A federal judge resolved a contractual dispute last week on its own motion, awarding a Missouri-based truck dealer $1.54 million after the defendant allegedly failed to pay for its order for composite trailers.
In a March 28 decision, U.S. District Chief Judge Stephen R. Clark of the Eastern District of Missouri granted summary judgment in favor of Trans Advantage under Federal Rule of Civil Procedure 56(f)(3), which allows a court to consider summary judgment on its own after determining material facts were not in dispute. On March 19, Clark notified the parties that it was considering the plaintiff-favorable ruling for breach of contract and negligent misrepresentation claims lodged against LTE Trucking. The court ordered both parties to submit their positions by March 25, though there was no dispute against the judge’s decision.
