“[T]he Court harbors a grave suspicion that more than one witness who submitted a declaration in opposition to the motion to sanctions has perjured themselves in either their declarations or earlier depositions, U.S. District Judge Virginia M. Hernandez Covington observed in a text order on the docket.
A federal district court in Tampa will hold a sanctions hearing Thursday involving Gary Cardone, a prominent crypto investor, and one of his companies, Chargebacks 911, over allegations that his employee Ben Scrancher deleted various selected Skype messages, including some a week after the business learned it would face a class action lawsuit.
U.S. District Judge Virginia M. Hernandez Covington of the Middle District of Florida entered a text order on the docket that said, in scheduling the hearing, she is “deeply troubled” by the allegations in the plaintiffs’ sanctions motion, “which is well-supported by the evidence of the deletion of Skype messages a week after Plaintiffs’ counsel alerted Defendants to impending litigation.”
