to pay all of the approved claims by class members, notice and administrative expenses, court-approved service awards, and attorney fees.
